MiriDom demands right to sexual expression for LGBT community

Coordinator of local group, Minority Rights Dominica (MiriDom), Daryl Phillip is asserting the right of the LGBT (Lesbian, Gay, Bisexual, Transgender) community to exist and have sexual expression.

He spoke to Dominica News Online (DNO) in response to a  recent statement made by District Superintendent of the Christian Union Churches of Dominica, Pastor Lennox Timothy on the growing concerns of the LGBTT global movement. Pastor Timothy presented a biblical view to Dominica as a “measuring line” of this development.

“The pastor has a right to defend his belief  as he sees it and the LGBT community in Dominica has a right to ask,  to seek the right to exist, the right to sexual expression which has been made illegal,” Phillip said.

“You cannot intrude on peoples rights and tell them it is because the bible says so. The matter going to the court is a matter of human rights and human dignity; it is not a matter of biblical belief. So the pastor is free to quote his bible but quoting his bible does not make the community freer or a little more livable for the LGBT community. It actually makes it worse and impedes on people rights to expression,” Phillip insisted

In the court matter which Phillip refers to, a gay man has filed a case in the High Court of Justice in Dominica challenging the country’s laws criminalizing “buggery” and other sexual activity between consenting partners, “including and in particular, partners of the same sex, as violating numerous rights guaranteed in the Constitution of Dominica.

A press release titled “Constitutional challenge to Dominica’s laws criminalizing LGBTQ people”issued by MiriDom states that the claimant is challenging two sections of the Sexual Offences Act (SOA) of Dominica; Section 16 criminalizes “buggery” which the Act defines as anal sex between two men or between a man and a woman and Section 14, which is a sweeping law criminalizing “gross indecency,” which is defined as any act (other than penile-vaginal sex).

Phillip argues that Dominica should be guided by all biblical sayings, not one.

“There are a lot of things that the bible states that they are not talking about. There should be a law against fornication, adultery, eating pork… so it’s kind of being hypocritical… and that is the thing the minority rights Dominica is fighting for… and our society should be big enough to recognize that this is impeding on a certain set of people and they need to be given the right to exist, to express themselves like everybody else.”

MiriDom claims in its release, that these laws have caused discrimination and violence towards the LGBT community.

“For many years, evidence has been mounting of the harms caused to Dominicans by criminalizing LGBT people, including the stigma, discrimination and violence encouraged by such laws,” the release states. “The continued criminalization of consensual sex by LGBT people through the gross indecency and anti-buggery laws, and the broader abuses against LGBT Dominicans to which such criminalization contributes, have damaged too many lives — and continue to do so every day. These are the lives not only of LGBT Dominicans, but also of their family members and friends who have lost loved ones to violence or AIDS, or when those facing persecution have sought asylum elsewhere.”

It added that the goal of this legal claim is to end the criminalization of any consensual sexual activity between persons above the age of consent, in particular the criminalization of consensual sex between partners of the same sex.

      What part of two people having sex, whether for procreation or not, isn’t natural? I’m not sure if you’re married or have kids, but do you just not have sex if you don’t want another child? I live in the United States, so maybe you don’t have condoms, anti pregnancy pills, hysterectomies, vasectomies, or menopause there, but if you do, how is that any different than two people of the same gender having sex? And to all you who say it’s wrong because they say so in the Bible, tell me where it says I can’t marry for love. Show me where it says 2 people who love each other shouldn’t be married.       Not really so. Jesus is the ultimate authority and He will punish those out of line with Him. Yet Jesus has delegated authority to humans. The Bible talks about the need for parents to use the rod on their children. 1 Corinthians chapter 5 talks about sinners ought to be excommunicated from the church. These are forms of punishment obviously. And Romans chapter 13 talks about how God has delegated authority to civil government to punish criminal behavior. And we should seek to lawfully influence our government to act in accordance with God’s law. He has already demonstrated with Israel under the Mosaic Law what a society governed by Him ought to look like- and it includes criminal punishment for the homosexual. An aspect of our own judgment on Judgment Day will be the impact our own views and vote might have had on a society’s legislation. We don’t want to be found to have had an influence on our society contrary to the verdict of God’s Law- that is equal to opposing God.

