Green calls for public support to see appeal through

Ron Green (left) chats with UWP Deputy Leader Hector John during delegate's conference on Sunday

The United Workers Party’s Ron Green used his final official speech as political leader of the UWP on Sunday to call for public support for an appeal which he and fellow petitioner Maynard Joseph intend to bring against a recent court ruling.

In a 49-page judgement delivered on January 10, High Court Judge Gertel Thom, dismissed the election petition  against Prime Minister Roosevelt Skerrit and La Plaine representative and Education Minister, Peter St Jean.

At the 22nd Delegates Conference of the UWP at La Plaine on Sunday, where Green “passed the leadership  baton” to former prime minister Edison James, Green  said that the most immediate task of the newly elected UWP executive would be to go forth with the appeal, a fight he considers a national issue.

“We are not happy with it. Our lawyers are not happy with it.  Our people are not happy and are dissatisfied because they do not approve,” he said of the judgement.

Green is convinced that not appealing the case would  mean, “giving up on our country, giving up on justice in our court system, giving up on our constitution, giving up on achieving truth”.

“We are not prepared to let our children down, to say to them that lies are okay. So we, yours truly, and Maynard Joseph will appeal on behalf of our children. So I join with my colleagues Maynard Joseph, (and call) on all Dominicans to own this appeal. It is for you, it is yours. The resources required to see it through is, for all of us in good conscience, to raise,” he stated.

Green served as UWP leader for the last three years.

If UWP cocksure they going to win on Appeal, they can come and get a loan from me.
Ron, Eddo, etc can use their land or other unencumbered asset as security. no bull.
But don’t beg people who they say are poor and stupid for their pennies.

If UWP confident they will win, they should go for it because a win in court would improve their chances tremendously in the next election.

The appeal would be for the protection of the Law and Constitution of Dominica. If Dominicans are to stupid to realise the constitutional importance of the case, If I were UWP I would leave them in their toilet pit and not spend possible campaign funds to appeal.

We have been tole – It is not what you know, it is what you can prove in court. We see it all the time with murderers walking free.

But even I have to admit that, in the end, everyone has rights and so we cannot ask someone to go against their own defense. The same way you cannot force someone to confess to a murder. So I believe we should give it a rest.

Still I have to ask. Why it is so important to remove Skerrit because of his French citizenship but it was never important to remove Ron? Let’s say we didn’t know this was wrong before. The fact is, we know now. To vilify one but not the other shows a level of selective reasoning that I cannot condone. This is not like Saul and the Christians. This is not like a sober alcoholic. There’s no point in saying that two wrongs don’t make a right. That line is just an excuse, a different way of saying don’t do it, let I do it. Ron Green really should take a back seat on this one. He has ZERO credibility in this case and cannot and should not be the voice of the UWP in this instance.

Well if the lawyers are so confident that they will win why not file the matter win and then wait for their money, the people by then will surely put money. It have cases so, especially accidents where they waiting on the insurance to pay because their cut is included. We must understand that a country is not governed on radio, tv and internet as we doing here yet still so many just believe what they hear. I believe the UWP should give up this appeal instead of wasting people money. If they asking for money it should be to organize themselves and run a serious campaign to win the next general election.

All they Do is Politics, the public Don’t want part of this, The Public Elected Skerrit as PM. Next 5 Yrs it might change based on his performance, But these guys are just always in the news like they are doing something. Taking up the court time, wasting their moneys, where do they even get this money, they ain’t got no Job.
And to be honest, If the court rules in Favour of UWP, They still won’t make it to office, UWP is not what Dominicans want right now.
It’s like this, if Eddie would go interview for a job, would you hire him? likewise for skerrit?
i would hire Skerrit, He look more hirable.

You know what really is amazing? The othernight when certain “intellectuals” were having their radio program on their “transistor frequency” with their “Can you hear me now?…. hello?” talk….The newly crowned mouth peice of the UWP called in and asked a question that was so timely…..He asked and I quote “Gentlemen will you in the diaspora be willing to Contribute financially to the appeal should the opposition decide to Appeal the case?” And the so called diplomat, Whom for argument sake we shall refer to as “sour grapes”, instead of answering the man with some direct forthright answer……..decided to not respond and cowardly said and I quote again ” I want to go back to Justice so and so here with this question…….Totaql brush off to this day never answer de question…I just shake my head because all that did….was confirm to me that these “talkers” are not serious about helping dominica at all…..and in my humble view….If they are unprepared to put up and help fight “the cause” then they should shut up…..plain and simple….Boy I would love for them to explain that one for me…..

