Top cop acting position extended

Acting Police Commissioner Daniel Carbon’s tenure has been extended for another three months

The appointment of acting Police Commissioner Daniel Carbon has been extended.

“Acting Police Chief Mr. Daniel Carbon has been appointed to continue to act in the office of Chief of Police of the Commonwealth of Dominica Police effective October 1, 2012 to December 31, 2012,” a release from the police department said on Tuesday.

Carbon replaced Cyrille Carrette on July 7 and was to  be acting commissioner until September 30.

He will now remain on the job until December 31 when a permanent replacement is found.

The extension of  the post for Carbon has not been without controversy as Opposition Leader Hector John has said he was not consulted by Prime Minister Roosevelt Skerrit, as dictated by the Constitution.

“This is a continuation of the disrespect of the constitution because the acting commissioner was put to act for three months up to 30th September and there was no consultation,” John told DNO.

    I am reminded of an old Chinese proverb, “If it is not right, don’t do it.”

    In Dominica presently, a few who think they possess all the power – political, quickly acquired wealth, through dubious means, do the wrong things, know that they do the wrong things against the Constitution and laws of the land, but do those illegal acts anyway. No Law, No Constitution could stop them.

    Dominicans, the classic case of Emanuel vs. Isidore, in which the former lawyer filed 42 charges of fraud against Isidore, cannot even start? Judicial Review? Until when?

    Chief Magistrate signed warrant, the Court sent it to the Police to arrest the culprit, who allegedly committed the fraud against Emanuel, up to now no arrest?

    The Court’s Order and Laws of the land blatantly disregarded? Hierarchy of the Force makes excuse and refuse to uphold the law and obey the Court’s order? Nothing happens? The Court even joyfully grants judicial review, so no charges could even be read to that lawyer and frees up the culprit, although he should have been arrested? give me a break? so no case then? big wigs would be involved? Case Kibosh?

    What about firebombings? Dominicans, dictators stop at nothing !! None will be saved under dictatorship. freedoms, rights slowly evaporating. Dominica I’m sorry. Remembering Papa and Baby Doc years of dictatorship rule.

    Once agan we have witnessed the raping of the constitution of Dominica by the Skerrit Labor Party Government.This behaviour has become increasingly scary in Dominica.Presently,we appear to have more actors in Dominica then in Hollywood.One of the most popular words in Dominica these days is the word UNCONSTITUTIONAL.The backs of the people of Dominica are presently tightened against the wall,therefore maybe we must seriously begin to consider some form of civil disobedence like the great Mr. Martin Luther King did . We cannot afford another 1979,therefore, the government must begin to listen to the people and obey the laws of the country,after all they boast of 18-3.

    This is a ‘Perfect Storm’. How do you expect a dude who disrespects the constitution and is probably holding office illegally to follow the laws of the land and knows what is the rule of law and the law of rule? Simply put, Dominica is a backwater country where all the folks are gone and are either intoxicated or sleeping…….I rest my case. You guys must be dreaming!!!!!!

    what do you expecting the acting police commissioner to be doing re: crime and all the bachanal that’s taking place in Dominica? Acting Acting, Acting and more acting! So to solve the problem appoint a Police commissioner and call it a day!

    Too many acting positions in Dominica just having folks getting big money every month end for acting, acting acting! Is acting in Health, Sport, finance, agriculture or dead culture, security, education, works, and the list of acting positions for the actors and actresses continue.
    Why don’t they add they add to the national day of community service, acting day of community service? And the street jump up to Acting Like all is well street jump up or act like you have a million dollars in your pocket sewo! And for those who always say they love the nation for all kinds of gains, why don’t you all just say: acting like we love them season! When election comes by, jus wait for acting season to open. All will be acting but those with intelligence wont fall for them silly season and stupid games!
    ps: just act as if all the things promised to Dominicans will come soon. Act as if you all really care!

    Ths blatant disregard for Dominican law does not stem from the PM but from the very people who support him. DOminica is the way it is because Dominicans in general are corrupt and have no values. When the country has values and knows God people will not allow this madness to happen. We are a gimme gimme gimme country- and we do not care where it comes from. Our people need to change. We are the ones allowing the PM to do what he wants.

    Admin DNO, the story seems incomplete. The information is scant and I am hungry for more details. In the event that you can’t assist, I would sincerely hope that your readers could help shed some light on the situation.

    1. Could you kindly advise whether the constitution of the Commonwealth of Dominica has been formally suspended by the Roosevelt Skerrit lead administration?

    2. Could you kindly ask one of our senior counsels or experts on constitutional matters including Dr Honeychurch whether it was necessary to follow Article 92. (1) of the constitution in this instance? Was it followed? Does it matter to Dominicans whether or not it was followed?

    3. Mr. AG, are we still being governed under your Doctrine of Necessity? If not sir, please advise which doctrine is appropriate in this instance?

    4. Is that the way an 18-3 majority is to be used to the extent that we now have an illegal PM, unconstitutional president and repeated unconstitutional appointments and/or extensions of the tenure of our police chiefs?

    5. Was it the unconstitutional President or the illegal PM who made the appointment? Did the unconstitutional President sought to determine whether the illegal PM had consulted the legitimate Leader of Opposition? Who actually made the appointment- the illegal PM or the unconstitutional president?

    6.Did anyone consult with the Leader of the Opposition in extending the appointment of the Ag Chief of Police?

    7. Are Dominicans really satisfied/happy with the current state of affairs?

    8. For how long are we going to be with an Acting Chief? Is that a way of ensuring the lack of independence of tenure and objectivity in decision-makin?

