UPDATE: Lennox Linton served with court papers

Linton said he is not afraid or intimidated
Linton said he is not afraid or intimidated

Leader of the United Workers Party, Lennox Linton, has been served with legal papers in a matter involving utterances he made at a UWP youth rally recently.

Linton told privately-owned Q95 on Friday morning that two police officers visited his home on Thursday at around 6:30 pm to deliver the statement of claims of 18 ministers who are suing him for defamation.

According to Linton the statements were filed in the court on June 18, 2014.

He said the claims are seeking damages for slander.

The matter goes back to the UWP’s “Youth In IT Too” rally recently St Joseph during which Linton referred to alleged activities by ministers as rape and noted that there is no honor in a government that harbors them.

“There can be no honor in a government that harbors rapist ministers and upholds extortion of sexual services from young people seeking the facilitation of ministers to get personal development assistance from the public purse,” he said at the rally.

Among the claimants are prime minister, Roosevelt Skerrit, attorney general, Levi Peter and all members of cabinet.

“I am in consultation with my attorneys and we will begin the preparation of our defence very soon,” Linton said.

He described the matter as “serious” and a “national event.”

“This is a matter that allows the people of Dominica to understand who really has been serving them in governement for the past 14 years,” he stated. “Because elsewhere in the Caribbean for much less than what ministers of government in Dominica know they are guilty of, ministers of government have been fired from their jobs. All of that will come out in the court.”

He said all 18 claimants have to stand up in court “and say what they know about specific complaints that have been made against ministers of government in their conducts toward young ladies, more particularly, who has been seeking assistance from these ministers from the public purse.”

Linton said that he is not intimidated and is unafraid.

“I am ready to defend. I am ready to tell the court and the world what I know,” he said.

Mr. Linton should have known better before he goes running his mouth on a public platform in an effort to win cheap votes.
There are many questions Mr. Linton should have considered before making his public statement.
    1. Did any of these women report these rape allegations to the police?
    2. If so, did the police conduct an investigation into these allegations?
    3. What were the outcomes of these investigations. I.E. were any ministers or anyone prosecuted or cautioned relating to these alleged rape incidents?
    4. Was there any police forensic examination carried out on the alleged victims of rape?
    5. If so what were the results of the forensic examinations?
    6. Did the results match the DNA of the alleged accusers?
    7. Who are the alleged victims and accusers these rape allegations are referring too.
You cannot make serious allegations of that nature by accusing someone of such a serious act without having the physical evidence to back it up. This is highly irresponsible.
This whole matter boils down to “responsibilities and judgement”.

If the leader of the opposition who has high hopes and aspirations of becoming the next Prime Minister of Dominica can make such irresponsible and reckless comments about government ministers; then serious questions must be asked about his “judgement and responsibilities” if he was prime minister.
It seem to me that Mr. Linton’s comments were the actions of a desperate opposition politician who has now realised, that the only way his party could win the upcoming general election is to throw dirty mud, hoping that it will stick against the recipients the mud was thrown at. (refer to the old proverb/cliche: there is no smoke without fire)
This is dirty politics of the worst kind and let us hope that Mr. Linton and the UWP suffer the consequences for their actions.

This is petty and ridiculous. It is a common trend for politicians to sling mud at each other during campaigns; is this not the case especially in the Caribbean. C’mon…. These politician should disregard such pettiness and move on and focus on the things at hand to keep them in their seats and make Dominica a better place. This is a waste of government money to retain an attorney to represent the entire cabinet (and guess what, the hired attorney is smiling all the way to the bank) in such foolishness. How much does this attorney make at the end of such representation? The amount over and above to cover the expenses to completely renovate the Marigot Hospital. First village our investors and tourist are welcomed into once they touch down in our Blessed Green Dominica. Stop wasting time.

        June 30, 2014

You can disregard it if it will have no implications. But you cannot disregard it if it is meant to bring down a good name and trust. What the UWP has realized is that the Labour Party is the only party where ministers and the people interact frequently, which is very much appreciated by Dominicans and others alike. So to destroy that relationship and trust, they have to sling mud. GO LABOUR GO! AINT NOBODY STOPPING US!!!!