I heard this same exchange ans was relly surprised that the “patriots” did not even dare to take the undertaking of raising/contributing to the collecting of money for the appeal..most of these people are well-educated and are well-off in the diaspora, they are well-connected, so raising funds should not be a problem(?)..I waiting to see who will stand and be counted. Dominicansat home are unable to bear this heavy UWP burden, I hope Eddo donate some of the new court money, and Linton brothers sell some assets..I waiting to see who can walk the talk…

My conscience is crystal clear. Appeal if you want, but you shouldn’t expect the people of Dominica to help you raise the funds required. Surely you guys should have checked your bank balance before the case started and made plans to cover an appeal.

Ron, You know that integrity that you all always talk about, please show some. Such hypocrisy!

  31. January 16, 2012

Ron Green, I suspect the time has come for you to simply remain quiet, you have given it your best shot and lost.

An incompetent you are; and so are the attorneys who represented you, they blundered before the deliberations began, and during the trial.

With all that we hear on Radio, and read in certain forum where some of your supporters indicated a conflict of interest in the matter where you claimed that the judge hearing the case was a ” friend of Tony Astaphan in-law’s in Antigua” was enough grounds for them to file a motion demanding that Thom recuse herself from the case.

If for any reason you believe the judge had any personal, or special relationship with Tony Astaphan, it was your responsibility to demand that due to some form of conflict of interest she recuse herself (disqualify) from the case.

You cannot cry foul now when it is your fault!

Your lawyer blundered, when he did not make that request!

In this case that constitutes malpractice of law, thus you should now sue your lawyer for malpractice.

You did not have a lawyer who knows how to practice law, in my opinion you may have been dealing with an incompetent bush lawyer, who seem more incompetent than you.

If your argument is going to be ” well she refused to allow certain evidence into the case, I do not know how you are going to overcome that because your attorney should have seen to it that every relevant piece of evidence you had at the time in hand be included in the case.

The fact is; you could not substantiate your allegations that Skerrit, and Petter had documents in their possession proving that they held dual citizenship, you had no actual proof of any such documentation.

You hope that the defendants would testify to this fact that they broke the law, even if they had you and your lawyer had to prove that to the court, and them providing you with that evidence.

Ignorance of the law is not an excuse, that is why you retained an attorney, and if he failed you; deal with him, however, an accuse is not obligated to testify against themselves in a court of law.

An accuse is not obligated by law to produce evidence that will incriminate themselves in a court of law.

You are the plaintiff, thus you have the burden of proof, which you the plaintiff failed to produce, so I suggest you will loose the appeal, you might save you money, since you do need it.

This money could be better utilized to assist DA’s unemployed, senior citizens, the poor and disabled of all. Do not be vindictive and do not encourage it. As God looks on, they as you will get nowhere. Cease supporting evil and people who have evil in their hearts. Sensible Dominicans know what their agenda is all about and what they are striving for.
Do not think that God is blind, deaf and sleeping to their thoughts, words and deeds.
Take note of these words of advice as stated. You should have kept your 500 of whatever to yourself. Surely, you need them and at least some members of your family. Give to where the money is mostly needed to help the less unfortunate. God will immensely bless and grace you, if done with loving and humble heart.
You should know that God is not a God of evil, of unloving ways and lack of peace. He is not tolerant of those who possess them and will obviously never exonerate them from always doing good.

