Family of 12 has nowhere to sleep after home is destroyed

A 12-member family of Loubiere is now homeless after they were bulldozed out of their dwelling home on Monday.

Marvella St.Rose said a court decision was taken in her family’s absence and without any notification to evict her.

St. Rose has been a resident of the property for over 30 years, but the land was purchased by a woman of the same community some 12 years ago.

St. Rose believes the manner in which the matter was dealt with is questionable.

“We have been in court for years and this final decision was taken in our absence. This morning without any notification, a number of policemen, a bailiff and one backhoe came and broke down the house. Despite what anybody says they decided to break the house,” she said.

St. Rose is questioning the right of the law to barrage her family out of the house and damage everything that they own. “They could have told us that they were coming to do that. They never ask us to move. They have been battling with us in court for 17 years to have the lot given to Lewis. I don’t mind action is taken but we weren’t prepared for such a move. They didn’t give us a chance to move anything. I have a new born baby and not even the baby’s milk and bottle I was able to take,” she said.

St Rose say she has no idea where her family will sleep.

“They demolished everything … I also have a baby on the way … I just don’t know what to do. They placed everyone under the rain … that’s unfair,” she added.

    and one more fact. the children father finally decided to marry her and now she blessing the marriage with a last baby.

    so dont be discouraged ms.st.rose. decisions have to be taken in life even if we like it or not. i believe dat one was to much for u to absorb.

    but maybe if u had the finance an offer would be given to u to purchase.

    did u watch the news? she has grand children and one on the way. i was much relieved when i look at the news to see she had 3 grown sons and all 3 are employed.

    your condemnation is not helping the lady and i think she is proud to have her children. i applaud her for having dem and caring for dem.

    this i just a sad moment where someone had to take a drastic measure to get what is rightfully theirs and no matter how dey did besides placing dem in a house and den working on the property the reaction from mostly everyone would be the same.

    did u read how long ms.rose is in court when she found out she was unfairly treated by not having the opportunity to purchase instead of lewis.

    at one point the right owner must act. and trust me, there is no judge, magistrate, baliff or anyone would me so dumb, stupid to do such an act.

    i believe there is alot more to this story ms.rose is letting us believe but anyone with common sense should know dat ms.rose i reluctant in giving up.

    This woman should be made to pay 18 years rent to Mrs Lewis. After depriving Mrs Lewis of her property for almost 18 years, she has the nerve to be coming with a pack of lies as to how she was forced off the land without being notified. She is the same woman who together with her sons ran after the bailiff with a cutlass and also the same woman who smashed locks which the bailiff in front of five policemen placed on the house and now she is saying that she had no previous notice. Mrs Lewis must be a saint to have waited so long to get her property after she paid for it and having her title of certificate. In fact after Mrs St Rose broke the locks in front of the policemen she should have been arrested.

    @Red Clinic: If I am not mistaken, the squatters law applies to crown land or state owned land. How the h3ll you expect to be living on my land and not want to live?

    Furthermore, from what I know of the law (and that’s a little compared to her so called lawyer) if someone is staying on another’s land with permission,they are given first choice when the property becomes available for sale. In the event that the person cannot purchase the property then it is offered to others.

    If however, you are living on the property illegally, then the person simply needs to inform you that the property is for sale and that they would like you to make the place vacant as soon as possible.

    We all need to be objective before we jump on the band wagon and make certain statements. Miss St. Rose is keeping the truth from us. The law requires that she be notified and given time to get off the property. She would have also been told that should she refuse to vacate the property within a certain period of time, then strict action would be taken, and in that case she would be forcefully removed. The officer and the bailiff would have known that the order to vacate had been served before they went to remove her from the property.

    While I feel for her and her family, no one should be wrong and strong.

You (Mrs. St. Rose) said that you have been in court with Mrs. Lewis for the past 17 years and let me reiterate 17 years imagine you could have given birth to a child she could have grown up and have a baby who could have been at least five years within that 17 years and you did not have enough time to clear your stuff come on, get real. Now deal with the consequences move on and start teaching your children better values in life. IT IS NOT YOURS DO NOT TOUCH BECAUSE IT IS STEALING MY FRIEND.From today start teaching that to your children and learn from it.

Is it fair to her that she pays for land and can’t have use of it? So right to bulldoze it- we need more actions like this- when people disobey the law.     Mrs. St. Rose should be ashamed of herself. She knows very well that the property was not hers. The parties were involved in civil litigations and Mrs. St. Rose knows very well that the property belonged to Mrs. Lewis. Some people are just lawless and figure that if we run to the media then our actions will be justified.

    Mrs. Lewis has her certificate of title and the people were served with notices to quit the land for a number of years- but as usual they decided to just sit on the land and have the owner pay a loan for land she cannot enjoy.

