Controversy surrounds “crab back incident” at Douglas-Charles Airport

crab backControversy has surrounded the firing of a security guard who was involved in an incident with crab backs and leader of the United Workers Party, Lennox Linton, at the Douglas-Charles Airport recently.

The security guard, identified as Vescott Jones of Marigot, was reportedly given walking papers after he allowed Linton, who was leaving Dominica, to dispose of the crab backs since he did not have the required permit to travel with them.

“For that, Vescott Jones has been fired, his employment has been terminated,” Linton said.

He stated the matter is not going to be taken “lying down” but CEO of the Dominica Airport and Sea Port Authority (DASPA), Benoit Bardouille, said there are “standard operating procedures” under which security officers operate and due process was followed in the entire matter.

According to Linton the controversy has its genesis on October 19 when he was leaving Dominica with a quantity of crab backs and was stopped by Jones, who asked him if he had a permit to travel with the item.

Linton said, he told Jones he didn’t have a permit since he was not aware that he needed one. He stated that since it was impossible to get a permit at that point, Jones allowed him to dispose of the crab backs outside the airport screening area.

In a letter, dated December 15, Bardouille informed Jones of his dismissal, saying that by allowing Linton to return the crab backs, Jones had caused the authority to lose confidence in him as an employee and that he had operated in violation of standard operating procedures.

Linton labeled the incident as an example of political victimization against the people of Marigot.

But Bardouille told DNO, security officers operate under standard procedures and Jones did not follow them.

“The gentleman in that case did not follow the process,” he explained. “He took the decision on his own without consulting with his supervisor and allowed the gentleman to return and bring the item back to a person.”

He stated when such incidents occur, a disciplinary process is required and normally takes place.

“If you have anything in relations to a member of staff, a disciplinary matter, there is a disciplinary committee that is set up and it goes through a disciplinary process, the person has to defend themself,” he noted. “The gentleman, his union and at the time a lawyer who was assisting the union, came to the hearing and there were a number of things raised at the hearing. The whole process was continued and the disciplinary committee at the end of the hearing made a decision.”

He said the decision of the disciplinary committee was communicated to his office by letter.

“This is a normal process and I would take it that the gentleman, or his representative who is speaking in the public domain, should know that in industrial relations there is a process and if the process is followed there is no need for us to be talking in relations to the public,” the CEO said. “This is something that has to be dealt with in keeping with what the law has laid down.”

Linton is also demanding that Bardouille reinstate Jones to his position.

“We discussed this matter in Marigot last night, we are not taking this lying down,” he remarked on privately-owned Q95 on Thursday night. “Mr. Bardouille is going to have to reinstate Vescott Jones to his position as security officer at DASPA. I am a human resource management practioner for many years.I know the Protection of Employment Act inside out. That was part of my responsibility.”

In response Bardouille reiterated that due process was followed and Jones and Linton can take whatever actions that are available to them.

“All I know I dealt with the employee in keeping with what the rules require and the employee has recourse in terms of the industrial relations process,” he said.

He stated that DASPA follows “as closely as possible” all operational guidelines mandated to it.

“At all times we want to make sure we do what is right,” he said.

    Garçon dominica just embarrassing. It’s shameful. Sometimes I am really embarrassed. Every little thing we take and make a huge issue in the country. What that happen in the incident for all this drama? The man lost his job, Lennox still talkig about it’s not over. Just pointless drama. Train the man better and Lennox let it go. Simple. Done.     Dominica is the most lawless country I know. The laws that do stick are full of crap. I’ve traveled to the US with meat (we all try to sneak stuff here and there) and they found it. All the did was dump it in the trash and I kept it moving. They fired the poor man for that?? I I Skerittttttttttttttttt you will feel it because God is not sleeping.

    I left Dominica on the November 30, 2014 with Crab Backs and Agouti and no one asked me for a permit to take them out. This is clearly an act of political victimization; when is this going to stop? Why do these men think that they are God? During an arbitration hearing which Mr. Jones won, Bradouille threatened the young man. As a TSA agent, as long as you have someone to take the contraband items, we give it to them in the travelers presence. One day all this will come to an end and they will answer for their actions. God sits up high but looks down low.

    Had it been a kilo of cocaine found in the passenger’s possession would the security guard given the package back to the passenger to dispose of? What does the law provide for handling the dead crabs?

      Don’t be silly. Cocaine is not crab backs. Possession of cocaine is illegal, whatever the circumstances. That is not the case for crab bakcs. To compare the two makes no sense. You may as well say “if the man tried to carry an atombomb”. Ludicrous.

