Green accuses prime minister of disregarding constitution

Opposition United Workers Party Leader Ron Green has cried foul on Prime Minister Roosevelt Skerrit for what he dubs a “casual, flippant, and dangerous” attitude towards Dominica’s laws.

In a statement released today,  Green criticized the prime minister for his appointment of a commissioner and deputy commissioner of police without consultation with the opposition.

“Roosevelt Skeritt’s casual, flippant and dangerous attitude regarding the laws of Dominica can only serve to put Dominica into further disrepute, and plunge our country into chaos and social unrest,” the press release stated.

Citing Section 66 (4) of Dominica’s constitution which states that there is a Leader of the Opposition until the holding of the first parliament after the General Elections, Green accused the prime minister of proceeding with ‘business as usual’ when all was not right with the results of the December 18 elections.

“While Mr. Skeritt intends to proceed with business as usual, Dominicans, the people of the Caribbean and beyond, are aware of the fraudulent, unfair and unlawful poll, the Election Petitions in the Court, the Boycott of Parliament, the formation of the Movement to Restore Democracy, and the outrage and disgust in many corners of the Country,” Green asserted.

“The UWP warns that this flagrant and deliberate disregard of the Constitution by Mr. Skeritt is a most serious threat to our Democracy, and a further slide towards dictatorship and a one-party state,” the UWP leader stated.

Following the Dominica Labour Party’s landslide victory at the December 18 poll, the opposition United Workers Party had announced that it would not sit in parliament in protest of the results and the manner in which the DLP conducted its campaign.

The UWP, along with other opposition forces, combined to form the Movement for Restoration of Democracy (MRD) which demanded fresh elections in 18 months. In the press statement released today, Green reiterated this call.

“The United Workers Party (UWP) renews its call for fresh elections within 18 months preceded by specified electoral reforms and assurances of adherence to the Laws against bribery in light of the fraudulent General Elections just held,” he stated.

    Ron Green, please get a life. You say you boycotting parliament, now you want Skerrit to consult you. Who appoint you as Opposition Leader? Not Dominicans for sure. Get some legal advise or I can offer it pro bono: The office of Leader of the Opposition shall become vacant-

    a) if he ceases to be a member of the House otherwise than by reason of a dissolution of Parliament;

    b) if, when the House first meets after a dissolution of Parliament, he is not then a member of the House.

    You are no longer an elected member of the House. Maybe a senator. You were not elected, so you can NEVER be the leader of the opposition. Be informed.

    Your party members that were elected failed to recognise the free and fair elections and have stated categorically that they will boycott the parliament. Do you expect the country to standstill and wait for when UWP ready to give the go ahead?

    It appears to me that you and your cronies want to hold the country hostage.You all decided not to have a part in the business of the country by boycotting parliament and now the country must wait for you and your boys. You are attempting to keep Dominica down, but no way. Skerrit smarter than you.

    Y.. remember, Labour Power is twenty times stronger than UWP. Your party lost more than 4000 votes and the other opposition parties did worse than you. So don’t try anything in 2010 because Labour Power will always stand behind their most Loving and popular Prime Minister.

    Wow, as reading every one comments i read one that states that we should all read the hole statement of Mr. Green, well i did and i understand that he thinks that he is trying to save ” Dominica Democracy” but it does not make much sense, if the constitution states that the Prime minister has to consult with the opposition about appointments, well he should have done so but the question that hunts me is where was the opposition? oh who is the opposition leader? if you guys have not yet established this how would the PM figure it out for you, is he suppose to drag you and your party to parliament when you decided right out of the elections that you are not attending? therefore its is his duty to consult with the President in order to go on with the business of the country, and as my menory recalls that exactly what he did, appointment of the commissioner and deputy is of critical safety to our country and while you and your party is ” fighting the Election Petitions in the Court, the Boycott of Parliament, the formation of the Movement to Restore Democracy”, the Prime minister will put country first and go on with its business.

    I only now see why this man won you guys in such a great victory wow!!.

    Mr. Green is no fool and ….seeking sympathy. Surely Mr. Green and his team of highly paid lawyers know just too well the term ” The Common Good”.

    Mr. Green and his infamous team understands what is meant by “the common good”. The government and by extension the Prime Minister have a responsibility to the Dominican people and not only to Mr. Green and the elected three opposition candidates.