    Mrs St. Rose needs to shut up and acknowledge the fact that she was aware that she had no rights to the land. The court made several orders which they chose to disobey. In the end this action had to be taken. She must tell the truth.

    @Joyful: You are so naive… If only you knew that the bailiff and police waited for almost 3/4 hr after they asked them to take their things out. The authorities are not crazy and besides there is procedure that they must follow. Instead they all sat around inside, calling husband, calling marpin, matt in the morning, sat and every other support system they could think of. They thought it was business as usual. Bailiff come, they run him and continue their beautiful lives. This time they had a rude awakening and still trying to beef up a case. More power to Ms Lewis (beautiful princess!)

    Truthfull I am in total agreement with you.

    I have a heart and do feel sorry for the lady, however, it seems to be the same old story over and over again.

    I have a relation who is going through that same problem. The realtion land and house has been occupied even renovated his house without his knowledge and the said person are going about stating that they have bought the land , who have they bought the land from, where is their title of deeds. All these are being done because my relation is out off the island.

    Personally, as a Dominican and residing overseas I tend to find that a lot of us tend to take what doesnot belong to us, and also wants to be very forceful. Action needs to be taken and the rightful owner needs to stand up and fight for what is rightfully theirs even if it leads to the court. Again, why should it lead to the court house when the occupant knows within their hearts of hearts it is not theirs. I cal this Bold Face.

    For your information Ms …. owned that land since 1992. Her case was in court against these people since then. Marva’s husband is a fisherman and is always overseas so the case took a long time to be heard. After the case was won by Ms Lewis the court gave them numerous occasions to move out and they did not. So finally after 18 years Ms … finally got her place back. Dont feel sorry for them…they had numerous opportunities to vacate and they always throw away the Court papers.Justice was finally served.

At the end of the day, we still need to show love. Yes, some people behave indifferent but we cannot be like them. Maybe the story is missing more, or the woman is not truthful.     Though I feel kind of sorry for the family of 12 who is now homeless, I think it’s about time that those who like to live on other peoples’ properties and ignore eviction notice will learn. It’s a belief in Dominica that people can’t be forced out of a property that’s not theirs if they don’t want to even if they refuse to pay rent.

Anyone with a brain can see St. Rose lying and looking for sympathy with her baby on the way.     I happen to be directly involved in this case and know most of the facts.

    The facts:

    – The Court ruled in Ms. Lewis’s favour in 2007. On Feb 2007 the court ordered Ms. St. Rose to leave the property. That is 3 1/2 years ago.

    – About 3 weeks ago Ms. St. Rose was approached by the bailiff who was instructed to take posession of the property, only to be runned away by she and her sons with a cutlace. Refusing to leave.

    -The bailiff returned with 5 police men and put locks on the door. Ms.St. Rose cut the locks and continues leaving on the property.

    – After 3 1/2 years to get an alternative place to stay the court had no choice and took a decision to demolish the house.

    – Most of Ms. St. Roses children are big working people, 2 of her sons and her husband work on the cruise ship making tax free US dollars. Her other children leave in other caribbean islands like Antigua working. Some children in Roseau working. The majority of them are adult and have jobs…most of them good paying jobs.

    – Since the house was demolished Ms. Lewis and her family are being freghtened.

    – Ms. Lewis is a single parent with all her children still dependent on her.

    As God is my witness these are the facts…not everything is as it seems. From the looks of it Ms. St. Rose may very well be in a better position that Ms. Lewis. Its irresponsible, malicious and sad that she is playing the role of the victim. The readers have common sense and can clearly tell that she is telling a 1 sided story. It would be sad to see Ms. St. Rose get “assistance” or a free hand out if housing is provided for her. She has hid behind the law long enough but today she has been EXPOSED!

    reviewing the news at dominicahe newsonline saddens me, headline gives one the view that it was a truly a mishap for a family of 12 when it really isnt because finally justice is served! i am a mother of 4 and i know what it is like to work for what u want in life. in the year 2010 why are we feeling sorry for a mother of ten who is without a job or house? public sympathy is notr an option in this situation!

I would also exercise some responsibility and ease up on the kid making. Especially if I know my situation with money is tight and I needed to get a place to stay.     It’s such a shame. For some reason Dominicans just like to see each other get dragged in the gutter. They can’t wait to rejoice at their neighbor’s mishap. They have so much negative to say. Do you know that locks were put on the doors by authorities after repeted warnings to evacuate? Instead, Ms. St. Rose cut the locks and continued leaving on the property that Ms. Lewis paid for. The same property the court passed judgement in Ms. Lewis’s favour. Ms. St. Rose is NOT above the law. I think she was too bold and to forward to continue living in the house. Especially after battling for 17 years. Its unfortunate that her children and family had to expirience the harsh reality of life but how much more time you think she should have been given to find a place to stay? 1 month, 6 months, another year or 2 perhaps.     @Red Clinic: “possession is nine-tenths of the law” that’s an old squatters belief….that only applies if the land belongs to the government or there is no clear owner. cannot squat on someone’s private property and expect them to just take it. nonesense!!! slave mentality…she had 18 years to look for somewhere else. if she had any ambition, she would have try to buy a piece of land cheap somewhere and all now so, she would have been well on her way to finish pay that mortgage. wrong and strong don’t work these days, lady.