        Steve people quotes the Bible; nevertheless, not everyone who quotes the Bible know what they are quoting, one cannot quote one verse of scripture without knowledge of what led to that single quote.

        You see, one have to know where something pertained to Israel; the Jews, and not Gentiles.

        You see the Israelite’s  are God chosen; he had a reason for instructing them not to eat certain kind of animals, ect, ect!

        Nevertheless, while he instructed them not to eat these things, he instructed them to “give it to the strangers at thy gate!”

        Anyway eating something; defiles not the body; it’s a far cry from people indulging in homosexuality; from my view it’s a curse, it is the same as one who indulges in bestiality!

          And to the three of you; Leviticus is the Book of Law in the Old Testament to ancient Israelites from God through Moses–the problem with the Israelites was that they did not obey all of the Laws so physical death was their punishment

          That was why Jesus came as a Man, in “flesh and bones”; it was to fulfill the Laws of Levituc on behalf of all mankind not just the Israelites; He did so through His “obedience” and “humility” which no other man could do

          That is what the apostle Paul means when he spoke about God’s promise to mankind: “When He (God almighty) could swear by no one greater, He swore by Himself”

          Jesus replaced all of those Laws with just one Law–it is the “Law of Love”.

          He said, if you are doing the “Law of Love,” you are doing all of the Laws of Leviticus.

          But who, in the World knows the “Law of Love?” What the gay man and the lesbian woman is doing, most definitely, has nothing to do with Love.

            You are correct that what the gay man and the lesbian woman are doing has nothing to do with love. But Jesus didn’t replace the laws in Leviticus with love; the laws in Leviticus always were love and Jesus vindicated God’s law by saying that every last bit of it is the expression of proper love towards God and one’s neighbor (Matthew 5:17-18, Matthew 7:12, Matthew 22:36-40). The law of God must define love or anything could be called “love” and there would be no basis to say anything was wrong. Jesus upheld all of the law and all men are still bound to any law or principle in the Bible related to morality. Jesus upheld the ceremonies and rituals concerning atonement for sin and Priesthood as He is the substance of what the OT ceremonies concerning these things foreshadowed. Even though the dietary laws in Leviticus were only binding by God’s appointment for a time and are not binding upon people now, they nonetheless represent spiritual realities which yet remain in place.

        If you actually read the book of Leviticus you’d see that it’s dietary laws were specifically for Israel. God didn’t bring judgment on the Canaanites for eating shellfish. But God was judging the Canaanites and removing them from their land for their idolatry, incest, homosexuality, adultery, and other violations of His moral laws; and the context of the prohibitions against homosexuality in Leviticus are in the context of God warning Israel not to defile themselves like the nations around them were defiled over such perversion that violates His moral law or they would be cast out of the land of Canaan themselves. All proven by simply reading Leviticus chapter 18 as a whole.

    Our legislation should not be based on religious doctrine if we are not to end up with dictates like sharia, although sometimes they intertwine. But even here there are contradictions. Killing a fellow human being is both a sin and a criminal offence….except, of course if during armed conflict you kill an enemy solider, whom you never knew and had no personal issue with. In that case you may end up as a national hero. Would God, Jahweh, Allah approve?
    With regard to sexual behaviour, are onanism, fellatio, cunnlingus, dildo’s illegal? I understand bestiality is but should we also include the sale of condoms? After all, they do prevent pregnancies, seen by some religions as the only justification,for sexual intercourse. Offending public decency I do understand, as something that affects most of us but then we should also include those who expose themselves in public to urinate or defaecate. Let people be human beings as long as they harm no one, commit a crime or a public offence.