    Dominica is a country of laws and “The Common Good” demands that the Prime Minister secure the Country by following the Constitution and appoint the Commissioner of Police and his Deputy. Shall the Prime Minister allow the country to go to the dogs as it were, by listening to the mischievious utterances of the opposition?

    Mr. Green and the UWP is mindful that 3 is not more than 18 and therefore must abide to the wishes of the people. If Mr. Green is so right, then he has another option by taking this issue of the Constitution to the Court and have the Judge decide on its constitutionality.

    Green and the UWP must stop the crying, respect the wishes of the people, it’s time to grow up.

    I really don’t understand why people can’t just say something is wrong when it is wrong. If the PM had to consult with the opposition and he did not IT IS WRONG. Because he won the election does not make it right. There is still an opposition until the first seating of the house.

    You need more than 2 party’s to have democracy in a country. The more the merrier. But people have to vote platforms and not colors and partys. In other words, they have to start thinking.

    The Leader of the Opposition MUST at all material times while holding that Office be an elected member of the House.

    Section 66(4) of the Dominica Constitution states- The Office of Leader of the Opposition shall become vacant-

    (a) if he ceases to be a member of the House otherwise than by reason of a dissolution of Parliament

    This means that even after the House is dissolved he still remains Leader of the Opposition. Had Mr Green won his seat, he would continue as Leader of the Opposition untill a successor is appointed or to the first sitting of Parliament when a new Leader of the Opposition appointed which ever is sooner.

    Since Mr. Green lost his seat during the election, he immediately vacate his Office as Leader of the Opposition. Had he won his seat, the President would have called on him to be sworn in as Leader of the Opposition and so appoint him by instrument.

    Mr Green’s Salary as an elected Parliamentarian would have ceased effective December 19, 2009 the day after the election. The same thing applies to any Minister who did not seek re-election and did not continue as a Minister in the new Government.

    Therefore, the Prime Minister is right by not consulting Mr. Ron Green on the acting appointment of the Senior Police Officers. The President who makes the appointments is very well placed to Know and understand the Law.

    I wonder which corner of which country that people are disgusted. Is Mr. Green referring to the very vocal minority in Dominica? Mr Green must make up his mind to move on with his life and stop being a “cry Baby”

    1. There shall be a Leader of the Opposition who shall be appointed by the President.

    2. Whenever there is occasion for the appointment of a Leader of the Opposition the President shall appoint the elected member of the House who appears to him most likely to command the support of a majority of the elected members of the House who do not support the Government: or, if no elected member of the House appears to him to command such support, the elected member of the House who appears to him to command the support of the largest single group of members of the House who do not support the Government:
    Provided that if a member of the House was elected at a general election in which he stood as a supporter of a political party and the majority of members of the House elected at that time (whether as Representatives or Senators) stood as supporters of that party, he shall, so long as he remains a member of the House by virtue of that election, not be eligible for appointment as Leader of the Opposition.

    3. If OCCASION ARISES to appoint a Leader of the Opposition during the period ” between a dissolution” of Parliament and the day on which the ensuing election of Representative is held, an appointment may be made as if Parliament had not been dissolved.

    4. The office of Leader of the Opposition shall become vacant-

    a) if he ceases to be a member of the House otherwise than by reason of a dissolution of Parliament;

    The pivotal issue here is not whether the UWP has boycotted Parliament. We should not be distracted by whether this move was right or wrong, wise or foolish. We should be concerned about whether it is lawful ACCORDING TO THE CONSTITUTION OF DOMINICA for the Prime Minister to make these top appointments without consultation with the opposition of the country. A wrong plus a wrong does not make a right.

    The Leader of Opposition under Dominica’s constitution has to be elected. Mr. ghreen whilst your arguments may seem plausible on the surface, thetruth is you are no longer an elected member of the house, hence you cannot continue to be the Leader of Opposition. We can argue that the constitution is silent on that matter and so desreves some attention.its arguable. So who then is the Leader of the Opposition in Dominica today? is it or rather can it be Ron Green? Certainly not. Is it Eddy, or Norry or Sprags? Any one of them can be….

    Again, who then is the leader of the Opposition you arereferring to Mr. Green?. You are not elected an elected member Mr. Green and so cannot be in the position. The people of La Plaine have spoken.

    It is your right to challenge the elections result in court. That you have done. So wait your day. Your election petition cannot delay the business of government. The state continue to fucntion whether you like being out of parliament or not until your petition is heard. After the couirt has ruled that the government is illegal, then you have a case. That is the rules. Why do you want to chnage the rules in mid stream. You public submissions that the government is ilegal cannot make the government illegal – simple as that. It is the court that has the power so to do mr. green. Not you or Sam Raphael or Wiltshire or Eddy. None of you. Wait your turn at the court.