    Flabergasted;;; you seems to have much to say about the situation. Does it matter how children she have or she making. She is a grown woman and can make as much children as she please. On the matter I think that their should be some type of documentation given to her telling her she should leave and giving her an exact date to leave. Thank God its not America cause she would be a millionaire if that had happen. However the situation this is a family in need of help so before u guys blast them to the roof why don’t u all try to give a helping hand….

    @Fair Play: It doesn’t matter if the owner has rights to tear the place down or not. It’s called being courteous. The owner wouldn’t like it if it was done he/she. And even the police or whoever was in charge of tearing down the place should have taken the time to tell the people to get there out. Shame Shame Shame on them. They have families would they like it if it happened to one of their family memebers? NO. Do Unto Other’s As You Would Have Them Do Unto You. My prayers are with the family and trust me. All those involved will not have any good thing come to them.

    I think that the Judge should have sent in the court marshall too take of her stuffs of the House and put it by the road side, and i am pretty sure she would have found a place to go. but distroying her all her stuff that a no! no!. The court ant the Gvt should have handle the situation a little better than that. It seem like we living in don’t care country

    This lady is just looking for sympathy. After 17 years in court she knew nothing about the land owner’s attempt to get she and her family out? Since I am aware of the facts, I say that she is a liar. When the matter went to court, on ocassions, her husband would say to the land owner that he is not leaving the property because he has to die there. She is about 40 years old and she is living on the land for over 30 years. That means that she and her husband were living there even before she was a teenager.
    Tell here I say to take the land owner to court. They ignored their court appearances because they had no defence. Now she is looking forf symp[athy. Not even her son is talking the truth. Ask him to show the correct boundaries and that will establish his honesty. He knows that the boundary poles were moved. THE LAND OWNER HAS A CERTIFICATE OF TITLE FOR HER LAND

    well! when i heard that news i smiled. I can imagine the amount of persons who think like you, but i’m yet to believe these persons were not notified. there’s noway under God sun in this island or anywhere that can happen.

    so maybe we must wait on the other side of the story before we start feeling sorry or accusing de court. i’m no lawyer or judge but common sense will tell anyone that move is ridiculous.

    LOL! i feel their pain but the lady must stop allowing persons to make fools of theirselves and speak the truth. or else if her story is TRUE she doesnt need to worry about where she will live or what she will eat. With a goo lawyer she will have a house build in no time and have enough to eat for the rest of her life with her large family.

    Because trust me that is a easy and quick way of having money. these person will be sued.

    only in dominica stuff like that happens….. With one kid already and another on the way the Gov’t is responsible for them esp if they have no home. In spite all the different stories about the lady knowing they were going to demolish there is nothing to justify them destroying all her belongings, and if they really wanted her gone there should be a govt agency set up to help families who need housing.. As i said only in dominica ish like that goes down and all the misinformed and uneducated folks making comments here about she’s “bold” etc com’n what would u do if the tables were turned..

    Some people to bold face. That’s a trend in Dominica these days. People have a bad habit of building on other people’s property and want to be wrong and strong. An example was made of the lady and it needs to be done to a few more times. Do you all who are pitying the lady have any idea how it feels to own land and not be able to move on that land because someone else believes they need it more than you? That’s a big problem in Dominica these days. I know cause I am in the same problem. Someone build on my land cause they want it more than me. The court takes forever to deal with these matters. I am looking forward to the day where I can Bulldoze some houses also.

    @Out of South City: I think we need to get the true story before we start to curse people and play the blame game. First of all if I living on a plot of land and I know it does not belong to me, my priority would be to find my own property. Can you imagine after 12 years on some one’s property this lady is still not moving. I mean we like to criticize that state and our laws that we are not represented. Indeed there are many times that the law fails us. In this instant that person with the certificate of title in hand wins and that is the law!!!! If you have no papers for it it is not yours.
    My lady I sympathize with you for your children sake, but you knew that the land did not belong to you. In light of that you should have made the right decision to protect your family.
    You see, we Dominicans are too bold, we always like to be wrong and strong.
    The government should do more of this, its not every time we see people with 10 kids etc we must say to leave them alone. What about the lady who pay for the land??? How you all know they didn’t give them notice to leave and they figure they not going anywhere??

    Something is missing.

