Man acquitted of murdering his brother, convicted of manslaughter

Mitchel Toussaint, the man who in 2011, was charged with murdering his brother, has been acquitted of murder but the nine member jury of eight women and one man found him guilty of man slaughter on July 22, 2019.

Toussaint was charged with murdering his brother, Alexis Toussaint of Bense, in November 2011 in a land dispute.

The State led by Director of Public Prosecutions (DPP) Evelina Baptiste called a number of witnesses including the wife of the deceased.

Police inspector George Theophille, a scene of crime expert who photographed the body of the deceased and the crime scene, also testified.

Cassandra Tousssaint, another witness, related to the court what happened on the night of the incident.

She said it was a moon-lit night and about 2:00 am, she heard a loud noise. She said she lives about 15 feet away from where the accused lives and thought he and his girlfriend were in an argument.

She said she went out and she saw the deceased on the ground with the accused standing over him. She stated that she saw the accused “make a lash” but since she was pregnant and scared, she went back to her home.

The police were eventually called.

In 2016, then high court Judge Errol Thomas, aborted the case and declared a mistrial after reports were brought to his attention that a member of the jury was heard by a police officer making adverse comments on the case.

Justice Victoria Charles-Clarke has ordered a social inquiry report on the convict and set sentencing for September 20, 2019.

    No amount of jail time will heal the Brother’ spiritual wounds, his Animal instincts did not let him evolve. One of the dimensions of Emotional Intelligence is Empathy, and that was lacking in totality , his own Brother was the victim, Mr Toussaint’ Platation given name, will forever remain FETTERED and SULLIED. Other disciplines of EI, includes Self Awareness, Self-Regulation, Motivation and Social Skill. It seems most are not the Core of every day Dominica life. The lessons to be learnt from this episode, is enormous where the Young Peoples are concerned.

    Was it in self defense he killed his brother, now what is it going to profit him knowing that he killed his brother over some land dispute. Why was it so long before a verdict could be reached? Justice delawed is justice denied

    It took eight years to finally dispose of this case. Justice delayed is justice denied. I hope the perpetrator is justly rewarded. A life is sacred no matter how poor, rich, intelligent or daft. The relevant authorities make a mockery of the justice system, as with everything else, when they failed to execute their duties in a timely manner. Time for Mr. Toussaint to enter prison while it’s time for the underperforming dictator and his spineless inderlings to exit office.
