Wesley suspects denied bail

Robbery suspects, Wesley residents Troy Henry and Irwin Prince have been denied bail.

The two men, represented by attorney Joshua Francis, were brought before magistrate Candia George on Thursday, after being charged with robbery and burglary of non-national resident Elizabeth Egberton.

Goods worth $10,720.65 which include a laptop, 2 cell phones and a digital camera were alleged to have been stolen from the home of the victim.

Inspector Claude Weekes, the prosecutor, told the court that firearms were used in the commission of the robbery, most of the stolen items were not recovered and that the accused had made threats to kill the victim if she reported the matter to the police.

He also informed the court that the fire arms were not yet recovered by the police and that ongoing investigations showed that another individual who was also involved in the crime was not captured.

DNO had reported earlier that the victim, an American living in Dominica for the past nine years, was said to have been beaten with a cutlass and robbed at gunpoint.

She was also reportedly raped.

Attorney Francis argued that the men deserved the fundamental right to their liberty.

However Magistrate George indicated that she had to consider the public interest amongst various other elements.

She said on that basis she was denying the two bail.

    It is sad you never had the love of your mom and dad because they abandonned you since you were a baby boy. You raised yourself in a good manner. Going to church, helping people, loving people… But the fact you never had parental love and those girls used you and treated you like dirt because you were too nice, took away your heart and broke you down.

    I know my comment will be trashed but; Non of you here knows about the poison he walked with daily because of all his problems, I’m just very sorry another person and a lady especially had to pay for it. As a victim of rape when I was a 7 year old, it’s heartbreaking and I do not agree with it, but God is in control, and may God bless Dominica.

    All of the people involved in this case will be in my prayers especially the lady. I feel for her.

        While he is doing his job, he is begging for the freedom of criminals who committed such atrocious crimes, to be out on bail, enjoying their freedom and will no doubt victimize other people. Do you think that God is pleased with him? Would you want such a person out in mainstream Dominica to roam the roads/streets? If you are a woman and they meet you, they could do likewise. They could also victimize men. Watch out for yourself and family members.

    So the police say they still investigating but the jury at DNO done convict the people already. What a thing eh!!

    People stop getting so emotional. There is a process. These people may be guilty, but not everyone who is charged with an offence is guilty.

    What if you were accused of committing a heinous crime, but you were actually innocent of that crime? Would you not want to get a fair trial? DOn’t be so quick to judge. All you have so far is what you read on DNO. Patience my bredda.

      exactly. We pay taxes to pay judges. What for, if everybody thinks to be the better judge?

      It is not the defense lawyers job to decide upon guilt or to regard the rights of victims. These points are up to judge and jury. That is how it works.

      If everybody does his job properly, things working out fine.

      Nobody would ask the local welder for medical assistance or an accountant to fix a car. But why do so many people think they know better how the law system works and/or is supposed to work?

        Many times, “the people” are smarter than those judges and lawyers. Education does not mean common sense. The people think and are not practicing preferential treatment and a one-way one at that. It could very well have been them or their relatives. You see, they are not paid and therefore are not concerned about amassing more money and clients. Their sole concern is for justice and for the victims. It is their ‘fundamental right’ to stand up for what is right to do and say.

    The suspects have a fundamental right to freedom? This lawyer is joking. I think he needs to return to law school and do some good articling for a long time. I wonder if this had occurred to a female relative and one close to him how would he feel?
    What about the fundamental right of the victim? Note what they did to her, victimized her, raping her, stealing her items, using guns and threatening to kill her if she told the Police. They placed the fear of not living in Dominica in her. She may never get over this trauma.
    Those men do not deserve one bit of freedom and not for a long time, if never. They are heartless and disrespectful people to do this to a woman, one who has been residing in Dominica for nine years. She loved DA and felt it was a safe place to reside. Now they have caused her to change her mind about that.
    Do they not love their mothers, sisters and other female relatives? If they loved them, they would never do something like to a woman or anyone for that matter.
    For committing such a crime, they should be incarcerated for life, never to walk the streets of Dominica again. Dominica and its nationals will be a safer place without them.

