Patrick John demands apology from retired FIFA referee Ibrahim Brohim

Suspended President of the Dominica Football Association (DFA) Patrick John is demanding an apology and compensation of $150,000 from retired FIFA Referee Ibrahim Brohim.

In the letter, sent through his lawyer, Glenworth A. Ducreay, John said comments made by Brohim on a local radio station on November 18, 2011 have greatly damaged his reputation.

John was banned by the FIFA Ethics Committee for two years and fined 3,000 Swiss Francs following proceedings of that Committee against Caribbean Football Union (CFU) officials related to apparent violations of the FIFA Code of Ethics.

The investigations were launched following a special meeting of the CFU held in Trinidad and Tobago on the 10th and 11th of May 2011.

The letter from John’s lawyer to Ibrahaim Brohim states, “We act for and behalf of Patrick John. Our instructions are that on November 18, 2011, whilst you were on a programme aired on Radio Kairi FM, you made comments intended to damage the character and reputation of our client. Additionally, our instructions continue that the said programme and your comments were repeated on November 19, 2011.”

The letter continues, “We are instructed that ever since, your comments and the airing of the programme thereof, our client has been sought out and characterized as a dishonest and corrupt person and a person who cannot be trusted and believed.”

According to John’s lawyer, not only were Brohim’s comments reckless but, “they maliciously and intentionally defamed our client’s character by effectively lowering the esteem in which our client is held by his colleagues, friends, family members and the football fraternity which he selflessly served and the general public. Your comments have also exposed our client to public ridicule and embarrassment, contempt, shame and odium.”

“In light of the considerable damage to our clients reputation, we demand from you full and unequivocal retraction and apology with an undertaking to immediately cease and not to repeat your said comments that inferentially, implicitly or expressly make reference to our clients character. The teams of the retraction and apology shall be approved by Glen Ducreay Chambers acting on the instructions of our client,” the letter stated.

It went on, “Additionally, we have advised our client that he is also entitled to substantial compensation for damage to his reputation, character and feelings. To that effect, we are therefore claiming $150,000 in compensation on or before February 28, 2012 failing which, we are instructed to institute legal proceedings against you without further notice.”

When asked, Ibrahim Brohim refused to provide Dominica News Online with a comment on the matter.

John has appealed the decision by FIFA Ethics Committee and is awaiting a hearing on the matter.

    dominicans need to know tht d money dfa getting from fifa there is no way as a footballer or a fan yu can hw this money is spent. imagine dfa receives half a million us a year, what has been done with football apart from a building in estate. what progress have the clubs made and some of yu ant to defend him for not putting the monies to the clubs but instead pocketing it. wake up dominicans and pick sense out of non sense and nw he want to sue a man. wonder why he eh going to his piggy bank hmmmmm

    Mr.Editor, I wonder what is working in the minds of certain people. I am not the type of person who condones wrong doing, but I am trying to find out if the disgraced president is on a witch hunting expedition or a tit for tat episode. I am saying that to mean that this is a man who has gone around saying so many things about people, but because he was never challenge, or the people that he slandered may have realized that this man do not worth his salt. Now he seem to be attempting to accumulate some much needed funds to keep him a float for the next two years.NB: With a salary of $5200.00 X 24 months($124,800.00), plus perks will amount to approximately one hundred and fifty thousand dollars. This is the motive and nothing else. Brohim, has assisted the disgraced president more than anyone else in Dominica in the advancement of football selflessly, and for today whether he may have said anything or not to attempt to extract money from him is a travesty. Further the lawyer who is representing the disgraced president should also ask himself a question in the form of ” Am I doing the right thing?” Here it is that the lawyer is the chairman of the disciplinary committee to which the disgraced president is also subjected to be disciplined in case of any infringement and he is practising double standard by being the legal representative of this man. What have we come to? Is it done in the name on money or is he in search of fame? I hope not. However, I believe that the Bar Association should intervene in order that some light is shed on this matter in order to bring to light to the unethical behavior displayed by some persons who ought to know better…

    I remember a High Court Judge telling the representatives of a West Coast community after throwing out a case that this is the price they pay for bad legal advice. Wow, Wow litigation to the sky on every concievable topic. We may soon learn too that Patrick is suing FIFA for what he claims to be the use of his past “challenges” to place a fine on him today. He still says he was not found guilty of any crime by the FIFA. But then he is fined big time. Can FIFA explain the fine?
