It appears that the community of Marigot is not letting go, the matter of the dismissal of Vescort Jones from his post as a security officer at the Douglas-Charles Airport in December 2014.

Jones was allegedly dismissed from his post after he reportedly allowed Leader of the United Workers Party (UWP), Lennox Linton, to dispose of crab backs that he intended to travel with but did not have the required permit to do so.

Members of the community decided to present a petition to Chief Executive Officer (CEO) of the Dominica Air and Sea Port Authority (DASPA), Benoit Bardouille, on the matter on Monday morning.

Since the incident, Linton has been very vocal saying Jones was a victim of political injustice.

The UWP leader said there is no reason that the fired security officer should not be at work.

He stated that the matter will be taken to “a fair, logical conclusion.”

“We want justice for Vescott Jones, because Vescott Jones is the victim of a savage injustice, perpetrated by Benoit Bardouille on behalf of his political masters. It is not right and we must correct things that are not right,” Linton pointed out.

But Bardouille doesn’t understand why the community of Marigot wants to deal with a matter which he said has to do with “industrial relations.”

“Why would they want to come outside of the place of business? To what end would it serve?” he stated. “It’s an industrial relations practice. Why would the community of Marigot want to deal with an industrial relations matter outside of the practice that is laid down and the law that is being laid down to deal with the matter?”

    Bardouille doesn’t understand why the community of Marigot wants to deal with a matter which he said has to do with “industrial relations.”(Bradouille).
    You know Dominicans have a silly way of playing with words and the English language: what does “industrial relations” have to do with this man firing simply because he perhaps did not take Lennox Crab-back so that Bradouille could carry it home and eat it. Industrial relations entails the dealings, or relationships of a large business.

    I agree that it also entails enterprise with its own workers, with labor in general, with governmental agencies, or with the public. However, I doubt there is any governmental rules which states a security guard can be fired for simply telling someone you cannot travel with crab-backs already cooked in the country of its origination! The only reason he got fired is because Lennox opposed Skerrit, plain and simple, that is political victimization.

    In all fairness, can someone tell me why this incident was blown out of proportion? Every clear thinking person can see that this has political under currents. People are allowed to give their friends or relatives things that are not allowed during screening all over. I was travelling out of Dominica once with crab backs as well and the security office told me that I could not go with it and explained why and allowed me to give it to the person who had dropped me off. He further explaind that if it was out of hunting season, it would have been illegal and I would be arrested. I had my questions but he was doing his job; now if there was no one to give them to then he would have to throw them out.

    I am trying to understand what Mr. Jones did wrong. It was during the hunting season so what rules he did not follow? Beniot (Badwill) will get what is coming to him. He thinks that he is in power and is above the law but karma is a bitch, he will be at the receiving end one day.

    Mr. Bardouille, Power and authority is given by God to do what is right & just. I advise you to humble and re-instate the young family man. He is not a threat to you or the security of the Port or Airport. A stern warning could have suffice. You are only temporal Sir, you will seat on your retirement chair one day soon and reflect on what you did during your tenure and wish you had done some things differently. Hope you find peace within yourself then. The good you do will follow your generation: the bad will also follow them. A word to the wise.

    Lennox is bringing politics in it when the regulations were not adhered to on both sides, he and the security officer.
    It appears that Lennox should have been arrested but for his status and this was preferential treatment.
    In future, we hope that all security officers adhere to the rules and regulations with no exception. I would expect that the manager had a discussion with them not to spare anyone who breached the Law.
    I personally would not travel without a permit for goods which require one. I am a law-abiding person and I live by rules and regulations. I do not want to get caught and be arrested. It is embarrassing and will give me a bad record.
    I would also not encourage anyone to do that. Therefore folks, let us live by the Law. It also makes me easier on the security officers, those who are responsible to ensure passengers adhere to regulations and those who perform a search on us and our belongings. It is tough traveling in this era. Their work is also tough.

Soon the hate in your heart (your actual sprit) for Lennox will eventually caused the organ in your body know as your flesh and tissue heart will explode, all because of your hate for that man!