      No one can improve upon the way God would legislate a society. He has shown us principles in His laws for the judges in the nation of Israel that He expected them to follow. He commanded the murder, kidnapper, adulterer etc as well as the homosexual, bestiality and incest perverts to be put to death. These were to be executions carried out by the judges after the convicting testimony of multiple witnesses. No one was allowed to execute of their own accord. You also see in Exodus 22:2 how those breaking into homes with intention to harm were permitted to be killed by the owner of the home and God did not consider this murder. When people allow perversion and evil in their jurisdiction it is something God considers evil. We must define evil by God’s Word and stand against it as much as our lawful authority properly allows us or we are complicit with it in God’s eyes. Wrath and severity are aspects of His character as well as goodness and mercy. -See Ex 34:6-7, Deut 10:17, Jer 10:10 etc

Was upset with his wife for having a coworker who is gay collect his daughter after after School.. I told him I prefer to let the gay guy to collect her. She will come to me untouched.     The problem is that the rest of us, sinners, are not out there calling for rights to perform our sins publicly, that is the reason it is so hard to find a murderer, a thief, and even an adulterer, they do their things in the dark

    The Law against adultery, fornication, etcetera, is the Law of the Bible, according to God’s Word, so those who commit those sins are left to be judged by God Himself, no man can judge his fellow man, but that doesn’t mean we must keep company with immoral behavior

    The Bible is the Book of Law for all mankind, the Constitution is the Book of Law for its Nation. So both laws in Dominica prohibits the conduct of those who call themselves “gays” and “lesbians”. Yes, it is the conduct that is unaccepted; Dominicans do not want “gays” and “lesbians” shoving their gross action in our faces, there is nothing healthy for the minds of our youth and young adults in that scenery

    You speak about the transgressions that societies commit; however God destroyed the cities of Sodom and Gomorrah because of their sinful ways –especially their conducts of homosexuality; so why only those two cities, why not the whole World, for there are sinful habits everywhere.

What consenting adults do in their bedroom is their business, and LGBT people should feel free and safe to express themself and hold hands with their partner on the road without worrying.

    I have always wondered why is it necessary for people to come out? I mean, Black men in particular just show the world they are Gay by swinging the engine too much. So tell me, should I come out as being straight? What are the specific discriminatory practices against gay people?

    Come on now, I mean some of our people maybe a little politically daft, but to make these claims and present no evidence is unacceptable.

    The buggery laws are more to protect young kids than adults. Straight people get AIDS, and face violence too. The disease does not discriminate, a criminal is a criminal.

    Why not do your stuff behind close doors? No one will care no one will be concerned whether you go to Heaven or not, at least not me because it is your decision. Oh yes, gay people can go to heaven, you just have to abstain like straight people, because they too will not go to Heaven if they do not obey God’s commands. So Genesis 19:1-29 is not only about gay people, it is about everyone.

    There is no “dignity” in homosexuality. It is a form of sexual deviance that results from psychological and physical abuse including sexual abuse and exposure to sexual content at a young age, lack of proper parenting etc. Instead of encouraging this lifestyle what we should be doing is looking at ways of solving this problem which is essentially an issue of mental health.

    Also there are no provisions in the law that allows for abuse against people because of their lifestyle. If you have been a victim of abuse or violence you are free to report it to the police.

    Legislative restructuring also will not stop the spread of STDs because you cannot legislate away bad habits. If you engage in sexual deviancy you are also very unlikely to practice safe sex. That’s just the way it is.

    Do the practitioners of these things also deserve their rights for sexual expression? After all, they can also all claim they were born with their sexual preference and deserve their rights also.

    With the legalization of homosexuality, every other sexual perversion will also have to be legalized.

      Our supreme leader, the creator God ( YAHWEH) gave us our rights. By him we were given a right to life, a right to religious liberty and the right to obtain private property.
      To choose to have sex with a man is not a right. It is an abomination according to Yahweh God( Leviticus 18:22) and is therefore absolutely illegal.

