Dominica Bar Association issues statement on recusal matter in election petition case

    You take time out to speak up for Miss Stephenson like someone abused her name.
    You can’t count the number of times you defended the constitution on one hand.
    We de public will now scrutinize every single one of you …. madam Justice is on trial and you against her.

    God bless the bar association but if memory serves me well the said DBA was once headed by the other Dcan resident judge. Hopefully they have enough trust in her ability to insist that she be allowed the opportunity to serve and render a decision in this case. She did not “bang water” to come to Dca and is well qualified in education, training, experience and with the moral and ethical upbringing to serve well. There is none within the ECC System with the moral fiber like her.

    Since her departure that bar association has never been the same. It is now considered a nonentity by a majority of its membership anyway because of its tilted posture towards those with political influence in Dca. I await a statement of support from them in the ability of the said “other” resident Dcan Judge to be objective and impartial, without fair, favor, malice or ill will.

    It’s rather unfortunate to see the way Linton demean women in this country but thank God our PM knows how to deal with him. I very disappointed to see the way the learned judge capitulated under the pressure because it showed a sign of weakness…..

      Your PM knows Jack S..t. If your PM knew how to deal with Lennox he would have agreed long time ago to meet him in a TV debate! But your PM is not man enough for that. Your PM is a coward and that also shows in all the things he does to our country and supporters of the opposition.

    It’s perplexing that the DBA will come out with a statement on the issue of the judge being asked to recuse herself from the upcoming case. I see that it’s correspondent wants to teach us the law in the statement that was released. Well in keeping with the law lesson, and since the system is adversarial, then the writer seems to be telling those who expressed their position about the judge, contrary to the writer’s viewpoints, that they are wrong. Isn’t this what the judicial system is about. Therefore, allow those with a contrarian point of view to say how they interpret things which they live every day without this” mightier than thou” attitude. Higher courts overturn the verdicts of lower courts all the time and even practitioners of the law disagree and criticize court decisions. The judicial system failed Jesus Christ so who else won’t it fail from time to time? It’s not perfect and don’t pretend that it is. Just know that we are watching you.

      “The judicial system failed Jesus Christ!” Say what!

      Now that state of mind is what I call carnal! That is why the World is in such a mess. Mankind has no “spiritual” knowledge about his Creator and His work of Life, but He is all about the Spirit. The quotes below are from Jesus Himself, His 7 “I AM’s”

      (1) “I am the bread of Life. He who comes to Me shall never hunger, and he who believes in Me shall never thirst”.
      (2) “I am the Light of the world. He who follows Me shall not walk in darkness, but have the Light of Life.”
      (3) “Before Abraham was, I AM”
      (4) “I am the good shepherd. The good shepherd gives His Life for the sheep”.
      (5) “Believe Me that I am in the Father and the Father in Me”
      (6) “I am the Way, the Truth, and the Life, no man can come to the Father without Me”
      (7) “I am the Vine and you are the branches, without Me you can do nothing”.

      Jesus is the head of the Law, there is no Law above Him. A failure you say!

          @Nkrumah Kwame, what explanation do you need? I stated the 7 “I Am’s” that Jesus claims to be, isn’t that enough?

          Jonathan claimed the World’s, “Justice System” failed Jesus. How can that be, when Jesus is above the World, its Laws, and everything that is in it?

          In my first comment to Jonathan’s, where he wrote that same nonsense pertaining to Pilate and Jesus, I showed him the dialogue between the two here it is again:

          “Then Pilate said to Him, “Are You not speaking to me? Do You not know that I have the power to crucify You, and to release You?” Jesus answered, “You could have no power at against Me unless it had been given to you from above”.

          Interpretation: Jesus is the King of Kings, the Lord of lords. Jesus is the “Great I am” the Christ (Person) of God Almighty, Eternal Spirit.

          Mankind must stand before Him at the Great Judgment Seat–it is carnal to think that man’s judgment is before Jesus–the Christ Himself.

Didn’t Pilate hand Jesus over to be punished? ..yes! Wasn’t Jesus punished even if he wasn’t found guilty on any of the charges? ..yes! Elizabeth, all this happened here on earth in the judicial court of Pilate. I rest my case.

          Jonathan, you have no case, where the things about Jesus is concerned.

          Your carnal mind has failed you–not Pilate failing Jesus; otherwise, you would have understood what Jesus said to Pilate–what you call trial. Here it is again:

          “You could have done nothing to Me, if it wasn’t given to you from above”

          This means that everything that Jesus went through when He walked this World was the plan of the Father, God, Almighty, Eternal Spirit. No man could have had his own control against Jesus, that is what he said to Pilate.

          When Peter told Jesus He was the Christ” He told Peter: “You didn’t get that from your mind; it was given to you from above”

          By the Will of the Father, in Him, Jesus came to this World, as a Man to do the Work of Salvation for mankind–Apostle Paul said about Him: “God was in the World reconciling Himself to mankind”

          Are you saying that the Justice System of the World failed God, Himself? My Goodness.