    I do not think they can demolish her house and belonings without giving any form of notice.

    The bottom line is if someone lives on a property for so long they should have first debs on purchasing it from the owner. The law typically protects the squatter. I think she knew of the eviction but decided to stay since she had nowhere to go.

    Also people should not comment on how many kids she has that has nothing o do with the issue, that’s personal.

    I do not beleive this lady story. She could have gone to the Red Clinic for assistance when notice was given to her. Is bad she bad. It is true when one dies one do not go with the land but at the same time you cannot let people do what they want with you.

    I blame the owner who sold the land in thr first place. By law (stand to b corrected) the law if the land was to be sold Ms St.Rose should have gotten first preference, she already had over 15 years living on the land unless if she was paying rent of some sort. Its rough id get a lawyer and see how i could be compensated for my loss.

    There is no way I will agree to destroying all of the person’s belongings. I family of 12, living on Somebody’s land already speaks clearly to poverty!! Should I conclude that the police, bailiff and land owner took advantage of this poor Dominican family??
    Y though would someone sell land and not inform the persons living on it? 30-12=18. She was living in that house, on that land for 18 yrs!!! The land should not be sold!!! She is squatting for 18 yrs…and what saith the law? If you squat for 10 years, on a particular area, and within that 10yrs no one reclaimed the land or u were not evicted, then the land automatically becomes yours!!!
    And even if she was asked to move several times, y destroy all her things? This is cold and evil!!
    Now, I see she didn’t get assistance from the Red Clinic!?

    I am a bit familiar with the court system and I find it hard to believe that they had no prior warnings. I feel that the people were wrong and still strong. While it is unfortunate that a family is left homeless, 18 years is a long time to be in a court battle and not have a clue of the outcome. If they have been to court several times as was said, then they would have some clue as to how the proceedings would turn out. If the woman is within her rights then they should have been off the property. Everybody who is entitled to their land wants their land for their use. The bailiffs at the court are used to that type of work and I am sure that an order to vacate was served. Also I agree with the comment that the lawyer should have been more responsible.

    I don’t believe the court made a decision in her absence and she was not notified. First of all, when a court date is set, the court informs all parties involved of the date for the hearing thru their respective lawyers or representatives and it is up to the clients to inform the court as to whether they can make the date or not. If they can’t more times than not a new date is given. According to Ms. St. Rose claims that the decision was taken in her absence – that can be done if you were given multiple notices to appear in court and kept asking for new dates and also if you were asked to appear and didn’t and the court felt that the matter had been dragging on for too long. The judge does not need your permission to make a decision. Besides, why would you want to fight someone in a court of law for their land that was purchased through property channels and in the proper way? I mean you shouldn’t even mention that. The minute the property was sold you should have started looking for a new place. Furthermore, the police and baliff do not just appear and break down houses. You were notifiied, I am sure. You just chose to not take action.

    The problem with us Dominicans we always want to be wrong and strong. We do not educate ourselves in the law and listen to “they say” and “I hear” and go by that. By the way, what are you doing having a baby and being pregnant again? It is always those in the worse predicaments that still putting themselves in a pit hole. You need to stop having kids until you know where you are going to put them and how you are going to take care of them.

    i believe this lady is keeping the truth from us. i don’t believe the police would just do that. he must have given her the opportunity to remove her things, but she playing bad may have refused to do that hoping that they would not do anything… i don’t buy her story at all. but this lady not easy. u fighting someone for 17 years for their own property. god that punishing her thats y she homeless. i can’t believe people that bold. what she should have done is like for a place to stay instead of fighting the lady in court for her own property. how u expect to win somebody in a case like that. the person pay their money for their property and now she want her place to do her business.

    @conscious: Are you retarded? Number 1. She has resided on the land for 30 years and by Dominica squatters law…. The land should be hers after 10 years (subject for correction). Number 2. Even if she was in the wrong, the courts decision must be carried out professional manner. The woman had to made aware of the courts decision before hand and at least be given 3 months notice to vacate the premises before a backhoe shows up to demolish her property. I mean she was not even given the chance to remove her belongings from the house. ARE YOU SERIOUS? CHECK YOUR CONSCIENCE!!!!     I think from the time the lady bought the land you should have moved because it was never yours in the first place. You cannot be wrong and strong. Your lawyers should have advised you to move instead of taking your money and wasting it going to court. But the police and who ever came to bulldoze the house should have given you notice they were coming in order to salvage what you had in your house.

    This is so outrageous, ridiculous and insane that this family was not notified before the demolition took place. Inspite of her being in court for seventeen years over the property she has a right to be notified of an eviction. Where in the world do such things occur? Again, she is pregnant and has a small child. How unconscionable!!!!!!!!!! I really can’t comprehend the things that occur in Dominica these days. That’s a shame to the highest degree.
