Antigua election petitions have no real bearing on Dominica and St. Kitts matters says a prominent attorney

BASSETERRE, ST. KITTS, APRIL 1ST 2010 (CUOPM) – A prominent Caribbean constitutional attorney in Dominica says a judge’s declaration in Antigua that the election of three government parliamentarians was invalid, has no real bearing on election petitions now before the courts in Dominica and St. Kitts.

Senior Counsel Anthony Astaphan is representing Prime Minister Hon. Roosevelt Skerritt’s Dominica Labour Party (DLP) and Hon. Denzil L. Douglas’s St. Kitts-Nevis Labour Party (SKNLP) in court matters challenging results of recent general elections.

“The judgments are significant but are based on two issues that do not apply to Dominica,” Astaphan said reacting to word that Justice Her Ladyship Louise Blenman had declared the election of Prime Minister Hon. Baldwin Spencer, Tourism Minister Hon. John Maginley and Education Minister Hon. Jacqui Quinn-Leandro invalid, leaving the government in 7-7 tie with the opposition in a 17-member parliament.

    Does any political party have the right to file petitions in court to challenge alledged fraudulent elections? Who doesn’t think so need some psychiatric help. The ruling party and Tony Astaphan ridiculed the opposition and remarked that the latter were either mad, or hungry for power to even mention that there were several irregularities that were not in obedience of the laws. To go to court with petitions is a waste of time. But Tony did the same working with the ALP in its court case regarding election irregularities. We are now learning of the same action being taken in other islands. Let Tony and the DLP know that there are intelligent and genuine people still in Dominica who prefer free and fair election and a process that will make our democracy stronger.

    Never again slavery. Never again should Dominicans behave like the colonial oppressors who overtly and covertly grabbed power from the masses by any means possible.

    Irrespective of all the calls, cries and pleading for Electoral reforms, some persons in power are trying their best to prevent or stall any attempt to reform the electoral system. A change to the system to ensure that cheating or bribery is arrested should be welcomed by every law abiding Dominican.. There are rules for every game being played, football, cricket. netball etc. and sportsmen and women are encouraged to abide by those rules. Why must Dominicans not expect politicians, political parties and supporters to respect the laws as it pertains to elections? Why such behaviour and thinking? Whether you support one party or the next, wrong is wrong. No one should be allowed to do as he/she pleases. When a leader of a political party in Dominica, the DLP, forcefully exclaims that no law or constitution could prevent him from being nominated to contest election, whether eligible or not, tell yourself that the country has changed gear to a creeping dictatorship mode. No dog bark. Let everybody do what he or she wants anytime and/or every time and you all will see where our country will be heading.

    Tony and Tony alone, not the poor people of Dominica, who will be counting the $$$$$$$ after all is said and done. Ask the hard-workinglaw breached farmers who are facing problem after problem while a few enrich themselves.

    What’s amazing is that before the election Mr. Green and members of his party said that the DLP was going to pay people’s tickets to come down to vote; there were people on Q95 calling out flight numbers as confirmation that they knew all about it. After the election Mr. Green said over 300 people were brought down to vote then he said it was 4000. Mr. Green said and I quote, “they had buses with police escort drive up to the runway pick people up and take them to the polls”. Now this is where things get retarded. UWP supporters need to ask themselves and Mr. Green how did 4000 people get to DA on election day and leave the next day? American eagle holds about 50 people and there are only 2 flights a day for the most . Ok so lets say they hired planes that hold about 100 people, it would still take 40 planes with a 100 people to get that much people to DA. Now, that much people and planes landing in DA at one time would never go unnoticed in Marigot, a UWP strong hold, especially when people on Q95 and leaders of the UWP said that they were coming. So why oh why are there no photos or videos of this? Why did the leaders of the UWP not send out some one to ducument this so they can show the courts and the world? You don’t even need a camera, most cell phones take photos and videos. Q95 is filled with investigative journalist, yet none of them went to investigate and take pictures or videos why? why? why? I guess they did not believe their own lies!! You can’t take hearsay, rumors, innuendos and un-proven allegations to court!!

    Skerrit is the man’s client. What do you expect him to say? If he was my attorney and he is being paid big $$$$$$ I would expect him to attempt to try the case in the court of public opinion as well. This is grand standing folks by Tony. Jamaica and Antigua’s courts have spoken—We are waiting for Dominica’s courts to speak. In the meantime expect to see and hear more of Mr. Astapan in the print, tv and electronic media as he drums up support for his weak case from Skerrit’s base.

    I would not sleep easy if I were the PM. But one thing he has going for him is an excellent attorney. But I am afraid the PM is in real trouble and we wil have to wait until the court of law’s–(not public opinion ) verdict is in. I don’t want to bet on which way the court will rule but I know that it wil be nail biting time when the court games begin.

    Never a dull political moment in our small island.