    The DBA only looks out for itself. In light of numerous transgressions of the law by the present maladministration, they remain thunderously silent. They do no pro bono work. Money is their god.

    The DBA acts as if the judges are beyond reproach. They are human beings just like any of us. No human being is perfect. We all have our biases, insecurities and weaknesses. We apt to err at times.

    The inordinate delays to render decisions by the court is a very vexing issue. Delayed Justice is Injustice. The corruption of the court by greed and political expediency is not uncommon. Equal treatment before the law in Dominica is a myth.

    To get redress in a Court of Appeal after bad decisions, by a lower court, is a very expensive proposition. Not every aggrieved citizen or organization has the financial means to carry on.

    In Dominica, the Justice System is used as a battering ram on the innocent and the aggrieved to achieve specific political outcomes.

    We all know that the Court system is SLOW and expensive. This always places the poor at an unfair disadvantage when they seek justice. They usually don’t try at all or give up early and settle for losing.

    Isn’t there a perception that the Court favours the privileged, those who are well connected, and have the resources to pay preset lawyer and court fees?

    How often is the Courts’ determination of winner or loser based on the TRUTH?

    The majority of claimants/victims “can’t breathe”. They stand outside the courtrooms, with faces forlorn, because they are losing their cases against wealthy bosses, landowners, government bodies, rich landlords, etc. They are telling the truth but they can’t breathe…!! Sometimes their attorney is in a tango with “the other side” working against their interests.

    Let us make the system work better for the benefit of all. Now, who will be the essential and frontline workers in this fight for a much improved justice system? Let’s…

    Whether one agrees with this purported statement by the Dominica Bar association or not, its provenance and bona Fides must be challenged: a) It is not written on a Bar Association’s letter heading, nor does it show a correspondence address or electronic contact, such as a telephone/fax no.
    b) it does not bear a signature, so one can not ascertain who, if any member(s) concur with its contents.
    If it turns out to be genuine, this omission alone would be a sign of cowardice and surely that is the last thing our bar association would want to be accused of.

    Interestingly the Bar Association issued a statement on the death of Ms. Sandra Julien, less than a month ago and it is so different from this one. Take a look at it below. First thing you will notice at the top right of the letter head referring to Sandra Julien is, their address on the top left and right accross to the right is their tel :767-440-0816/ 440-6901; their email: [email protected] ,[email protected] and [email protected] https://dominicanewsonline.com/news/homepage/dominica-bar-association-statement-on-passing-of-sandra-julien/

    Surprisingly, on this article which is more legal binding than the one on the death of Sanda Julien, has NO address, NO tel #, NO email address. So guess what? it seems like the author of this article was probably drunk or had some mental issue and while driving fell in a drain and damaged their tyre to the point that one could see Mark in the tyre .

        Apostle John said about Jesus: “In the beginning was the Word–, and the Word was God. He was in the beginning–. All things were made through Him, and without Him, nothing was made. In Him was Life, and the Life was the Light of men. And the Light shined in the darkness, and the darkness did not comprehend it”

        How can Jesus be the “Light” of man’s soul and some people believe they have a higher judgment above Him, don’t you think that this is foolish and carnal

        Education and knowledge they say! Well is that education and knowledge about God, the Highest, Holy, and the Mighty Creator? Jesus is the “Person” of that Great, Divine, Body of Spirit and Truth in Love

    Who beat them they crying? where are they with all the injustice going on. We the public have been begging , pleading and literally crying out to the BAR Association for direction on many constitutional matters including electoral reform, political victimization, the suppression of human rights, including the many matters involving the non transparent, non tendering of many government projects; the unexplained wealth of many public officials, the apparent violation of the opposition parliamentarians rights and their unlawful arrest on bogus charges , inclusive of Joseph Isaac, Johnson Boston, Sam Christian. The deliberate attempt to frame the opposition leader, a seating parliamentarian by accusing him of leaking out the PM IPO personal documents when in fact was the doing of the SC. What about the two white men caught planting items at the house of Lennox and on the darning report coming across from Aljareeza report; all of a sudden they find their tongue;!! Hypocrites!1

    This statement from the DBA speaks volumes! If the Bar Association of any country in this world feels obliged to come out in defence of a sitting judge of same country, something is seriously wrong with the judicial system of that particular country.

    I makes me laugh the way the UWP and its leaders continually paint themselves into corners from which they remained mired … simply because they either get bad advice, or getting good advice simply let let their heart rule their heads.
    In ‘forcing’ Judge Stephenson (a judge who has ruled in their favour in the past) to recuse herself. what are they going to do if they then lose the case? Are they giving up their right to appeal? Natural justice would dictate that. If they win the case does that prove their contention that Judge Stephenson is biased and so unfit to sit on any civil matter (our society is so small it is not difficult to work out people’s political leanings)? They have opened up a can of worms here and not to the country’s benefit , IMHO

    The moo moo talking. Where is the bar on the protection of the constitution? Where is the bar on the delayed justice for Joshua Ettiene and the young mental man who got burned in Roseau? Where is the bar with all the abuse going on in country. The folks in there seems to be more concerned about selling passports.
