Sexual offenses dominate January Criminal Assizes

High Court fineSexual offenses will dominate the January Criminal Assizes which get underway in Dominica on Tuesday.

A total of 24 sexual cases will be heard.

On the list are 12 cases of indecent assault, eight cases of unlawful sexual intercourse, three cases of incest and one rape case.

Three cases of murder will also be heard.

The murder case of three Soufriere siblings will be re-tried during the assizes.

Herbert Xavier, Manuella Williams and Loretta Xavier were jailed for 15 years after they were found guilty of murdering their brother, Harrison Williams, in September 2010.

However in 2014, the sentence was quashed by the Eastern Caribbean Supreme Court (ECSC) after attorneys representing the three argued that there were many errors by the trial judge, Brian Cottle, rendering the conviction unsafe in law.

The Judges said the errors were a “clear miscarriage of justice.”

The three are now on bail in the sum of $250,000.

The matter of Kenrick Tyson, who was sentenced to life behind bars for the murder of Cecil James, will also be heard.

The incident occurred in Concord on May 10, 2009.

In 2014 the ECSC ruled that the matter must be re-tried saying the trial judge had “erred.”

Also on the list is the matter of David St. Jean, whose 25-year sentence was also quashed by the ECSC ,and a re-trial ordered.

St. Jean was convicted of murdering Clement James in September, 2010.

His attorneys had argued that the trial judge failed in law to direct or give proper direction to the jury on self defense.

    Imprisonment is not enough for them and will not change them. They have a bad, immoral habit which cannot be changed overnight or even in a few years.
    There is a way of handling sexual offenders, especially repeat offenders if they are released from prison. Place them under house arrest, in shackles with an alarm system which will have them monitored.
    The problem is these people are not treated or cannot be treated. What can be done about them? The government and the DPP must find a feasible, constructive and permanent way on how to treat them. If they cannot be treated then imprison them for life. They should not be allowed outdoors and to roam the streets. You know what the end result of this could be.

    Why are so many offences related to sex? it would be interesting to know what is really causing them? the offenders need help; they could be addicts who cannot control themselves without the right help.

      They need the grace of God but they have rejected him. Sex is their god.
      The Mother of God, the Ever Blessed Virgin Mary said, “Many souls go to Hell for sins of the flesh.” She speaks through the Holy Spirit. Therefore, this is the Word of God.
      These people need counseling and rehabilitation. I hope they get it. If they do and do not change, know that the devil has their souls. They should be castrated.
      If they are imprisoned and later released, they will surely re-offend because they cannot help themselves. They are sick people.
      These men should not be released in mainstream D/ca. There are those who murder as well. It may come to that when their advances are rejected.
      Sometime ago a man asked the Ontario Court/Judge to castrate him because he was a chronic pedophile and he would re-offend. His wish was granted. I wish those in D/ca who commit sexual offenses would do likewise; in fact, all those over the world who commit sexual offenses.

      The cause?

      All sin erupts from within from the fallen nature we inherited from Adam.

      The more we feed the fallen nature within us the stronger it becomes. When we yield to a temptation the more difficult it is to resist the next time.

      Because sex is so integrated with every part of our total life, sexual temptations are more difficult to cope with than most (many all) other sins. Things that lead to sexual temptation or cause us to be vulnerable should be avoided. Pornography is a stumbling block. Drinking alcoholic beverages lowers inhibitions. Allowing ourselves to be in bad company is another. Engaging in loose conversation is also misleading.

      There should be an emphasis on teaching the moral code God has given us to govern human sexual behavior from such scripture passages as Romans 1:21-32, 1 Corinthians 6:9,10, Galatians 5:19-21, and Jude vs. 7 in the homes, schools, and churches of the nation.

      Whenever you speak/write/comment, put on your thinking cap. There are some good priests and I am certain some good pastors. The offenders are not in the majority.
      How many good married men you know who remained faithful to their wives?
      How many boyfriends are faithful to their girlfriends?
      Do you note your biased attitude?
      How about you, if you are man? If not, how about your fathers, brothers, your male ancestors. This is why when you comment, guard your heart, mind, mouth and fingers.
      Know that you are not God. Our Lord told us do not judge lest we be judged two-fold. God will hold you accountable for your words; careless ones.
      State the fact if you know it to be factual. Do not repeat those hearsay which may not be accurate; not all of them are.
      The eyes of Jesus are on every word we state and on every step we take. You may be the one who will rut from the head as well. Therefore, be careful what you state about others. It is a warning. Take note and pay heed…

      Sexual crimes are no laughing matter. Intelligent people do not joke about anything this serious.

      We are all sinners in need of God’s salvation which can only be received through faith in Christ. However, the implications of sexual sins often influence other areas of our lives. Sometimes the results can be seen in the second and third generations.

      Alcohol, porn, and bad company and loose conversation are often contributing factors in the downfall of those who might have been decent individuals. These are things to be avoided.

      There needs to be a fresh appreciation for the moral code God has given us in the New Testament in scriptures such as Romans 1:21-32, 1 Corinthians 6:9,10, Galatians 5:19-21, 1 Timothy 1:9,10, and Jude vs. 7. It would make a difference if these instructions were taught in the homes, schools, and churches,
      and exemplified by those who teach them!

      The cause?

      It is the rebellion of the human heart against God that is the cause. :twisted: Let me address it.

      The Word of God needs to be taught (not just read) in the homes, schools, and churches of every nation and that includes my own nation, Canada. I am referring to the moral code God has given us in the New Testament to govern human sexual behavior. It is found throughout the New Testament but especially in such passages as Matthew 19:4-6, Romans 1:21-32, 1 Corinthians 6:9,10, Galatians 5:19-21, Ephesians 5:1-7, and Jude vs. 7.

      When the Word of God is ignored governments lose respect, schools deteriorate, the institution of marriage loses status, families fall apart, and crime increases. It does not happen over night. It is the
      gradual result of God Himself being made unwelcome in society. It is time we asked ourselves what kind of nation or world do we want to leave for our great grandchildren.

    Why is there so much incompetence in the Dominican justice system? This is a scary country! Dominica has become a country where you are afraid to get sick and have to use the hospital or to get into any situation where you need the justice system. And the list goes on and on!

    Sexual offenses top the charts again. This is crazy. They need to start exposing those perverts and label them as sex offenders for the rest of their life. Will serve as deterrent. This is crazy.
