Woman who asks Canefield man for $3 gets hit with stone

Dorival Scotland

Dorival “Bohyo” Scotland of Bena Ravine, Canefield has been sentenced to one year imprisonment for wounding Claudia Degallerie of that community with a stone after she asked him for three dollars which he owed her.

Scotland, who appeared before Magistrate Candia George yesterday, pleaded guilty to the offense on Thursday.

The incident occurred on July 29, 2010 in Canefield and as a result, Degallerie spent two days on the Dawbiney Ward at the Princess Margaret Hospital for the wound to her head.

According to the facts of the case presented by the police prosecutor, when confronted on the matter on August 17 Scotland told police, “She hold me in my shirt and she tell me she want her money. She tell her daughter go for a cutlass for her. When I hear the gate open, I say her daughter coming so I hit her with the stone.”

Scotland has previous offenses, according to the prosecutor.

In response to the facts of the case and after viewing the said rock which was tendered as evidence, Magistrate George expressed her disapproval of Scotland’s behaviour.

She asked him, “You didn’t see the size of the stone you hit the lady with? You wanted to kill her?”

“No. I just pick up a stone…” he replied.

“That kind of stone is a death shot you wanted to send … She stayed in the hospital for two days. That suggests that something could have gone wrong. It’s very serious to me. I do not take this lightly at all,” the magistrate said before passing sentence.

    @WELL WELL:
    My dear, I could comment so many times on incidents that I have noticed as I go about my business in Toronto. Never a day or a second/minute goes by, that some incident does not occur in this City of Toronto of all be it that we hear and read about them through the Media. Some will make you laugh too even though they are serious cases.
    On Saturday, I was on my way to a mall which is close to where I reside. Walking towards it, I observed a woman in a van who came out of it and began quarreling with a man. I wondered what caused this. She walked to the sidewalk of the mall and hit the man. Lucky for her she was not on a main road. I thought that the man was in the vehicle and may either be her husband or relative. They were not Canadian people. By their accents I thought that they are Europeans and both were approximately in their 60’s, if not older but not younger.
    I could not believe my eyes and what I was hearing. She began hitting the man. He tried to hit her back to fend her off but he was not aggressive towards her. She utilized some terrible swear words to that man. It was evident that she was the aggressor.
    At this time I thought if only the Police was around and thought of calling the Police. I thought this fight could be dangerous with injuries or could be fatal.
    I kept on walking and looking back and hoped that this confrontation will not be a serious one. The woman got back into her vehicle and she drove towards the main area of the mall and kept on telling the man off with some profane language. I thought, “What a woman, a bad and ill-tempered one.”
    I wondered what did that man do to that woman. If he were a different person, he would have fought with her, injured her or even murdered her.
    I got a second thought that she was driving the vehicle on her way to the mall and he may have cut across her and she commenced her road rage. I have never seen a woman carry on like this, in public, towards a man.
    We never know what we may encounter and with whom. The advice is to be careful and do our utmost at all costs to avoid such confrontation. We do know as I have learned when I resided in Dominica, it takes two to tangle. There are times these situations come as a surprise and we do not know what our reaction will be. The saying: “Who knows what lurks in the heart of man/woman.”
    I do think that the woman should also have been arrested and charged for inciting this incident and asking her daughter for a cutlass who probably brought it to her. She disturbed the peace. She threatened him. Her intent was to use it on the man to injure him or murder him. All the man owed her was $3. I would not want to befriend such a person or to be near her and especially if she is in a bad mood. Her day will come. The Dominican Law must be fair and just.

    @eddie:
    Utilize your basic common sense. Dominica’s money is, “dollars and cents”; not pounds and by no means British pounds. Therefore, it could not be pounds. Do you know of anyone in D/ca lending pounds to and trading pounds with other Dominicans, in Dominica? They would have to go to the bank to exchange the pounds for dollars. What a waste of time to line up in a bank for hours to exchange 3 pounds to $3.00. In anycase, it would be more than three dollars. This does not make sense to me. This is why some people state that some of the comments make them laugh out loud – LOL. Some of them make me laugh too. Anything better you have to say?

