Salisbury resident fined for theft at ATM

Salisbury resident Bernard Pascal has been ordered by the courts here to pay EC$1000.00 by Friday in compensation to Miguel Pascal or spend three months in prison.

Pascal was also slapped with an additional fine of $800.00 to be paid by 30th June.

He was told that failure to make that payment within the stipulated time would land him in jail for three months.

He appeared before Magistrate Candia George on a charge of theft, and pleaded guilty to the offence.

Pascal was brought to the court after withdrawing $1000 from the account of the complainant.

Complainant Miguel Pascal is reported to have gone to an ATM machine to inquiry about the balance on his account on 26 April, 2012 but walked away from the machine before the transaction was completely over.

The court heard that a few moments later the accused noticed that the screen of the machine showed “would you like to complete another transaction?” and quickly withdrew money from the account.

He told the police that he used the money to purchase parts for his scooter.

The Magistrate expressed her disgust over his action of “stealing for things that are not necessary.”

She said she took into consideration the fact that he pleaded guilty at the earliest opportunity.

He was also a first time offender.

Pascal was warned against such conduct in the future and asked to calculate the consequences of an action before going through with it.

    HMMMMMM well he shoulda “put on d mask” like Lightning if he didnt want to get caught lol……the fact that he working has nthg to do with anything because usually it’s the working man/woman who have the most commitments……….he saw an opporunity to “set up” his scooter without having to wait till his next payday and he too it…..it was a foolish thing to do, but let’s all hope he has learnt his lesson…..

      I would dare to say that there are circumstances when when it is necessary for the individual to steal…just as there are times when it is necessary to kill. The Law may not explicitly state that, but I believe the concept of mitigating evidence implys that.

      @ ron rainbow: I believe the judge meant that if he had stolen because he was hungry, or his children were hungry, that would be a necessity; however, he stole for material things. The judicial system is usuaslly more lenient when people steal for basic human needs, the main one being hunger. The fact that he plead guilty shows that he is remorseful.

    HOw come you in the ATM with him? Your family man? THe man trust you to bring you ATM with him and is so you betraying the man trust boss?

    People must be careful how they use these machines. It could have been someonw else that come upon that message on the screen and wipe out the account clean.

      you cannot withdraw more than a $1000 per day from the ATM…i guess that’s all he could remove, if the account had more money and he had the opportunity to remove more i guess he would…but shame on you doh Bernard you coulda just been a good Samaritan then spoiling your reputation smh….

    i just knew that something like this would land someone in court. last week a friend ask if i go to an ATM and i notice that the screen showed would u like another transaction what he would do..and i said to him i would not take chances cause there are cameras anyway, whenever u go to an ATM. now he is changing his mind after reading this about pascal..smdh.

      Those ATM machine are no good that should not have ever happen in other to make another transaction it should have ask you to enter your pass word,some of these ATM in Dominica are all updated.
