A Roseau Magistrate on August 29, upheld the prosecution’s request that “bail be denied” to Ian Roberts of Yam Piece Stock Farm.
Roberts is charged with inflicting grievous bodily harm to Delroy Victor on August 26, 2013.
He did not enter a plea since the matter is an indictable one.
He was also charged with wounding for which he pleaded “not guilty”.
The prosecution, led by police inspector Michael Laudat, objected to bail, stating that Victor wh was still nursing his injuries at the Princess Margaret Hospital (PMH), was in a stable condition but the matter involved several persons and the police were concerned about the safety of Roberts.
“There’s lots of anger still in the community at the defendant…we fear for his life and we don’t want the matter to escalate and so we are asking that he be remanded briefly to allow tempers to cool out,” Laduat told the court.
But defense counsel Ronald Charles, objected, saying that the safety of his client was “not an issue” and the reasons put forward by the prosecution objecting to bail were “lacking legal tension.”
But after listening to both parties, magistrate Bernard Pacquette ruled that he was satisfied that the safety of the defendant was “an issue” and he also wanted to get some more information on the condition of the victim who was a patient at the PMH.
“I will also give the police some more time to deal with the matter and so for the safety of Roberts I will deny bail for a few days to ensure the matter does not escalate and tempers don’t flare,” he said.
The GBH matter was adjourned to May 22, 2014 and the wounding to March 14, 2014.
The court ordered that disclosure be done by December 31, 2013.
