It is day two of the Kenrick Tyson murder case presided over by Justice Errol Thomas.

Tyson is charged with murdering Cecil James of Concord at Hibiscus Inn Hotel between May 9 -10, 2009.

On day one of the trial, the State called three witnesses including eye witness Nasha Daniel, who was in a relationship with the accused at the time of the incident.

Dr. Martin Christmas, who was the District Medical Office stationed at Marigot pronounced the body dead.

He told the court that he was called by the police and when he went on the scene, saw a body of a male adult, motionless on a bed in a pool of blood.

Upon close examination he also noticed blood “around nose and mouth” of the body.

According to Dr. Christmas, he carried certain medical test and found the pupil of the body “dilated and fixed and unresponsive to light, had no heart beat or breathing sounds”.

“I pronounced the body dead,” he stated.

Dr. Christmas said also saw swelling in the head and face was “a bit disfigured”. The swelling, he said, was irregular.

Daniel, who was on the scene with the accused, she said had “a long gun” when they went to Hibiscus Inn Hotel at the time of the incident.

The house, she said, was open and she stayed by the door while Tyson entered took a piece of wood and lashed James who was lying on his back.

“He gave him two other blows, I asked him why he was doing that and he made no reply,” Daniel told the court.

Under cross examination, which lasted five minutes short of two hours, by defense counsel, Bernadette Lambert, Daniel was told that she conspired to frame Tyson since their relationship was “bitter and rocky.”

“You wanted to get back at him…you were the one who struck the deceased,” Lambert told Daniel.

But Daniel vehemently denied the suggestions.

In response to questions, Daniel said she was never threatened by the accused and he never used the gun.

Wayne Norde and Bernadette Lambert are representing Tyson, while Sherma Dalrymple and Fernila Felix is leading the State’s case.

Tyson was in 2011 found guilty of the murder and sentenced to life in jail by trial Judge Bernie Stephenson but on appeal the Eastern Caribbean Supreme Court (ECSC ) upheld the appeal quashed the conviction and ordered a retrial after ruling that several procedural errors by the trial Judge rendered the conviction unsafe.

The matter is presently ongoing at the court.

    was she charged along with him? if i read correctly, she was there and did nothing to stop him, so i think she conspired with him to kill the man.

    So daniel gets no jail time? She was there so I think it would have been fair for her to have been arrested too. SMH

    If the police conducted a thorough investigation, as taking fingerprints, the results should reveal who hit the man with the wood.
    Heartless people hit another, to maim and kill the person. Do you not know, if caught you will be arrested and charged and may spend some years in prison? There goes your good name and freedom for life.
    The man’s life was a God-given precious life. A grave injustice was done to him. His right to life was taken away. You still have your life and want your freedom. Is this fair?
    The deceased has relatives who will constantly mourn his loss. It is painful to lose a loved one through a natural cause. I visualize it is much worst through an unnatural cause.
    People must think twice before they harm others. Just as we should say, “God, grant me patience”, the same should apply when confronting someone with such an urge, and say, “God help me!” He will. Think God at all times to keep you from trouble.

    So is there any evidence related to finger prints? Was the plank of wood ever found and entered into evidence? I hope that justice is served!

    As Lawyers we were trained to put our emotions behind us when defending our clients, whether we know that our client is innocent or guilty, it is our job to represent them to the best of our ability. At the end of the day its a job and we Lawyers must eat as well….

      Well, you have much to answer to God for. Have a good talk with God and ask if He is satisfied with those lawyers who defend murderers/criminals.
      Lawyers get an exorbitant sum of money for defending their clients. Their job is to defend them but at what expense to even their immortal souls.
      A calypsonian once made a song, “Lawyers Are Liars.” They will defend their clients who murdered and who committed other crimes. There are times they are acquitted or receive a lesser sentence.
      This is why I never had the urge to become a lawyer. A family or real estate lawyer but not a criminal lawyer. While I recognize there must be criminal lawyers, I would not want to be in your positions. Your immortal souls may be at stake for defending murderers/criminals.
      A family member is a lawyer. Thank God he is not a criminal lawyer. I would have to pray harder for him. :lol:
