Injustice says Green

Sad, alarming and painful are just some of the words one United Workers Party (UWP) petitioner has used to describe a decision by the Eastern Caribbean Supreme Court to dismiss an appeal in a matter involving Prime Minister Roosevelt Skerrit and Education Minister Petter Saint Jean.

The decision was handed down by Her Lordship the Honourable, Janice Pereira, on the general basis that the UWP petitioners did not provide sufficient evidence of the existence of French passports, which Skerrit and Saint Jean allegedly held.

However, Ron Green says the decision reeks of injustice.

“I want to compliment Prime Minister Roosevelt Skerrit on his ability and success in hiding the truth from the court. We go to the court for justice. Justice depends on trust and when you hide the truth, it means injustice. This seems to be one of the major weaknesses of our court system,” he said.

“Everybody, in and out of Dominica, knows the truth, but con men, tricksters, lawyers, leaders specialize in keeping the truth hidden from the curt and also from our people,” Green said.

He said the UWP will now move “to educate the people on the truth.”

“Three years and three months short a week, is what we have spent at an incredible high court and the appeal court is saying that the direct evidence in the hands of Skerrit and Saint Jean was not put into the court”, Green lamented.

According to Green, the issue of dual allegiance was only one of the matters deemed unfair in the 2009 general elections.

    I am not reading the comment nor the posts. I would like to ask RON GREEN, what is the difference from Skerrit holding a French passport and himself, Ron Greene holding an American passport? Why is it okay for Ron Green to run for office, regardless to how old he was when he became a United States Citizen, and it is not okay for Roosevelt Skerrit?

    Ron Green, collect your social security benefits, if any, from the United States, leave Skerrit along.

    Allow the VOTERS voice to be heard.

    It is indeed a sad day for all of us when even the Appeals Court, the custodian and safeguard of our freedoms and liberties, has turned its back on truth and relied on a comedy of errors made by a lower Court; on its unwillingness to correct that lower Court and what appears to be a desire to sit well with the ruling thugs. It is a fact that Skerrit and Saint Jean both held French pasports. A letter from Skerrit to the French authorities and published in the media clearly amounts to evidence that he held french citizenship and a passport. Skerrit himself admitted to obtaining French citizenship as a result of his mother and not of his own doing. Even if the lower judge did not compel Skerrit to reveal his passport to the Court, there still is an abundance of evidence that Skerrit was French. For the Appeal Court to now say that the petitioners did not show sufficient evidence, when evidence would probably have been sufficient if the passport was revealed, is a mokery and amounts to nonsense. It is now a fact that our Court system is unwilling to give a fair hearing to any complaint against the DLP. My fear is that this continuing behaviour by the Court may well breed civil discontent which may lead to a bypassing of litigation and a return to lawlessness.

    mr green it seems is skerrit that tell you to go an denounce your american citizenship? he can still go to guada or france, because he is still the prime minister, but on your side you have to apply again for a visa to enter America. who is the loser now. never dig pit for your brother, you will end up falling in it. it was alright when you went up from 95-2000 and 2005-2009, there was no problem, but because you lost you sit, you remember you have dual citizen. if you obtain it from you mom, so did mr skerrit. you lived in america, skerrit live and grow up in vielle case so how he become a french man, with french dual, and you remain a dominican with american dual. that is not adding up at all. anyway it is over and you just have to apply again for your american passport.

    It was Labour, then it was Freedom, then UWP, then labour/Freedom and then labor again. What next then? Those who are happy today will be sad tomorrow and those who are sad today will be happy tomorrow.

    I cannot recall a moment in history when the UWPwee was gracious in defeat. This is no model for aspiring leaders. How can Sen. Green speak of “injustice” when the very document on which he seems to claim justice, the Constitution, does NOT support his case of trial and condemnation in the absence of proof of a crime?! What kind of justice does Sen. Green support then? Where does his understanding of justice originate?

    In reality, all sides can claim victory on this matter. The PM and Hon, St. Jean, for obvious reasons; the people of Dominica, for the fact that the Constitution has been upheld; and the UWPwee, for its steadfastness. Now, do not misinterpret me, steadfastness is not necessarily a good thing, but I think we must applaud the UWPwee for adding voice to a regional debate on dual citizenship.

    Nevertheless, I still do not understand why they pursued the case to this level even in the absence of proof that could stand up in court. I remain astounded by this decision. You cannot accuse me of an offence and then ask me to prove that I have indeed committed that offence. Ludicrous! The onus is on you to prove your case. So, how can Sen. Green now accuse anyone of “hiding” truth? Frankly, if anyone deserves this title is the UWPwee, for hiding the evidence of the infringement of which they accused the PM and Hon St. Jean. Any lay man could have advised the UWPwee that its case was doomed from the start because it had no evidence to hold in the court.

    It may very well be able in the court of public opinion to spin all sorts of tales and summon all categories of speakers to publicly claim that the PM and his minister were illegally elected. Yet, modern democracies are not built on street talk but on the rule of law. Unfortunately, for the UWPwee, it has failed, again, to grasp this very basic facet of our democracy.

    Now that the case is closed, let us all join hands tonight and celebrate. We have all won, something. (Of course, the colour code for tonight’s function is red. Then again, we all have red flowing through us.)

    Ron, by now perhaps you heard; “what goes around comes around” I call that the “the Boomerang effect!”

    What is a boomerang?

    It’s a toy; nevertheless; no matter in which direction we throw it, and how far; the boomerang always return to its place of origin.

    And you should know that is back into our faces.

    I mean there is no need for you to dwell on this thing when you probably knew you and your colleague had zero chances of winning your case. In a court of law even in the kangaroo courts of Dominica, and some parts of the Caribbean, cases are debated based on the physical evidence presented.

    Your case had absolutely no merit from the word go, because you fail to meet your burden of proof!

    You hope that political rhetoric, and the empathy, and the sympathy of the court would help you through, well that would be some biasness on the part of the court. Your lawyers screwed you; you see, they took your money knowing that you had no case from the beginning, they should have told you that without the physical; the solid passports of the two defendants Skerrit and Petter, presented in evidence, your alternative was to simply withdraw your petition.

    The only way you and company could have won your case was if Petter, and Roosevelt decided to stab themselves in their back, and walk into the court and admit to your allegations: in other words becoming a witness against themselves. Now if in the Common Law System, a wife cannot testify against her husband under normal circumstances in a court of law, I do not see how the defendants could have become your witness against themselves, except if the went in and simply pleaded guilty.

    On the other side of the equation I do not understand why you took these people to court for an alleged offence which you have also committed, assuming that Roosevelt, and Petter violated the nation constitution by serving in office whilst they have sworn allegiance to a foreign, and a none Commonwealth nation.

    You Ron have done precisely the same thing, because all the years you served in the Edison James administration, you were a citizen of the United States, which is not a member of the British Commonwealth of Nations. What is good for the goose Ron is also good for the gander!

    You know you broke the laws of our country, that is why prior to the last general election when you thought you had a chance of becoming Prime Minister, you ran to the American Embassy in Barbados where you denounced your American citizenship.

    You would be better off if you simply left it alone, because you would still maintain your American status, by which you could have collected your social security benefits, if you worked for ten years here and contributed to the system, now I doubt you can get anything since you are no longer a citizen of the country.

    Stop crying over spilt milk man and go on with your life, leave the politics to a younger generation; let Skerrit defeat come at the poles and through the ballots; do not try to take the man’s crown by force and in a court of law. Right this day he seems unbeatable, I do not know for tomorrow!

    You speak of injustice, I see no injustice, I simply see a lack of evidence which you failed to produce.

    So many of you labourites can admit it seems, that you know Skerrit is guilty but there was not sufficient evidence to prove it in a court of law. Yet, you are cheering victory. You are cheering that your party got away with it. Got away with deliberately and willfully breaking the constitution. So that makes all of you just as dishonest as Skerrit. Go cheer that and pray it away in your church.

    While I appreciate that Ron is hurt and wounded by this defeat and may be grasping at straws now, I`m still disappointed in that statement. As a former member of Government, current member of Opposition and essentially a law maker, he should know that justice has nothing to do with truth. Justice is about what you can prove! Unfortunately, this is not the same as truth, because if it was then there`d be no need for lawyers. The fact of the matter remains that there was insufficient evidence presented to prove the Opposition`s case….simple!

    Ron and the crew should take heed. We`re closer to a new election than we are to the last one and they should focus their energy on increasing their votes in the new election!

      I guess nurse James got justice because truth was hidden from the court. As a human being of supposed morality what is important to you . Forget about the courts. Are you prepared to tell your kids that Petta and SKERRIT are honorable men and that they stand for truth. Are you prepared to tell your kids that truth does not matter as long as you can get away with a crime.
      This is beyond politics my friend. We can go around in circles and argue for or against the courts decision but the end of it all we all have a solemn responsibility and that is to uphold morality in our society, communities, families , churches. This is beyond party line, beyond religion. If we implore honesty from our children why must we cheer on is honesty and criminal behavior from politicians.
      God I hope that the thumbs down that I will receive will not come from those who profess god fearing disposition; I also hope that the thumbs down will not come from people who earnestly want their children, nieces, nephews, grand children , godchild to be law abiding and to not think that it is ok or is entitled to wrong doing as long as he or she can get away.
      While there is a call to put the matter behind and move on we must carefully examine what it is left in our backyards.
      When the soviet union pulled out of Afganisan the world was happy; The land mines left behind is what took the lives of many innocent Afghan children. So when we believe that we have moved on with the matter be sure that the land mines left behind will torment our society for as long as we won’t clean up the mess.

        Was it justice and morally right when Mr Green held office as an American citizen. we keep crying for justice when it suits us. Based on what you have said Mr Green cannot be perceived as honourable because for years he has been in the same position 1and it was fine because he could get away with it. why didn’t he bring forth those arguments when he was a minister? I guess back then moral standards were different. whilst I agree that there are issues that needs to be addressed please stop crying about justice and morals. they are al guilty of the same offence so he has no moral legs to stand on. You cannot say that he did not know that. their approach to the case and their demands said it all. In the prime ministers case they wanted the loosing candidate to replace the candidate to replace him but in la plaine they were calling for fresh elections. The question is why? it is simply because he knew he was just as guilty of the crime he was accusing his opponent of. how is that morally right and honourable. now please explain to me in which justice system i1s one forced to give evidence if they are accused. I’m guessing only in communist countries. are you saying that we should emulate justice systems where persons are forced to give evidence against themselves. If such precedence was set in this case then it would open up a huge can of worms because prosecutors and plaintiffs in every other case could force defendants to testify under oath. one da1y you could face the courts and your lawyers would have no say in whether you give evidence but the prosecution would. when you face the court you are given three options. 1. you may give evi1dence under oath which can be used in deliberations. 2. you can give an unsworn statement which does not have much weight or 3. you may choose to remain silent. The choice made is dependent on your discussions with your attorney. There is only one exception where the burden of proof lies with the defendant and that is in cases of financing of terrorism and money laundering and we have 9/11 to thank for that. so please tell me what land mine would you want to leave behind? It seems like no law no constit1ution will prevent either side from attempting to achieve what they desire.
        We need to stop letting politicians play games with us! They are all the same. at the end of the day it is all about being in power and enjoying the benefits associated with it.

      a. is by virtue of his own act, under any acknowledgement of allegiance, obedience or adherence to a foreign power or state;

      Ron left Dominica at age 11 and became a US citizen, not by his own act. So, to this day he could still be a citizen of the US and run for office in DA.

Because I was at Court in September 2011 when in Judge Gretel Thom presence, Mendes declared (to the shock of many present) that La Plaine would have to have a re-election because Mr. Green was as unqualified as Mr. St. Jean since he had not done the necessary paper work to renounce his US citizenship in time for the election. So, who is the ‘dumbo’ now?

        Grammar Cop must have been asleep in Court. The issue is holding and using a Passport not only Citizenship (if held as a result of parents)— and for those who wish to know it was a Courtcase settled in Jamaica in March 2009 that determined this. So before March 2009 there was no morality failure, deception or illegality to serve if your Citizenship was not of your own hand. Now that the Case has ended are we satisfied Leaders who boast moral weaknesses, deception and illegality proved or not in the Courts?

    heard Mr James on Q95 this morning going on and on,i want him to remember it was not aDominica court who rule it was not even a labour court .it was ECCJ. What were they suppose to do tell the court,UWP will not agree so we can’t accept the ruling. It was thrown out now for the second time for lack of evidence, that’s it.You guys did not do all you homework,go back to the classroom and come again

Isn’t it the same Ron Green that only denounced his US citizenship before the last general elections. How is it any different? Poor guy.     On August 4th 1857, West Indian Emancipation Day, in Frederick Douglas’ speech, he said, “Find out just what any people will submit to, and you have found the exact measure of injustice and wrong which will be imposed upon them, and these will continue until they are resisted with either words or blows, or both”. West Indians, this is quite prophetic for the people who feel it in 2013 eh.

    I believe one of the maxims of laws says its not what one knows but what one can prove. Also as a matter of law, their is a difference in the terms proof and evidence.

    The Court of Appeal was unanimous in its decision.There can be no further appeal in this matter.This is the Rule of Law and the law of the Constitution of Dominica.But,nevertheless, are there other legal authorities and learning from other common law jurisdictions that could persuade us that our appellate Court was wrong?Should this not be the focus of those who hold that the ECSC Court of Appeal is wrong.Or should we just lambaste the Court and its decisions here on on the dominant Talk Show?

    Grave injustice by the Appeals Court. Is this a reflection of the CCJ? I was of the view that the CCJ should become our final apellate court, but now I am totally against it.

If you taking me to court you have to come with all your evidence. Don’t say I owing you and take me to court with nothing to show for it and expect me to bring the promissory note.

    the sad thing is d/cans are going to celebrate tonight, yet PWC can’t get paid and yet, they’ll go and eat, drink and be merry… and hail to a ‘king’… who have none of their interests at heart… while reading a social media post… a young man hinted that dominica is a democratic country (where free will and freedom of speech lives) but it is a sovereign republic… and hinted to our national anthem which says pledge allegiance to the sovereign republic for which it stands… and every republic has a ‘king’… interesting!!! so skerro has all right to act as a royal highness because our system of gov’t supports it… we aren’t answerable to England but to king skerro or any p.m at the time… interesting again…

    Is this the same Ron Green who held dual allegiance for several elections? Is this Ron Green who is talking about Dual allegiance being UNFAIR in the 2009 elections, the same Ron Green who was part of the UWP when they won elections to remove the Freedom Party government in 1995?

    My people, several posters here keep saying that two wrongs don’t make a right. Well, I have my own point of view here. Ron Green and and others before and after him set the precedent that dual allegiance is acceptable (even though it is in the constitution). It was acceptable for years before Skerrit. What was so special about the 2009 elections that made it unfair? The 18-3 victory? Would it have been unfair if the margin was lower as what happened in the previous elections?

    Honestly, I fail to understand why Ron of all people, is even commenting on this issue, an issue in which he himself had benefited from the precedence on a number of occasions.

    I am not DLP nor UWP. Elections coming up soon. Both sides need to establish more credibility in my eyes, but on this issue, UWP has no credibility. Pick another issue to bring to our attention and I will listen.

    Mr. Green should be the last person making comment on this issue when he served the La Plaine constituency for years with dual citizenship. Mr. Green is it because the affiliation is French and not the USA? What is good for the goose is good for the gander. It’s over, move on!