    As a law enforcement Officer myself, the objective is to prevent someone from transporting any prohibited merchandise without a permit, and Guard did that by not allowing Mr. Linton to travel with these items. And for Mr. Baduille to terminate the Officer for simply doing his job, is beyond comprehension.

    Mr Bardouille has many more security officers at that airport to fire. Talk to them, they will tell you who or which of the officers have acted in the VERY SAME MANNER as Mr. Jones. I had a similar experience with a friend who was travelling with crab backs, she had no permit the crab backs were returned to me, I then got a permit and they were then despatched to her without any problem. This is nothing but VICTIMISATION. Guess it’s because the passenger was Lennox Linton

    Are the questionable items not usually seized and destroyed if there is no permit?
    How could Linton enter another country with crab backs without a permit? Or did he have contacts at that airport who will allow him in with no penalty or destruction of the crab backs?
    Thinking of it, crab backs are prepared food/meat and he should have obtained a permit. If he had one there would not have been a problem at the airport.
    The fact that the officer allowed Linton to give them to someone to take back, this may be a violation of the rules and regulations. This is why he was dismissed. All concerned will have to fight it out at the hearing to decide who is right or wrong and if the officer deserves to be re-instated.

    On the same day in question .another security who,s last name is Dangleben from grandbay found a woman with crabe backs at the airport ,the crabe backs was conferscated and the woman was allowed to travell.she was not dismisss nor was she diciplined so why was vescort treatted so unjustly .His record has shown that he was one of the most decipline security officers at the douglas charls airport..Mr badwil stop allowing the polititions of dominica to pull you by their strings be a man.stop the injustice to to your employees.IN another incident a security from grande fond allow a fire arm to pass through the check point at the airport .yet she is still employed .so what is badwills point …………. :twisted:

    dominica is one amazing place. A humble security guard gets fired for using his discretion and doing the appropriate thing. Whilst Inspector mills a senir police official gets to keep his cushy job after performing a ‘dissappearing act’ on over 15,000 US dollars. Skeritt and crew still get to stay in office after the million of dollars ‘escaaping’ in the bin bobol affair and much more.

    The same forestry official who campaigned fpr the neck, of the poor security officer, does nothing when chinese nationals indiscriminately hunt wild life in and out of season without a licence. What a shame. However they should know that the longest road has a bend.

    I think this incident was blown way out of proportion. And to have the security officer lose his job over something so petty is so unjust. I travel very often and I know the security officers do their jobs very very well. The guy did not deserve to lose his job over this! I am still in shock and disbelief!     I don’t think that was fair at all.I remember my friend was leaving for D\A and she had something that she could not pass with and she ask the TSA if she could give it to the people who took her to the airport and they told her yes so please who does this man. Think he is for firing this man right infront of the Christmas.God have a special place for people like him.I could understand if he had allow Linton to pass with it.but he didn’t. The man payed for his crabs of so why let him throw it away when he can give it to somebody outside the airport.please people stop this cause today is yours tomorrow will be his and when people like that bad things happen to them people saying is spoil they spoil them but remember carma is a BTCH.

    Dominicans beware. Some bear deep hatred against their fellow Dominicans. The authorities did not have their wish. Lennox was not arrested, charged or jailed for the crab backs. How they would rejoice if that had happened. So enraged that Lennox was not punished, and with vengeance in their hearts of stone, DASPA and CEO fired the poor Marigot worker struggling to feed himself and family.

    With such hate in the hearts of some men, who think they have ‘Power,” crimes, corruption, illegalities, victimization, firebombings, thrive. Did the guy commit any crime worse than or compared to those who secretly sell our passports, engaged in Bobols, kick-backs et al? Stand up or another poor worker will also bite the dust under that regime.

    can we see the section of the Act which he referenced? I have traveled to other islands and countries when they have asked me if i had anyone to return items to which i could not take with me. the security Officer did his job by refusing to allow Mr Linton to take the items without a permit. some of you guys are a shame and disgrace by your actions. why the drastic action of being fired if that was his first mistake, could he not be suspended and cautioned?.     I who do not live in Dominca I know you need a permit , I heard custom officers said that several times on dbs why linton that is in dominica do not know that?and secondly why would somebody have a delicious treat likec crab backs traveling with and customs give you the opportunity to walk outside with it you would throw it?I do not believe linton he throw it .that is a lie .he gave it to a taxi driver to bring that back.(lol)

    I’m a Labor supporter , I’m not in favor of these none sense things that Linton is doing ,I have a problem with what is being called “wild life”. How can prepared{cooked} food becomes “wild life” This is debatable .I would like to know, if I have a bowl of soup { agouti, dumplings, potatoes and other amenities} while traveling, would the security officer dig into the soup to see whether I have argouti cooked in it? I would understand if the man had a few crabs on his on his way out, I could deemed it to be “wild life” The security officer should be re-instated .