    @Y2K:

    Do your best with the help of God to forgive her. She does not seem to be the kind of person whom you should confront and ask her for your money, ungrateful one that she is. Your safety and life is more precious than money. Also keep in mind the mercy of God.
    Read Matthew 18:21:35 – The Parable of the Unforgiving Servant, as taught by Our Lord Jesus Christ. It is obvious she did not practice it toward the man.
    Sad that he allowed his temper to get the better of him and now he has to bear the consequence of jail for a year. I do hope if he exercises good conduct he will be released in some months, if this is in the condition of the Law of Dominica.
    I doubt that this woman would forgive that he has injured her and that he owes her $3. Someone should give her the $3 to pacify her. Know that because of the type of person she is, she may still demand that he repay her the $3. Her heart is heavy- laden. She is in dire need of the blessing and grace of God. Pray for them both. We are to pray for everyone in the entire world.
    God bless you for your generosity. St. Paul said: “Never get tired of doing good.” For the day will come when you will reap the benefit from no other than God Himself.

    @Irie:

    It is better to walk away and fast as one can. If possible, he should have run away and report it to the Police. It is better to avoid such a confrontation which may result in injury and fatality. You know, two wrongs do not make a right. Threatening people could land one in jail and worst yet, injuring and endangering their lives. The Law has to exercise its duty.

    @Anonymous:

    This is a sad story of lack of love, generosity and forgiveness of one borrowing $3.00 and the other asking for it. One does not take a cutlass at someone who borrowed $3.00. Such a small amount of money to threaten a person’s life. This should never have occurred. Is this woman sane? She does not appear to be.
    If someone borrowed $10 or $20 from me and I had the means to give it and the person did not return the money, I would not ask for it or threaten the person.
    We do not know what financial situation people are in. No exultation here but I have lent people money, be it a $1.00 if they asked be it at work. I have been approached at work and been asked: “Could you lend me a dollar to purchase a bowl of soup, a sandwich or a few dollars for a bus ticket?” I usually bring my own meal. As a Dominican, I love my homemade meals. I could make this story longer about the reasons they make for not bringing their own to work. However, I willingly gave it with no thought of getting it back or asking for it. If some time later I am repaid, I will inform the person to keep it – do not bother. I do recognize that there are some people in this part of the world who are not generous.
    I have offered without being asked if I am aware that someone is in need of. When they can, if it is a certain amount, they may return it.
    I have been on my way to work on a bus and on different occasions some people did not have exact change or enough money. The bus driver has a job to do and he/she would have informed the person to get out. If I am aware of it and knowing the situation, I have volunteered to pay the fare by either giving them a bus ticket or the cost of same.
    I have also given those who beg on the streets $5.00 for whatever reason they said they wanted (be it that they lied and I am not aware of it) and, obviously I do not expect it back. I am certain there are other people who have done likewise and even more.
    Once again, Our Lord spoke about giving without expecting it back and without interest.
    I am shocked that the woman would have asked the man for the $3.00 and threatened his life. It may be that she was in need of it or that she is not a generous person. If the man did not have the few dollars to give to her she could have been patient and waited when he had the money.
    I am not condoning what he did. She threatened him and he retaliated. He is in prison for this length of time. I do hope when he gets out he will not retaliate.
    I pray that God will assist them both with a compassionate and forgiving heart and no such incident recurs which may be fatal. I would not be surprised that when he is released that she approaches hm for the $3.00. Oh my! It could be worst.
    We are here to help each other. We help someone, another will help us sooner or later. What goes around comes around in time. Whatever good we do for others with a loving and generous heart, it will be done unto us and two-fold and not necessarily by the person whom we have helped.
    There is a saying: “Everyone gets a turn at the wheel sometime as the wheel turns and all too frequently, when we least expect it”, one way or the other.
    We may not reap the benefits of it immediately or in this life but rest assured that we will receive our fair and just recompense from Our Lord. I like to say that as God looks on and is taking note, the benefits are out of this world. it is better to give than to receive. Jesus never forgets!
    Is there anyone to inform that woman accordingly? Also to speak to the man that he may not get out of jail worst than when he went in?
    I do hope that the Dominican Law has some provisions in place to assist both of them. If we want a better, safe society and a loving one, then rehabilitation is absolutely necessary.

    Hello people this reminds me of the incident involving the chinese contractors, when so many contributors to this site condone what Mr Joseph did . Here we have a case where this man was ask to pay what he owed, grab by his T-shirt and threatened with the use of a cutlass. So he thought the best thing to do was to use a stone to defend himself, what has happend to our civilization in Dominica .

    Now so many of you views thinks that this man need to be behind bars for his action and rightfully so and so was Mr. Joseph along with the victim in this case as well, for having order her daughter to get the cutlass. just for a moment lets just think about it , had she not ordered her daughter to get the cutlass just maybe she woud not have been hurt. so here we se that the consequence of her action cased her pain . We to protect our civilization and respect for our community by denoncing violence of any kind

    Oh we also need to be aware that the comment that we place here on this site can have consequences , for this is how we are judge by the content of our character . our kids and others are reading

    Sorry DNO – but reading the magistrate’s statements just makes me laugh. Too hilarious!!!!!!!!!!!

    “You didn’t see the size of the stone you hit the lady with? You wanted to kill her?””” – “That kind of stone is a death shot you wanted to send…: what the hell????????????

    Isn’t there such a thing as self defence if he thought he was going to be assaulted with a weapon. Isn’t a defense to assault self defence? Wasn’t he supposed to defend himself? 1 year in jail for an unprovoked attack? If she collared him.. then she was wrong. I do not condone violence but at the same time, everyone has a right to defend his security of person.

    I think the sentence does not fit the crime! So what happened to the woman who got hurt? She instigated an altercation over $3, got hurt, and yet the true victim/person defending himself gets 1 yr prison?

    What kind of defence lawyer did he have?

    I disagree with that sentence! It does not fit the crime!

    i am not taking sides but what if she had gotten the cutlass.did the judge ask her about that?for three dollars u want to harsha a man?d@#n woman.on the other hand for him to bend over to get a stone he could not have been holding him around his neck,more like by his shirt,he could probably have pulled himself free and run.

    whatever happened. ONE YEAR?sometimes the law is one sided.in his eyes and mind the guy believed his life was at risk,it was not premeditated.make him pay her hospital bill and community service and let the man go.they were both wrong

  25. WELL WELL
    August 20, 2010

    I happen to know both the parties involve personally and let me tell you, if that woman had gotten her hands on that cutlass … I am not saying he had right for hitting her with the stone but she had no right to even put her hands on him to begin with. For $3.00 you calling for cutlass? That could have been resolved in a more civilized manner

  26. bagai bien bandez oy
    August 20, 2010

    It’s sad. From what i read, that is a self defense story.

    For $3.00? Lady, post your address and i will send you the $3.00. Things are real hard in Dominica papa. So nobody can advise the man to take that lady to court for assault? Seems she decided to take the law into her hands and assault the man by “collaring” him, and even sending for back up and for a cutlass too,,,,what was she going to do? What were her intentions?…..Ahhhhh magwe sa. come on Candia, you can do better than that. Not because he doesn’t have a “big” name in the country or is not a child of someone in high position, he should be treated that way. No sar. But kids of police offices who shoot with intent, are out and court case dragging and dragging till it will drop from the face of the earth.
    That is how tings roll in Dominica.

    Chhh Bohyo, going up for a whole year? Well you shouldnt give de lady a kool wosh my boy. Fellas learn a lesson eh, anytime a woman collar all you, doh retaliate with blows or any kind of violence, just plant a washay on her (a long long kiss) …because when woman acting aggressive so, whether is for $3.00 or not, is usually something missing (like a little motion in de ocean?)…..and even though they charge you with sexual assault for de washay, the punishment for that is not a whole year….is usually 3 month…not true? Bohyo you well wrong, she maybe didnt mean ‘cutlass’ in de literal sense….you shoulda stay there and let her hashay you with love. LOL.

    I don’t like this judgement, I believe the guy’s story it makes alot of sense. Lets say she’s saying the guy burst her head because she asked him for $3.00 she owe him. That right here makes absolutely no sense at all because the guy is not crazy. Now, on the other hand, his story makes alot of sense, she held him by his shirt, i’m guessing that she wrapped her hand around his shirt around the neck area and she threatened his life by calling her daughter to come out with a cutlass. She was wrong for that!!! This judge did a very poor job, he could be charged for assault, but not one year in prison. And the lady instigated all this.

  35. Jeez!
    August 20, 2010

    Hmmm, that’s some serious stuff…if the lady really “collared” the guy for her $3….don’t get me wrong, he shouldn’t have hit her with the stone, because it could’ve been a fatal blow….but whether the guy was owing her or not, she had no right to hold the man up. But i guess infront the court, is who get the harder lash that everyone feels sorry for. So petty……….*sigh*