        And who are you? You are no Roger Moore. Are you a law-abiding person? You may be a relative or friend of the lawyer or those criminals. I have a right to comment about the foolish statement of the lawyer, begging for freedom of those criminals. They almost murdered the lady. In this respect, they have forfeited their rights to be free in society. There is no excuse for what they have done. If they want their freedom they should act as law-abiding nationals. The lawyer should also advise them accordingly.
        The only right criminals/murderers have is to be treated humanely when arrested, while incarcerated, to feed them, give them at least a mattress and pillow to sleep on and allow them to bathe. This is based solely on compassionate grounds and as a human being. In view of this, they are getting a lot from the Law, from society in general.
        I do feel that the lawyer, for one of his calibre and learning, erred making such a statement. For this reason I do think he needs to learn more about defending a criminal. Lawyers do not consider the fundamental rights and freedom of the victims; always the criminals. Those who want their freedom must abide by the Law.
        Someone, in fact all of us who are law-abiding people must stand up, speak out and write about “the fundamental rights of the victims” who were denied their freedom, rights, dignity and were oppressed by those criminals who have no mercy for others. For this reason and in this case, I have no consideration for them.
        We must stand up for justice and peace. It is too bad if you who are supposed to be a law-abiding national opposed what I stated. Wait until it happens to you or members of your family, your words and tune will be different. It may just happen to you in time. Wait and see.

        This is another reason to keep him out of society. Surely, the government and the police should be aware of that and ensure that he does not contaminate anyone with it. I hope the lady is not affected. Those criminals surely run tourists and visitors away from Dominica. So much for their love of country, Dominica.

      u really think so? The right to a proper defense is a big achievement… back in the day people were killed just because neighbours pointed at them and accused them of wichcraft or stuff like that. If you deny a decent defense, prosecution and police can do whatever they want. This may end up and police terror and total suppression. Then, you dont have any rights anymore. Not only offenders, especially ordinary innocent people will not be protected in any way anymore.

      Is that what u want? If there is no defense, why bother about prosecution at all, and why pay the magistrate and all that court-carnival? Just ask on DNO what should happen to the suspects. (I am avoiding the word “offender” on purpose)

      The lawyers are not criminal by definition, they are an integral part of a working civilization and promote the rule of law in a society.

        What justice and for whom? For criminals? They will get justice and this is to be heard in Court.
        Wait until you find yourself in that situation as the lady and others and your words will be different. Too often people blame society for the actions of criminals and not the criminals themselves. This is supporting them in their evil acts. You are not fair and you do not practice justice or teach it. According to your words, all of us, no exception including yourself should get out there and commit crimes.
        Society needs to be eradicated of crimes and this includes Dominica. Those who take it upon themselves to commit crimes must be dealt with the full force of the Law. If it is possible to rehabilitate them, I am all for it. Until such time, they should be incarcerated for I reiterate that they have forfeited their freedom since they are living a life of crime and are a menace to society, the same one that you reside in.

    i hope that the uncovered stolen item are in the custody of the other suspect, if not ….the police need to investigate if anyone else is in possession of these items and charge them very harshly…..these people who buy stolen items are not better that the thieves themselves

      the police and the legal system need to start with these parrows who steal form peoples gardens to sell to individuals out there….they buy form these people knowing they don’t own any garden…..a deal must be made with the criminals …they will be not be charged if they give names of people who buy form them or rather set up people who buy from them……i know they would rather do that than go to jail……we need to start somewhere to stop/decrease all these crimes

      Some people just wicked, they know some of these guys working nowhere to own some of the stuff they having for sale, people who work descent jobs sometimes think twice about buying some of the items because of cost and another lower price can do the job……but they have selling and people there buying from them……wicked!!!

    Rights? The attorney was trying to say that the suspects deserved a fundamental right to their liberty? How about the NEED for the public to be free from gun carrying, robbing, beating, RAPING, thugs?? Lock them up and throw away the key… actually, maybe take them out to the center of the sea, cut off their and throw them to the sharks. They don’t deserve the right to continue to breathe! They surely don’t deserve to live among the wonderful people of Dominica!

        This was a friend this happened to, after hearing the story of her experience and knowing that her life has been forever changed it is pretty difficult not to get emotional about it. What if this happened to your mother, sister, friend? Dominica has received more undeserving bad press because of ANOTHER rape and robbery incident, so you know what I think? The people of Dominica need to get MORE emotional about it and fight to drive out the “few” that ARE damaging the masses. This is a whole heap larger than this one incident, this is about ALL of the people of Dominica and how it is going to effect each and every one of us.

        Contracting AIDS is indeed as bad as a life sentence. We know that once people have it there is no cure for it. Their entire life will be changed. They will never be able to enjoy life as they did previously.
        If he knowingly has AIDS and gives it to another or others, he should be tried for murder. People have been sent to prison and for life for giving it to others. The crime is worth life imprisonment. In the countries which have capital punishment, those people are executed.