    9. To those who will be quick to give thumps down, please help me understand why you are prepared to defend the status quo. Please explain to me why the PM would repeatedly disrespect the Opposition and the constitution of Dominica. Please forgive me but I just don’t understand. Enlighten me…please someone!! anyone!!

      Interestingly, Roseasu Valley did not make any inference to Lennox Linton as being a “constitutional expert”.In fact he referenced the Senior Counsels among us and the AG’s office. It was Lennox who took the Presidential debate to the dizzying heights of callousness and total partisan.

      Roseau Valley the Court has ruled that the PM was legally elected. You have no respect for the Courts but you speak about constitut ionality.

      Why you do not want to wait for the decision of the Appeals Court the final arbiter on the matter. And are you going to accept the final decision if it is not what you expected?

        Such was the contribution of a minister of government to Sir Alleyne, failing as it were to make an intelligent contribution to the national debate on the constitutional appointment of our president.

        FYI- Roseau Valley is not an officer of the court but if he were, he would be very respectfully to the court.

        Roseau Valley respects the court and the judicial process but disagrees vehemently with the decision of the Judge Thom.

        Yes, if the Court of Appeal were to uphold the decision, Roseau Valley will respect it for whatever it is worth but I shall continue to lament its flaws so that those who ought to be held to account will do so politically.

        Roseau Valley is not playing politics. These are serious matters of national importance insofar as they pertain to the supreme law of Dominica.

        Roseau Valley has great respect for both Astaphan S.C and Lawrence S.C to the extent that they respect themselves, their profession, their professional colleagues, their fellow citizens, the notion of truth, the concept of integrity, the constitution of Dominica and the country of Dominica.

        It was an SC who announced on the Next Level programme that he does not respect the opinion of any lawyer who is his junior and he would only comment on the opinion of one who holds an equivalent rank in the legal fraternity — he was saying this in the face of a junior colleague who is not an SC- So much for respect.

    How can a someone who believes in democracy and the rule of law supports Skerrit.Where are the Unions,the Churhes, DAIC,the legal minds,are they just going to allow Skerrit to do whatever he wants when he wants and not even talk about it. They dont have to criticise Skerrit or get involved in the daily cry of curruption but aleast let Dominicans here and abroad know that they are concerned about the blatant disregard to the upholding of the constitution. Remember the days of Patrick and Leo,these guys never enjoyed their stay in office.It was a daily dose of political harasment,today many of the same people are still alive and what is happening today is far worse then those days. They are more silent then a gave yard at nights. If Dominicans dont stop that nonsense immediately,I pray to God it might be a case of to little to late.

    The country and its 70,000 inhabitants still waiting to know, after two years, if the PM is legitimate in office. His dual-citizenship case still not over.

    One Police Chief, one Acting Police Chief, a President all illegally in their respective positions. The process to be followed according to the Copnstitution, has been flawed. No Constitution, No Law, not even lawyers could stop the Supremo from doing those unconstitutional acts.

    No case for the Lawyer charged with 42 counts of fraud.

    Investigations stalled into two firebombings, one on Emanuel and his wife, and the other on a Police Officer, who is investigating money-laundering.

    Rubbish Bin and fertilizer Bobols – No investigations, No case although a criminal act was committed.

    The list goes on and on. Just like that again. In our faces. Another illegality. Dictatorship under our beds and the people are laughing, ignorant of the fact that Haiti was once ruled by dictators like Papa and Baby Doc.

    Who have eyes to see, let them see. Who have ears to hear, let them hear. It is a crime to stand by and allow Dominica to be drowning in so many illegal acts.

    Really, can someone tell me who the government is going to get to fill in that post. This extension thing is going to be like this for a while until the government simply appoint Carbon as Commissioner, Just wait and you will see. Carbon has no finess in the way he speaks on the radio informing the public about certain things he is asked about, he thinks he is in his backyard, talking to little boys.

    Spaggs only want to consult when there are “Big appointments to be made. It would seem that this is the only part of his many duties as Leader of the Opposition he is interested in. For example, he has not called for or convened a meeting of the Public Accounts Committee for years now. A few short weeks ago he was talking loosely about having the meetings of the PAC in public. No doubt he wanted to hide behind the cloak of his UWP know-it-all media acrobats for support in what he or they wanted to do. Outside of that there has not been any word form Spaggs except to lament that he was not consulted. After all Spaggs, if we have an illegal President and an illegal Prime Minister, why would you want to mix up with them anyway. You and the other three members of Parliament from the UWP are the only legally elected members of parliament. So continue to stay by yourself.

    Stop being selective with your sacred duties as the alternate PM. Stop singling out what you want. Unless otherwsie established,as I undersatnd it the convening of meetings of the Public Accounts Committee (PAC) is yours to arrange. You have not yet arranged any such meetings after more than two years in the job (remember you all the experienced parliamentarians to woo you into ignoring parliament for almost a year), yet you have difficulty with another man’s job. Come on Spaggs. You know that Salisbury and Dominica know that you can do better than just belly aching

    Only in Dominica, these blatant violations of the constitution can happen and the people remains mute. SMH!!

      Perhaps DNO should investigate whether the Commission had an opinion on the appointment.

        You are conflicting yourself by your own admissions. If you say that the president acts only on the advice of the PM. Then it seeks to reason that any move by the opp leader to seek redress with the president, will be promptly overruled by the advice of the PM.

        Unlike the system in the US, our constitution has no checks and balances to ensure it runs smoothly, it depends on the goodwill and honesty of those in control. If the leaders are corrupt and unrighteous, then in effect you have no constitution protection – go figure

      UWP alone cannot bring about the change you desire. You have to get involve. Be there when they call for protest or a simple gathering. Make a financial contribution when called upon. Write articles on the wrongs in the country and the poor governance practices of this current administration.