      Now i understand that the unbelieving world is going to do what the unbelieving world does. But everyone who follows the almighty God is to submit to his commandments, including the commandment against homosexual behavior. That doesn’t mean we should be unloving toward people engaged in that lifestyle-God forbid! But we cannot compromise God’s standard. truth is truth.

      God demands that we be holy in our conduct, including our relationships which, according to the Bible, is only to be enjoyed within the boundaries of a covenant marriage. And marriage, by definition, is a heterosexual union.

    All humans are born of a sinful nature; left to ourselves the entire human population would burn in the lake of hell fire if Jesus did not come to earth and sacrifice his life by shedding his blood on the cross for the sins of all humans.

    However, before we as individuals can benefit from his sacrifice, we first have to repent of our sins (change or way from sin).

    Daryl, are you saying that with the laws on the books you cannot walk with your partner on the streets? If someone decides to beat you up because they notice you gay it is because of the laws on the books? What if the act is decriminalized and then a man has reason to accuse another man of buggering him how will that man be charged? The devil really is a liar.       Of course any type of sexual assault should be criminalised and the attacker prosecuted by law no matter the gender, but this is a very different topic from what we are discussing here. Here we are talking about consenting adults, not about somebody being assaulted or ‘buggered’.

    Is there an LGBT community in Dominica? Whereas I do not support any type of discrimination against the LGBTs, I am confused to understand who has been persecuted in Dominica for their sexual orientation. Homosexuals, both male and female, have coexisted within the Dominican society for a very long time, and though they are referred to in derogatory terms, yet I have not seen any evidence of persecution. In fact, some prominent gays and lesbians have held positions of authority on the island without any difficulty.
    MIRIDOM should present evidence of persecution and I would be the first to render my support otherwise it appears that they are following the bandwagon of the international LGBT movement.

      But it’s not OK to be referred to in derogatory terms. There are alot of gay people persecuted and this would not go to the court for their attackers to be prosecuted simply because they won’t currently be protected by the courts as it’s still illegal here. The gay people have every right to feel safe and supported in society as anyone else, and this is why the law needs to change.

      I agree, yes it’s finally time for LGBT rights! (well ideally homosexuality should not even be an issue in the world but people made it an issue). I’ve written supporting comments for Daryl and Miridom on here, but they’ve all been deleted.

    Would the head of MiriDom just sat that he is ready to break the closet door open. In my world and my Dominica the only rights that one should have with no objection is a right hand, foot, eye, ear and other body parts. Although that’s the way I see it no one has injected to those sick people engaging in their activity in private. Go to your home, play in the septic tank as much as you want. Just do not attempt it bring your nastiness in public and give the youth the impression that it is the right and natural way to go. I will say so without reservation that EVERY gay person, man and woman, is mentally sick. Dominica is a Christian society. The Christians need to stand up. Even when Pilate found Jesus not guilty the community said crucify him. So to are we saying to hell with the courts and their version of rights. We will not accept this as a norm in our society. Let us run them out of town. The courts should be more concerned about the leakage of divorce petions than gay rights

      This is the most crass comment I have read on DNO in a very long time. It brings absolutely nothing to the table. I agree with Mr Phillip that we are being hypocritical as a number of us have anal sex with our girlfriends and wives.
      It really does not matter to me what 2 consenting adults choose to do with their bodies.

      In a country that criminalizes freedom of LGBT expression, it’s very understandable if people are scared to express themselves or be ‘undercover’. It’s not something they should be shamed for. Change the laws, educate society and the majority of people will feel safer to express themselves.

      Wow, is this your response. Why does it matter to you who are on cover and under cover, is it relevant. Why don’t you look at the big picture and see how a segment of people are persecuted, discriminated and scorned at simply because of their sexual orientation, all they are asking for is to be treated with respect and dignity repealing laws that discriminate against them.
