Man jailed for threatening police officer

Deny Delon Philbert is now an inmate at the Stock farm prison after he was jailed on Thursday August 29 2019 by Magistrate Michael Laduat.

Philbert of Bath Estate was arrested on August 28th 2019 after posting threatening and insulting language towards a police officer.
He stated in his post,  “I will open the head of ( policeman’s man withheld) wide and come to his home to attack him.”
Philbert also used insulting  language in his post. He pleaded guilty to the charges.
On the charge of insulting language, he was reprimanded but on the charge of threats, he was jailed for 18 months.
Philbert is no stranger to the court and has a long rap sheet. He was represented by lawyer Peter Alleyne who pleaded on his behalf asking the court not to impose a custodial sentence saying he client was ” remorseful…sorry for his actions and apologized.”
But magistrate Laduat was not amused, saying that such threats are sorry and Philbert continues to disrespect the law. He said he is duty bound to send a message to those wanting to issue such threats that the court will deal with it seriously.
Police prosecutor, sergeant Jeffrey James, prosecuted on behalf of the state.

    The magistrate has punished this guy for other legal problems ( a long rap sheet and continued disrespect of the law) and not just the threat and that is wrong. 18 months constitute an excessive sentence. As for the threat, threats should only be punished where there is imminence. There was no threat of imminent harm from a threat made in a post.

      People always talk when the shoes is on one foot but when the crime hits home they sing another tune. Firstly do you know what a threat is? Threat even though a misdemeanor is a serious offense. How does imminence makes it more serious than social media. The offender is not stuck but likely to move. Don’t send a wrong message that citizens can just utter violence without repercussion.

    I’m a bit curious, confused or both. Is this the guy with the misaraged teeth who was recently making the threats asking where the police was living and all that? Well if so, it was expected that he would be charged and possibly jailed has transpired. My confusion is I’m whether this is one of the group of young men who were threatening who I think was also a police in Bath Estate some time back while he was pulling down branches of a mango tree (another unrelated Incident). One if the young men issued the threat that “a bullet would be put through “police” head”. Is this the guy that was charged? If not, why was the recent guy charged and not that one from the group of guys Bath Estate? I’m expecting to hear two charges and sentences for threat. Otherwise I must question the precedent that is being set and the selective justice that is apparently being dispensed.

    I agree with some of the comments that certain people are taken more seriously when a report is made about threats. I agree that the guy should be jailed but what about the ordinary citizens who are threatened on a daily basis and when report is made to the police the do nothing. Sometimes you have to make them feel what we go through on a daily basis when they dont deal with the threats. Or maybe this guy should still be walking the streets for them to know how it feels. I just hope going forward when people make their report they are dealt the same way.

    So it’s obvious that this man is mentally challenged and honestly to me, talking rubbish. But, there’s also a video of 3 fellas in bath estate telling an officer “I rather put a bullet in your head instead of going court and waste my time.” I guess no jail time for bath estate block boys

    I applaud the fact that he is jailed for making threats to a law enforcement officer. The law is the law. However a man was killed by police in thier custody in Portsmouth. Where is the justice. The only message i got from the magistrate is it is ok to kill a man than to make threats. Crime is crime no mater who commits them!! We are making a mocry of our criminal justice system. There seems to be two seperate laws in Dominica. One for the nobodies and one for the criminal elites. People not authorized to order who to arrest and search. Illegal warrants to search man house. Four people charged in inciting 3 dragged to court and one dont bother show up yet he is not arrested. No information on whether his charges were dropped and why. This is not justice.. So mr. Laudat check your messages. Dont talk about money laundering and constitutional criminals. I rest my case your honor!!

    People in high position make threats all the time how come the police can’t hear them like the PM and his cronies proves the point in Dominica there is no law ,no equal rights as far as ghetto people is concern,maybe the police could prove me wrong and make an arrest on the PM and some of his ministers for making threats and braking the law.

    i saw Denyl’s video…He is my nephew and is clearly guilty of the offense..which he admitted to after coming down from his high, no doubt. I believe he is also diagnosed as mentally ill – schizophrenia- which may be a mitigating factor. On behalf of the family I offer sincere apology to the officer and his family who were threatened. I accept jail time may be necessary in such instances but an 18-month sentence appears harsh for what I believe may be a first time offender. The larger issue of mental health services and treatment for our youth needs to form part of the national conversation especially at this time of spirited debate about how to allocate national resources..We are losing our youth to drugs, alcohol, mental illness and other deviant behaviors.

      Dominica is a very backward place, it is the only country on this planet where there is no freedom of speech!
      How can someone saying they will open the head of someone be a threat?

      When I was small there was a man in Wesley who asks his friend to write a letter to a woman he loved, and could not tell tell her; he could not read, hence his friend wrote the letter for himself, and got the woman.
      When my grandmother heard the story, she informed me and told me; ” Son, open your head and learn in school so that nothing like that happen to you.”

      Was my grandmother suggesting I chop my head open to learn?

      Absolutely not; the keyword here is open; for the uncle who agree that his nephew is guilty, your day is not too far off, your nephew is in jail thieving politicians out free oui!