      I cannot believe that anybody can hate a person the way you Linton. I live on Skerrit back every day, but I do not do it with any malice or hate of the man, my reason for dealing with him in that way is so that he can recognize the truth and do better for the good of the country. I support him when he does something viable and right. When he screws up I have every right to critique him. In your case you stick on Lennox like leach, making unfounded comments which you pull out of thin air.

    Had the representative of the Marigot constituency and the security officer not attempted to circumvent the laws of the land, there would be no issue. Had he not tried to pull strings for his party and party leader he would not have to face disciplinary action leading to him losing his job.
    Lenox, I d’oh jalou Modelled, but you should have made Vescort Jones a senator instead.

    Go back a few years before that deadly 9-11 that change the way we travel and what we can bring on planes and other mode of travel especially airplanes forever. I am happy for the precautions the authorities take when looking after my well being even if it poses an inconvenience to me. My safety is more important.

    Before 9-11, we were not expected to remove our shoes when going on a flight.
    Before 9-11, we could bring any size liquid on a flight.
    Before 9-11, many security laws that we now have, were not in place.

    Since 9-11 we have to be extra careful, people will try to test the laws and the employees must be ever so vigilant. What if it were someone else who had the crab backs, with a concealed weapon in it; or the crab backs were contaminated? Shouldn’t all of us get a permit and if we don’t shouldn’t the authorities take away the none licensed item? How about security? Could something else been brought back in?

    The man who wanted to be the custodian of our Constitution which includes law & order broke the law. A Civil Servant swept his crime under the carpet and the people of Marigot are opposing his dismissal? He should spend some time at the Government’s pleasure!!! Would he have allowed a mere citizen to get away with it? I think not!!! Linton has just proved that he is NOT fit for public office. God knows what else he’s gotten away with!!!

    This is absolutely ridiculous! Mr. Badwill deserves to be fired. If it had not been Lennox Linton that would not even be an issue. Is crab back any worse than cooked manicou, rabbit, cow meat that so many of DIASPORA’s left Dominica with both after the independence, election and Christmas? Badwil and Skerrit them making it sound like a gun or some drugs Mr. Jones allowed to pass through. If Skerrit is serious about his olive branch then he has a perfect opportunity to demonstrate to all of us that he means what he said. He needs to take the lead in bringing the nation together. If he fails to take this opportunity, he will find out that the headline will not only be Marigot but all of Dominica will stand behind this young man.

    First off Mr Linton, before you go pointing fingers, it would serve you well to recognize that had you not attempted to commit an illegal act, this young man would still be employed. Clearly he held you in high enough esteem to allow you to dispose of the item, which was obviously a violation of DASPA regulations. I do believe, that the both of you should have been punished for your individual contributions to this saga. Secondly, I think that another method of punishment could have been used. However, I am not fully aware of the managing policies and codes of conduct that these officers agree to follow, and the respective grounds for termination should those policies be violated, so my opinion remains just that; An opinion.

      The question is…is this regular practice? countless Dominicans can attest to misunderstanding or potentially violating this particular export law, without being arrested or accosted in any form. The security officers were not fired, and we have not heard of any instances where reprimands were given out for letting the traveler dispose of the restricted goods.

      So why did this case lead to the loss of Jones’ job? We know jobs are hard to come by in Dominica, here is a man following the standard practice of his job and suddenly he is fired for it? all because he had the misfortune to be dealing with Lennox Linton and not Joe Schmo?

      Jones got fired because it was double ” L ” don’t try to be ignorance about the issue .. I travel several times with cooked provisions and I didn’t have any permit but when I travel with uncooked items I have my permit to show, Once I was travelling I was told that I couldn’t go thru with a certain item I was told I could give it to someone which I did and continued.
      In larger countries they will ask if you have someone to give it too if not they will take it so I wonder what went wrong in this case , We Dominicans seam to be destroying ourselves with stupidity and ignorant attitudes and we got to stop it in the name of Dominica’s image … Wake up brothers and sisters and stop the bashing of each other, We speak about olive branches but for whom.