Lennox should have been arrested,charged and fined.Ignorant of the law is no excuse. A supervisor was caught taking items from passengers luggage and because he is a laborite, all he got was suspension; any where you are working as long as you are caught stealing that is immediate dismal. Haters like you can’t stop a good man down. The elections are over but Dominicans troubles are yet to start.

    I don’t see the big deal. The main point is he was not allowed to travel with it. Overseas they just make you throw it away, as long as you don’t board the plane with it. Dominica is so topsy turvy.

    mr linton knows better than that, whom did he spare at DCP he must remember there are different level of disciplines, to me this is grave enough, security is security, I have things taken from people and they are arrested, lost their flight/passage on ships taken to court and punished so I don’t know what mr linton is talking about, well in the in the in the first he should know that it was unlawful to try to leave the island with the CRAB BACKS without the necessary permit. lennox please seat and think first, remember your sayings for when things happen, remember the blame is yours, good luck.

    So officers steal money and guns in the police station they still have their jobs. In custom, Jewelry of a local business disappears in custom holding and no one is fired or suspended. Keys for the Treasury disappear in police holdings no one is held accountable, suspended or fired.

    But a young security officer ask the opposition leader to discard crab backs because he did not have a license and he was fired. Not suspended without pay or put on a performance improvement plan.

    MY friend this is just the beginning …..Who next should I asked?

What he did constitutes a serious breach. I still hope he is reinstated so he can continue to build his life and adequately care for his parents.

    Bardouille is always in some issue. DASPA has not been doing well at the Courts and at the Employment Tribunals recently. The CEO’s competence in industrial relations is under question. Remember the case with Kenrick Ambo? Bardouille will have to show that what Vescott did on that fateful day, is an act that DASPA has and will always terminate for. And this will be difficult to prove because many of us who have been barred from taking certain products on the airplanes, gave those products to our families who had accompanied us to the airport. There have been times when we simply stepped outside and consumed the product before returning for security screening. The question which will be critical is, “if an item is not permitted to be in your possession on an aircraft, what options are opened to the parties?”

    Immediately, you will realise that confiscation and destruction are definitely not the only options. Why? Because the critical matter here is not the illegality of possession of the product, rather is may be the illegality of travelling with the product without the required permit. If the passenger can’t get a permit or can’t return it to someone who is not travelling, then it may be confiscated. If it is confiscated by security, it does not become the property of DASPA, but since the traveller did not get a permit or returned it to someone who is not travelling, DASPA MAY dispose of it. I say “may”, and this is not to be taken to mean that DASPA may make use of the product, rather DASPA can confiscate and secure the product until the person’s return to the island, as has been done to me on two occasions.

    Generally, DASPA’s policy and rules will have to stand up against legislation and common law if DASPA is to be victorious in this case.

What he did was not proper, he allowed Mr. Linton to dispose of the evidence, something which Mr. Linton boldly admits and he as leader of the opposition UWP finds nothing wrong with that.
    Is Mr. Linton saying that once you are from Marigot the rule of law does not apply to you. Mr. Linton should be apologising to Mr. Jones for having caused himm to loose his Job, not blaming Mr. Bardouile.

    All you UWpites verbally lashing out, demonstrating, demanding for equal rights and justice and when it is done all u blue vex. It’s not the first time Lennox and his family taking products from Dominica illegally to other destinations. He knows the rule. He is master of all subject, am appalled he was not aware of this… My god any time you buy crab backs the seller always insist that one get a licence… Which means these were ( crab backs pres kaille) Crabs backs made at home Since September 11 re. The accident in NewYork serious measures are taken against certain items which travellers put in their hand luggage before going through any air or seaport…I live in Europe . I have a 4 year old son. Just in October of this year, I was demanded to drink his juice before we boarded the plane. The immigration officers took all my cosmetics, cause they were in my hand luggage as it was an early flight and I forgot.. They took it and threw it in the bin…what can I say.. I have no defence, because I was in the wrong, laws are laws. And stop you all dramitization of, because is so and so. The law is to be abided by and if it is forfeited well. I re ber so time ago I placed so many bottles of local rum in my suitcase. When I got to Antigua they opened my suitcase which is a shame… However we still operate in prehistoric times.. Anyways the custom officer saw the large quantities of rum, she then proceeded to take them from me.. I literally begged her not to As It was for some friends and I could not get my dominica rum.in Europe. Any way she allowed me to go with it out of pity.. She could have lost her job had she been caught. However upon arrival in Switzerland as this is a neutral country no one searches any one unless there is proof otherwise. I was allowed to go through the customs with a suitcase filled with 15 bottles of local rum+ a cutlass from Nassief store, and it was no little class. Imagine being caught in Switzerland with a cutlass in my bag a black woman from the Caribbean.. Do we take chances in life yes we do.. hoping not to be caught,. But when we are caught we should be prepared and willing to pay the consequences…