        Francisco my biggest problem is with the police itself as a failed institution..Recently about a week ago, Skerrit called upon his supporters to pour hot water on opposition candidates when they are canvassing for votes in a particular area in Dominica. The police is fully aware of the statement, but they can’t even issue a warning to the idiot Skerrit. Had it been Lennox Linton, he would have been arrested! Dominica has no justice system to be proud of .!
        That’s a failed country!

          You know, I am of the opinion if the police in our country stood next to Roosevelt, while he pulls out a gun and shoot a UWP member, or a supporter, that police officer would leave the criminal; the culprit Roosevelt standing and go and find Lennox, and blame the murder on him and arrest him!

          If by some token the police forget Lennox exists; that sucker would take responsibility for the crime, and go to the galas:   forfeit his life and let the real culprit Roosevelt go free.

          In their world Roosevelt is god, he can do no wrong; but time will tell; he cannot remain in power for ever; he will pay for his wicked vicious crimes of sedition and others which he has committed over, and over in our country!

          That little rat time and day will come.

          I fully agree, SKERRIT should be reported or charged for threatening language. What do you expect when SKERRIT said he run things in DA? SKERRIT is going to say worst than that and nothing will happen. That’s the kind of Leadership in DA.

          I am not in agreement with the young man using threatening and insulting language towards the Police Officer.

    Why is that when ever it comes to police a man is so quick to get thrown behind bars? But police themselves do so many illegal crucked things that one will have a hard time believing. Please give regular citizens the acknowledgement attention and swift justice like you do for them crooked police officers

      I have being saying on many occasion that Dominica doesn’t have a police force anymore but rather it has been degraded to being Skerrits private militia. Furthermore the law in Dominica is applied to some but not to others.

    You cannot go around threatening police officers for doing their jobs simply because you are “connected” to some politician. These guys must be taught a lesson. Next time double the sentence please. Law enforcement officers are there for us all so whether we disagree with some of their actions that should not translate to insults, threats or injury to them and family. Again, job well done Mr. Magistrate and continue the fast bowling when needed. We got your back bro.

    I agree that persons should be charged for threatening people. But the truth is we must not too political and bias with our judgement. We need to treat everyone equal. I mean what is more frightening than to hear the Prime Minister of a country publicly advise his supporters to throw HOT water on his political opponents yet to date, no one has condemned or arrest anyone? Would I get away if I told my children to throw hot water on Christians or Jehovah witness if they put foot on my step? Would Lennox Linton or any member of the UWP walk free if they told a family member, in their bedroom, let alone in public, to throw hot water on members of the DLP? We must be fair to all man. Dominica is just sold to do evil

      Good point. So many sex offenders walking free, people robbing people in broad day light and they never see the court, murderers getting slaps on their palm but the simplest of things such as a spliff, small quantities of marijuana, and a man saying he will burst a police head getting a year and a half jail. And we wonder what’s wrong with the system? If the head is corrupt, the rest of the body compliments it. Blessed day

      Every threat should be taken seriously. If not, society could descend into anarchy. I have experienced people making threats then executing them. The message is that threatening language should not be taken lightly. The tongue has no bone but has caused much damage.

        Mr. Dog, I live in the United States, where there is freedom of speech, and if someone said they were going too open a Peace Office’s (police officer’s head) I don’t think the person who spoke those words would be arrested and sent to jail.
        When Obama was president, a man said some threatening things pertaining to Obama, the FBI paid him a visit, and ask him to explain what he meant by what he said; they did not simply go and arrest him and put him in jail.

        Dominica is a police state supported by a corrupted one man government Roosevelt Skerrit destroying the life’s of our young people.
        The sad thing about it is we have people in Dominica puled of the street or in the civil service, without ever studying law, never been to law school playing magistrate jailing people  if I had my way I would open the head of some of them and pack it with commonsense.

        Let them send FBI to get for opening head!

            Mr. Dog, what you have conveyed is not true; I will not say it a lie; but be informed, we see people Americans and foreigners disgruntled anyway burning the national flag of the United States everyday!
            Nobody murders them, by shooting them at the back of their heads.

            Freedom of speech is alive and well in this country. Certainly there are instances where things get out of control, but a police office have to be careful not to trample on the civil rights of people, for this reason the courts a filled with law suits due to police abuse of peoples rights.

            The city of Los Angeles settles thousands of cases not allowing them to go to court.

            Guy if I am driving down the street and there is a pot hole and I drive into it and my car sustain any damage, I will sue the city, for the damages and prevail; we have rights in the Unite States.

            Can you do that in Dominica?

    So when Skerritt tells Dominicans in Belleview Chopin to throw hot water on the opposition isn’t that threatening enough for the police to charge him with a crime as well? No wonder so many people do not believe in the system of Justice in Dominica. And the thing about it is that it’s not the first time that Skerritt has been giving terroristic advice to his labour party followers. At least the police need to get Skerritt to apologize for that type of behavior and promise not to do it again. Are we going to wait till someone gets hurt badly before admonishing Skerritt? It has to stop. It can not be that the powerful and well connected blatantly violate the laws and the police look the other way.

      He should not be made to apologise..They should charge him. He is a repeated case (a bad example) of a leader calling on his followers to carry out criminal acts… You don’t ask repeated offenders to apologise. He gets away because our criminal justice system is non functional for he and his ilks!!!