    It happens at all ports internationally involving ordinary and or high officials – there are other known cases where people going through the same airport have been allowed to either go through or allowed to give back to the one who brought them up to the airport. There were occasions when people pass through the security check point area with their firearm – there is one prominent lawyer who that happened to when he arrived in Barbados he was found with a gun – nothing happened to the security detail at the airport. In coming passengers by law are required a limited amount of alcohol into the country – I would like to ask sincerely how many of us have come through the ports with more than the quota allowed and were allowed discretionary pass by the customs? Marijuana is an illegal drug in Dominica – I know of people who have travelled with marijuana cake and marijuana rum back to the states- is this an offence?

    I don’t see the problem there. Lennox Linton couldn’t travel with the crab-backs. He disposed of it himself….what was he supposed to do? Give it to the security officer for him to share among his friends to eat and enjoy??

    As far as I’m concerned, if the crab-backs are still in my hands, they are MINE to dispose of as I see fit. If I don’t want anybody to enjoy my crab-backs i paid my long money for, i can throw it in the Melville Hall River if I please. I don’t have to give it to the security officer.

    I can remember i was travelling with a teeny tiny bottle of expensive lotion. It was within the required size. A female security officer told me I cannot pass with it. She also told me I would get it back on my way into Dominica. (I was going to be out for 7 days)….who tell you? up to a day like today i NEVER got back my lotion. I got all kinds of run-around story.

    The point is, DASPA don’t keep your stuff for you…they use it for their own benefit. So I agree with…

        The gravity of the situation at best warranted a written warning even a final warning and is clearly too harsh for the so called infringement. You people are forever crying that you want development and for the country to be taken seriously in a mature world but you are so far from it.

        Mr joe, if as you claimed an illegal act (a crime) was committed, why then wasn’t Mr Linton arrested. Sir in all civilized Airports in the world, when ever a restricted item is discovered, unless it poses a danger to the flight security officers at their discretion allow the passenger to dispose of the item themselves ( give it to a person who is not travelling) if the can. If they cannot then security will dispose of it.

        Maybe if you were to put your loathing for anything to do with Mr Linton aside for a moment and consider the harshness of the situation you might have some…

    Enough of the political victimization in the name of “law”. Benoit know darn well that the guy was fired because he is from Marigot hence perceived perceived to be a Lennox Linton supporter. They waited until after election to fire the poor man for BS. I personally have brought large quantities of wildlife of the country on many occasions when in season for friends in foreign. Was I breaking the law? Well now I know that after the LL incident but until then I totally thought that once in season it was ok. Further, no security officer never stopped me even though I declared what was in the packages. There is something called discretion and officers of the law (customs, wildlife, police, security) and civil/ public servants are constantly reminded that this (discretion) must be exercised on a case by case basis. I stand with the good folks of Marigot in their fight for justice for a fellowman.

    How can we ever move forward as a nation with so much hatred, division, lack of civility and compassion for our fellow countrymen? Are we the laughing stock of the region? Olive branches are offered with thorns in every twig to injure those who dare handle them in the process. The government representatives speak on both sides of their mouths as they say one thing to appease, while their actions discriminate and discredit those they don’t like. Disgraced officer with ugly skeletons in his closet calls on the radio talk shows to voice his biased opinion against the opposition with impunity. With so much to reconcile, how can we move forward to heal the nation? The new year will continue on the same old path of yesteryear, and that’s very sad for a nation that yearns for political and spiritual healing.

    This is not only sad; it is pathetic, and tragic, that even the headline does not do justice to the cause. This is not only about someone from the village of Marigot, the constituency of the Hon. Lennox Linton, duly elected leader of the opposition, but about justice, the right to work, and political victimization.
    In my humble opinion, the headline should be “Dominica Stands with Security Officer”. It is remarkable, yet unbelievable, that the Prime Minister, is on one hand offering “Olive Branch”, declaring that Campaign season is over, and that Hunting Season is over, yet, I personally have not seen any affirmative action on his or members of his cabinet, and/or portions of the senior public servants to suggest any seriousness with regard to those pronouncements.
    My observation, is that it is business as usual, with an elevated level of animosity, which began even before the swearing in of the opposition leader.

    I have been allowed to pass with items without a permit numerous times. Other times, I was allowed to go back out and give the item to family. I have never been fined or made the national news over it. This is nothing but a personal vendetta against Lennox. ALL the officers give people breaks at one time or another, so Bardouwille if you’re going to fire one, you must fire all. Give the man his job back!!!!!

