Seaman fined $6, 000 for hidden ammo and explosives

A twenty-six-year-old Colihaut man has been fined $ 6,000 to be paid within the next 18 months, for the possession and importation of ammunition and explosives.

Marley George, who was employed as a seaman aboard the vessel MV Lady Rena, admitted to importing 93 rounds of 410, 50 rounds of 12 gauge ammunition along with 390 bandits explosives and 40 flares onboard that vessel on February 10, 2010. George pleaded guilty to the charges.

According to the facts of the case which was presented by the police prosecutor, the vessel, owned by Marlon Peters of Colihaut, had left Guadeloupe for Dominica at about 4 p.m. on February 10 and arrived around 1 a.m. on February 11, 2010.The cargo aboard the boat was offloaded at about 8 a.m. at the Long House Harbour in Portsmouth and at about 1 p.m. that day. Customs officers conducted a routine search on the boat, and Officer Smith found the illegal items hidden behind a bale of rope in the bow of the boat (cargo area).

The boat’s crew included four persons and the defendant.

When questioned by the police, George quickly admitted to being responsible for the ammunition and explosives.

“A French man that tell me he have bandit…. he tell me he just voleh it from a partner, if I want to buy,” George told police.

On Tuesday at court, Defense Lawyer David Bruney in mitigation asked the court not to impose a custodial sentence on his client. He stated that George was a first- time offender and had not wasted the court’s time.

“This conduct is foreign to my client… He has a job, any incarceration would affect it,” Bruney added.

Magistrate Tiyani Behanzin ordered George to pay a total of $333 monthly until he pays off the entire fine by July 2011. If he misses any instalments he will immediately have to pay the full amount of the fine. George was fined on the possession charge while there was no separate penalty for the other charge.

    Its interesting how we all cry LORD LORD when we are in dire straits. The only time we seem to realise He is around is when trouble hits us. When we are doing our dirty lil sins, we conveniently push Him to the back of our minds. Don’t Try to sugar coat what this dude did. Everyone is responsible for their own actions. And as for the other idiot who said bandits don’t cause any damage. My cousin spent a week in the hospital because of some fool who burst one by her feet.she still got the scars from almost four years ago.

    I have read all the comments posted and respect everyone’s comments. Thank God for freedom of speech. Many of our young people today find and put themselves in difficult and dangerous situations, and should face the consequences of their actions. The courts system may not always be fair to us, this is why God is going to be THE FINAL JUDGE at the end. Someone made a comment, i think it was PEACE that maybe Marley knows a top head in the force. I don’t know where this came from, but one thing i know is that when God wants our attention, he allows us to go through a valley, then takes us out of it so that we can see His hand at work. I’m not trying to be bias, by no means. He was wrong, as he was told by his family. He is an adult with understanding and we just hope that he has learnt his lesson. We continue to pray for him, because nothing is impossible with God. There are many people today who have done worst things an God has delivered them, who is Marley that God cannot deliver? Sin does not go unpunished. Many people turn to the evil one to fight their battles, but God allowed him to pay for his sin/crime and what happens after that is for Marley to decide.

If it was my brother and he did this stupid deed, I say thro the books at him. He knows better. You guys don’t realise in ur “cast the first stone” bull, that lives were basically spared by this seizure. The dude could have gone on to sell these ammo to folks who had no good intentions and ruin innocent lives. Could have been ur cuz, aunt, friend, bro, who cud have been injured.     Since i am not familiar with the young people of the village, i can only check surnames, i do not care what part of the island that idiot is from, but to be smuggling ammo, explosive into the country is very dangerous. I do not care if it’s his first or hundredth offense, 6 000.00 is nothing. Who knows what his intent was? he should have been fined and jail for this offense

There are many boats coming into the our ports with worse things than that and customs will not search because of who owns it and what they get from it. I know what I am speaking about. Not only MV Lady Rena should be searched but all other vessels , I MEAN ALL VESSELS.

    I can’t understand how certain people are so foolish. The magistrate has to listen to facts on a matter before he can give a sentence. A sentence is based on the facts given by the prosecution. If he gives a fine of $6000.00 there should be a reason why that happened. The prison being small is not the magistrate’s problem….that;s something to take on with the government. A magistrate can’t give sentences based on the size of the prison. Doesn’t that sound just stupid to you? I guess a man can beat up another and he shouldn’t be sent to prison cause the prison is small… Don’t make hatred and jealousy take over sensible thinking.

    What are our judges drinking? Another slap on the wrist for a deep fracture of the law. The sentences being handed down recently are way too lenient for the crimes being committed. “The conduct is foreign to my client”? What does that mean? I do not think it is foreign conduct at all… It just happened that this is the first time he was caught. He knew that he was buying stolen property.

    There is an intent factor that the judge ignored. Had he not been caught, the effect of his crime would have been felt by some innocent citizen(s).

    To my Dominican judges: Stop playing politics and having your duty to dispense justice swayed by personal/political affiliations. Our judicial system has to be upheld to the highest stand of integrity and impartiality. You predilection in dispensing justice is frightening.

    Grow a spine. What happened to the oath that you took before assuming residency on the bench?

    EH BEH LOOK RORO !

    So ball head lawyer finally got the message then. Charter had to put some sense in his head Papa Bondieu the prison is overflowing with young men…. has to humble himself and this is not Canada, Usa, or England because when you go up stockfarm you hardly ever come out better. So one gas to watch how they sentencing people and he needs to do some course on the Dominica Culture before he continues to put the hammer on POOR MALAWAY CHILDREN ! HIS RULING ON THIS FIREARM CASE TELLS US ABOUT … Let us pray for him. Its not us that kill his daddy so dont punish us with fines and sentencings but again some of youths have to behave themselves.

    here we go again. He has an opportunity in having a job and he playing with it. He bought it from a thief so he also is a thief. If was his boss I fire him. Who know what else he carry and how often also in the opposite direction(Dominica -guadeloupe).Just giving we people bad name.