Ron Green has no moral authority to pursue the matter personally since by his own admission in the High Court and speaking under oath he admitted to being a citizen of the US as a result of his own action. At that time he was under allegiance and obedience to a foreign power. When he served as Minister of government between 1995-2000 and even acted as Prime Minister, he was a US citizen under obligation to the US. Mr. James admitted under oath as well that he knew Ron Green was a US citizen, but he always considered hime Dominican. How then can he Ron and Edison) now seek to persecute somebody else whom they claim was in the same position like Ron Green back then in November/December 2009? Politics do make strange bed-fellows

New Yorker, I know that everyone has a right to appeal but how do you suppose they have a strong case when they were not able to produce evidence that the respondents( PM and St Jean) gave allegiance to another country? And how are they going to prove that the respondents under their own volition applied for citizenship to the other country? Maybe you should represent them at their appeal if you think that they have a strong case. And for your information I am colour-blind and not color selective or color biased as you seem to be. I am a Dominican who is neither Red, nor Blue nor Green. Unfortunately the only colour that seem not to be on the Dominican flags is Blue but on the American Flag which you give your homage to. There are limitations on appeal – anyone can’t just go ahead and appeal…. FYI …this is not a criminal case

“We are not happy with it. Our lawyers are not happy with it. Our people are not happy and are dissatisfied because they do not approve,” he said of the judgement”
This man has to be delusional for believing that the judge’s findings should have been made to make him and his “people” happy irrespective of the fact that they did not provide evidence or have credible witnesses.
“not prepared to say to our children lies are ok” Well this is exactly what UWP mandate is promoting: Lies and innuendos with hopes of garnering support to be view as a legit party.Pharaoh do I hear laughter? We are not amused!

You know what bothers me about the whole thing? Ron Green himself IS an illegal candidate. He was ILLEGAL for the whole time he represented LaPlaine in Parliament and he was ILLEGAL in 2009! Go ahead and appeal Mr. Ron, but you won’t get a black cent from me!

“Our lawyers not happy with it”????????? Ron please. Your lawyer is extremely happy. Lawyers are the ones benefiting the most from all this drama. Keep feeding them.

      @ Dominican

..And they are costly. They make a mint and get rich from defending their so-called clients. Surely Ron Green and his associates should know this and to leave well alone after the verdict.

:)IF THE TRUTH BE TOLD RON GREEN WOULD GO BY HIS FULL NAME .HE WOULD TELL US WHERE HE WAS BORN .HE WOULD TELL US THAT IS NO SUCH THING AS DUAL CITIZENSHIP IN THE USA .THE USA DOES NOT RECOGNISE DUAL CITIZENSHIP.IF THE TRUTH BE TOLD RON GREEN OR WHATEVER HIS FULL NAME IS WOULD ADMIT THAT HE IS STILL A CITIXEN OF THE USA AND WILL NOT CONTEST THE GENERAL ELECTION BECAUSE HE DOES NOT QUALIFY

      @ EMILE Zpatos

It is on the U.S.A. record that he is a U.S. citizen. The U.S. did not revoke his citizenship. He was not a criminal in the U.S. and he was not deported. He voluntarily left the U.S.A.
If he wishes to return to the U.S.A. or at the end of his political career in DA, all he has to do is to re-apply if he formally gave up his U.S. citizenship.
He will have to prepare and submit a certain type of document and provide the reason why he (supposedly) renounced his citizenship.
Ron Green thinks he can deceive DA Nationals. Dominican nationals smarten up!

@EMILE Zpatos – Sorry but part of your statement is incorrect.

See excerpt from State Department Website – “A U.S. citizen may acquire foreign citizenship by marriage, or a person naturalized as a U.S. citizen may not lose the citizenship of the country of birth.U.S. law does not mention dual nationality or require a person to choose one citizenship or another. Also, a person who is automatically granted another citizenship does not risk losing U.S. citizenship. However, a person who acquires a foreign citizenship by applying for it may lose U.S. citizenship. In order to lose U.S. citizenship, the law requires that the person must apply for the foreign citizenship voluntarily, by free choice, and with the intention to give up U.S. citizenship.”

I agree, that if you are not please with a court decision, that you should appeal it as long as you have the legal grounds to do so – error or law etc….

however – i hate hypocrisy, as in this statement “We are not prepared to let our children down, to say to them that lies are okay”…what message was Ron Green and UWP sending to the children before?

It;s ok to lie once you are not caught?

smh at the audacity and gall of this man. It would have sounded better coming from someone else, not a PROVEN LIAR

The best thing is to used the money for Next election. Appeal do not make sense cause if DLP looses they will have a Bi-election or it will be close to general election anyway.

An appeal is a waste of time if a guilty verdict does not garantee that skerrit be banned from running for office permanently