    But where are the Marigot ppl to support Vescote Jones. Just about 10 person with Linton and Edison. I expected to see bus loads of ppl from Marigot and also UWP suppports. Man all u let down Vescot big time. Shame on Linton for not really his ppl for because of him Vescot is without a job. Am very disappointed in Linton.

    If it were a mere civilian the security would not have acted so inappropriately? There are many persons who have been fined for the attempt to export wildlife. Is it fair that normal persons are charged but Linton was then allowed to dispose of it? What else has he allowed Linton to go through with? Or dispose of before it was found out? My point is if you are employed to do a duty, do so with no biasness… Subsequently you brought your dismissal on your own self…. You do not work for Linton. You work for DASPA which is ruled with laws and regulations of which you have sworn to uphold…

      I say it is because of the passenger because there are a number of examples where stuff not allowed or requiring a permit was either given back to or the passenger was quieting allowed to go through with it so doh give me that crap.

      Great point risque!!!!!! Lennox is confusing me, why is he seeking redress through this route when he knows the Protection of Employment Act like he knows his own name (that is according to him) as he served as Human Resource Manager at DCP for a longtime.

      Is that how he learnt to resolve industrial issues? I would think he would pay a good lawyer for Mr. Jones and have him take DASPA to the Courts for wrongful or otherwise dismissal!!!

      This current action will not help the gentleman case not one bit, and his attempt to intimidate the CEO of DASPA will only agitate the situation.

      It is unfortunate Risqué has decided to take a cyclopic view. It is the same Marigot a large sum of money was missing from the police station and a high ranking police officer who is alleged to be a supporter of the Skeritt led administration was held responsible for the disappearance of the money. He was not fired, in fact, he was requested to repay the money.

    In this instance, the Security Officer took it upon himself to deal with the matter outside of the established protocols He did not consult with his supervisor, nor did he seek the assistance of the police and the nearest Forestry Officer. The available information suggests that the Security Officer having determined the nature of the contents of the bag, spoke to the suspect who promptly went outside and left the crabs with someone outside.
    Did Mr. Linton breached the law – the Forestry and Wildlife Act of 1976? Yes, he did. He attempted to leave the country with wildlife without a valid permit issued at the office of the Director of Forestry.

    Procedure:
    Once intercepted, the Port Security has a responsibility to alert the nearby Forestry Officer or the police and to hand the matter over to either of those authorities. The Forestry Officer and or the police will take over the matter. The suspect is interviewed and the matter is advanced or dismissed based on the circumstances of the case.
    Where the matter is to advance to the court of law, the suspect is formally arrested and charged. Bail may or may not be granted. In most instances, bail is granted to nationals on their own recognition. The suspect always has right an Attorney.
    The court will then decide on the matter.

    Interpretation: Wildlife: means animals of the following groups living beyond the control of man:
    “mammals (including feral pigs); birds and the eggs thereof; frogs and the eggs thereof; reptiles and fishes, their fry and eggs, and crustaceans found in freshwater streams or impoundments;

    Third Schedule
    1. Frogs-Crapaud (Leptodactylus fallax)
    2. Shrimps (All members of the families Atyidae and Palaemonidae)
    3. Crabs (All members of the families:
    Potunidae, Psedothelphusidae, gecarcinidae and Ocypodidae)

    Section 32:
    “No person shall export any live or dead wildlife or parts thereof except under a permit and in accordance with conditions specified in such a permit issued by the Director. The permit shall be in Form 5.”

      So based on your rationale and the law as stated, should the MANY Dominicans who have violated this law but never charged/detained by security officers, file suit for failure ALL of DASPA and Bardouille as the head, to do their jobs? because they surely have not been implementing the law until the day LL was considered to have breached it.

      These people are being paid by tax dollars, yet they are allowed to pick and choose when/how to implement the law. If it was standard practice to detain folks for breaching the law, this issue would not be as surprising to most Dominicans. The fact of the matter is simply that this law has not been regularly enforced, until the day they missed the opportunity to arrest and nullify the voice of Lennox Linton.

      Shame on Dominica and the Dominicans who uphold hypocrisy and double-standards instead of equal rule of law.