    What is good fro the goose is good for the gander. I was travelling last year from Dominica and I had a bottle of Castor oil in my carryon luggage which I did not know that was given to me for someone and the security who checked my bag took the oil and when I ask to return it to my mother he refused to give it to me. He should have taken the crab backs from Linton and should not give him the opportunity to discard it. This is what they do when they confiscate a banned item. They do not give it back to you to discard. I am sorry that he lost his job but he should have known better.
    Politics is over and evryone is entitled to their own opinion.

So cover it fast before linton takes a lash. I would justify the law to mr. linton like this: U were found transporting illegal goods and u should have been arrested and charged. And so too the lackadaisical officer, There u have it. And don’t take sides. But u there winning elections. If it was me all now I still fighting for my life to get from under these fellas.

    I was the biggest DLP supporter over the last election period but even I agree that the measures taken were to extreme especially during this tough economic period. However, it would have been nice to know if he had been disciplined in the past for any other incidents of similar nature. If that was the case then it would make sense why such an action was taken.     He has stated clearly that the Security officer allowed him to give the crab back when he was supposed to confiscate and call the Police.

    The security compromise his position to cover Linton’s back and Lintion was not interested in his welfare at the time because he wanted to save his political life.

    Smdh. Mr. Bad will the administration of discipline cannot be partial. Was this the employee first offense? If not was he warned on previous offenses? We all in Dominica know that most of the port workers and custom officers make exception s for there friends. You have done it also. Has anyone been fired. You said the authority has lossed confidence in the security guy service? Who are you referring to.
    Let me give you a reminder: one police woman cost the government over 400k in law suit for abuse, two other officers cost the state another 100k. They were only given a slap on the wrist. Two of these officers were again involved in a homicide, according to the police commissioner, in possie station. Today they are yet to be charged.
    It is said out of the 13 or so active volcanoes in the Caribbean, Dominica has nine. There is one they did not count. People can only take so much. You guys are taking this to far. Only a matter of time before that volcano erupt.

    Lennox Linton is full of **** and a hypocrite. The security guy got fired because he did not do his job right. Lennox was supposed to of been fined and the crab backs seized. The guy is a poto Workers supporter and he choose to break the rules and let Mr Linton off. So both he and Lennox cannot blame anyone but themselves for him losing his job. If it was anyone else we would of been fined. Rules are rules Mr Linton so the same way all of us have to follow the rules you better get over your arrogance and ignorance and start following the rules also like the rest of us. And stop lying and pretending that you didn’t know about that law. It’s not a new law and has been around for quite some time. Besides ignorance of the law is NO EXCUSE. And Dominican stop encouraging this man with his stupid excuses and his twisting of the truth every time he does some kind of nonsense. You guys know if it was you, you would of been fined. So why shouldn’t Lennox be dealt with in the same way as the rest of us. DASPA was within there rights to take action.       Mr bardouille know well it’s because is Linton vessy got fired…why was n one fired when a high court judge travelled with it in August out of season without a permit??? The insurance lady sister and brother who were travelling to barbados was stopped cuz the had 6crabbacks and no permit..plant quarantine was called along with the forestry officer…one phone call to a certain government minister and the quarantine officer was ask to allow the ppl to go and seize the crab backs…why the double standard…..why did the supervisor quickly changed the old log book replacing it with a new one??? The old log book have other instances that person were reported to the supervisor but no action was taken because the persons had close ties to the Labour Party…a radio owner left dominica for at thomas with almost 6rounds of ammunition in his pocket…why wasn’t the security officer penalized??? Oh another Labour Party mouth piece…vessy losing his job was pure politics….everything that I mentioned here i have first hand knowledge of it..