    Talk abouit social unrest. Mr. green remember, Mr. Skerrit has six times your number in parliament. Your party lost 4000 plus votes in the last elections.The other entitiies in your coallition could not muster 1000 votes between them. So come on, Bring on the socialunrest. We will stand by Prime Minister Skerrit as we did on Decemb er 18th 2009. You will be surprised.

Whether you like or dislike or support Mr. Green or the PM, that is the debate that should be occurring here ‘civilized’ people of Dominica. I think Green has a point and if Sherrit wants to change that then let the courts expedite the case which the UWP brought up. The courts are part of the Democratic system and the laws of the land must be obeyed by all. Skerrit cannot have it both ways. Is he a French citizen or not????? And when did he get this citizenship????? Any one care to answer that question? Come on folks … taking out ‘Maprei’ and let’s have a spirited debate. Dominica requires that of you………….I appaud Ron for his leadership and my prayers are with him for strength for the sake of our country. My prayers are with our country for safe passage as well.

    Come on Ron, give up on this foolish waste of time – Dominica is moving on to the next level, with or without you! The people have chosen their leader (Hon Rosevelt Skerrit) and their party (Dominica Labour Party) and you will have to wait another five years. Even then it is doubtful that Dominicans will want a lazy, tired and old Prime Minister who is void of ideas and can only cry and complain.

    It appears that whenever Mr. Green “surfaces” it is to accuse the Prime Minister of something. Doesn’t he have anything else to do? Is he the self appointed critic of the PM?

    While Mr. Green have every right, like any of us, to criticize the PM, I think in his capacity he should be more constructive than criticizing the PM all the time.

    When I saw the headline of the story, my first reaction was “oh no, here he goes again.”

    Is Mr Green speaking as leader of the opposition? If i recall, mr Green did not win his seat so he cannot speak as leader of the opposition. The UWP should get their act together and appoint a leader from their three elected members, Stop this nonsense of boycotting parliament and exercise their constitutional duties of representing the people who elected them.
    The Prime minister is exercising his constitutional responsibility by appointing the commissioner and deputy commissioner. Mr Green should realise that country comes before party politics. Did he expect the PM to sit with his arms folded while they ponder on whether to participate or not. The fact that the elected members from the opposition chose to be absent when they should have been in parliament to participate in the appointment process should not be blamed on the PM. The country cannot remain at a ‘stand still’ while the opposition members behave like morons. The PM has the support of the majority who elected him to run the affairs of the country, if the opposition decide not to play their part they should step aside and allow people who are interested in moving the country forward to take on those roles.

    What is wrong with mr Green? Is he the leader of the Opposition? If my memory serves me right he did not win his seat. Mr Green as you a US Citizen? What are you crying foul about? You turn yourself and Dominica into a laughing stock, what else do you want to do? Dominicans are not foolish , we voted in a Decembe 18th 2009 elections, which was FREE and FAIR as was emphasized by the observers. You want dominicas to fight againts each other but this will not happen because we are reading between the lines. Just to say if we were to give you 2 seats, The Labour Party would still win a landslide victory, so Mr Green what is the force? Count your losses and move on. Labour has won and theat is the fact, accept it.

    How long will it take Mr. Green to realized that the Dominican people has clearly spoken and that its time to move on in a united manner in working together with the government elected towards addressing the economical, educational, health, social……..needs of the people? His political quest most be realized to be futile and without merit. Ron “Please put your political cold war to rest and be an asset to Dominicans by working together with fellow leaders. There is more you can gain by acceptance and allegiance than your continued political ignorance. I know that you are much smarter than that”.

    Ron Green, u think the people of Dominica and the Prime minister of Dominica, will stay there and waiste time with .. u. Sir there’s work to be done in this country and we have no time to step down to this low gutter politics u and the rest of this lazy men of your party wants us to be part of. ……u cannot and will not be the leader of the opposition. And wen u saying d/cans know, …? who dominicans? Mr. Green your party was heavily defeated at the last election, 18-3, so who are the dominicans u talking about, that concerned about the results. Mr. Green get over the defeat, there is work to be done in this country, and trust me we wont be waisting time with u and the lazy, uwp or freedom party or the new party, all u form after the election.
