The trial of murder accused Shane Degallarie continues to linger in the court system with the matter now being traversed to the January Criminal Assizes.
This is the third time the case has been traversed.
Degallerie has been charged for murdering Justin Joseph of Fond Cole on April 23, 2010.
The trial commenced on September 26, 2012 but came to an abrupt end on October 8, 2012 when the court was informed that one of the jurors (the foreman) was hospitalized due to illness.
Justice Bernie Stephenson, told the court and jury that “because of the nature of the offence” all nine members are required to be “present” during the hearing and that since one juror was still incapacitated, the jury would be “discharged”.
When the court convened on Thursday it was revealed that the juror was still sick and Justice Stephenson had no choice but to discharge the jury.
A new trial date will be issued on January 15 2013 at the start of the January Criminal Assizes.
Degallerie who is represented by Zena Moore Dyer, Gina Dyer Munro and Joshua Francis remains on bail.
The office of the Director of Public Prosecutions (DPP) was represented by DPP Gene Pestaina along with State attorneys Clement Joseph and Arthlyn Nesty.

If so, why is it that the authorities did not contact some other juror?, what about stand by Jurors?, man the whole world is laughing at DA, in this day and age, this is a shame

So long reccomendations were made to amend the law to make provision for alternate jurors it has not been done. This is a crying shame and a total waste of the resources of the country everytime something happens to a juror a case has to start again. Attorney General do something to earn your salary instead of just playing politics. Do your job man !!!!!

What type of justice system is this in Dominica? The juror did not fall sick while the Court was in session. The case should not be held up or adjoined for an indefinite period if a juror is sick. There should be stand-by jurors, one who could be called-in to continue the case.
Furthermore, the Court should request the sick juror’s doctor to submit a medical report on the condition of the juror and when the juror will be able to report for duty. If this is not possible in the near future, then another juror should be chosen.

That is utter rubbish! Where are the alternate jurors. So if the juror drop dead what will happen. That is serious lack of justice. This matter has been going on for so long. These are the sought of things they need to fix in the system, instead of every beginning of azzizes having big show and talk for nothing.