I agree with u that they throw stones at each other . but the time has come when persons must be held responsible for there actions and statements. you don’t keep accusing persons for things that you cant prove and someone must be made example of so that these things can end.
do you think that if someone breaks into your house and still your dvd player the court should say his a petit thief and let him go or should he pay for breaking into your home. well it all comes down to this if u can stand on a public podium and make such bold accusations then u must dance to the music u a playing

I’d rather see this matter played out in court. It is too important to ignore. Let the plaintiffs and the defendant state their case in the public arena. Actually, I am looking forward to our ministers being grilled. If that is not in the public interest no writ would have been issued by the Govt. lawyers, so let the games begin.

Parry, I would advise the Prime Minister, Ministers of Government and Tony Astaphan, like the saying does,” let sleeping dogs lie.” I would tell him, the bin and fertilizer boreball came and went, his Government is still powerful. The D.O.N. Emanuel matter would appear to be no serious threat to cause his Government to loose the next General Elections. All the talk about who owns the Villas, has not touched his popularity. The new leadership of the UWP and their plans of jobs, jobs and more jobs plus an International Airport appears to have no cause for concern, the last poll says it all. Therefore, why cause Dominicans and the world press to take interest in you for that kind of thing. If the case goes to court, certainly, you will be in the history books. Is that the legacy you want to leave for Demitry.

What is clear to me is the fact that the ruling party are very afraid of Mr Linton and will stoop to any length to hide the truth law suit after law suit instead of getting their own house in order.

The problem they have is that if they did there would not be enough candidtaes to fill the gaps, and could not risk by elections as they know full well they woulkd loose

  7. Let's think
    June 29, 2014

The sexual abuse of young people especially young women is an act that has been happening for years, it occurs at all levels of society and is not unique to Dominica. It is wrong and should stop.
It is shameful that critics of Mr. Linton position their arguments that gives the perception that he is speaking of a behaviour that does not happen. From that position they are alluding that the victims are lying. That someone who dared to stand up for them should be punished Instead of investigating those allegations .
What is the message we are sending to our young people?
That they are fair game for sexual abuse because no one will listen to their complaints. That no one will stand with and for them to right the wrong that is meted out to them.
That those with power will always be right in whatever their interpretations of right are.
That unless there is absolute 100% of physical evidence of sexual abuse that their cries and shame imposed upon them should be stifled. No counseling, No compensation, No protection from future abuse for those still innocent and unborn

That they are to be used as sex toys in exchange for the help they seek.

Our religious leaders make a big hue and cry about ‘passa passa’ and gay ships visiting Dominica but they remain silent when our DOMINICAN YOUNG PEOPLE are sexually abused by OUR DOMINICAN MEN!

Where is the match by the religious leaders to pray to rid our society from this sick behavior?

Did the Vatican have physical evidence for all the victims they are now compensating after the allegation of sexual abuse was made years after the abuse was carried out by the priests?

Is this the christian society we have become?
Is this what the gender affairs desk wants for our young people?
Is this what we parents will settle for?
Is this the justice we are willing to uphold for our young people who we know are victims?

Teachers, Nurses, Doctors, Youth Leaders ….. by our silence, are we by omission consenting to the continued abuse of our young people. They confide in us and we know they are sexually abused.

I appeal to the young people you have to protect yourself as you cannot depend on the society with the power to protect you.

NEVER go to an office alone. Have your parents, an adult or the secretary sit in on the meeting. If you have a recording device inform the person with whom you are having the meeting that you would like to record the meeting. If they have good intentions they will most likely agree. If they have something to hide they will disallow it.

NEVER go to the homes or in the vehicles of persons to contract business.

NEVER allow yourself to be fondled when you are seeking help. If you are approached inappropriately, scream and run out of the room to a place of safety. Report the incident immediately to someone you trust and then go to the police with that person to lodge a complaint.

I pray that we as a society will examine our conscience? political allegiance.

The future of our young people is NOW!
Let us as a society protect and keep them safe.

Sexual abuse of our young people is the betrayal of trust and abuse of power implicit in relations with these young people.

I am just getting to know about this matter of the suit. My brothers, my sisters. Liston! Please. This development is most serious. Can not be more serious than any other issue I have known about in my entire 63 years. How are we going to handle this? Can’t we all realise that this is going to embarass every man woman and child of our nation? What’s gone wrong with us all? I’d better be dead than to know this matter will proceed to the detriment of our country. Act now my friends and get this privately and quietly settled among yourselves. Don’t let the Devil wound us all. Act swiftly and abort this calamity. Thanks for so doing.

Integrity and respect begins with the leaders. Certain people tongues are too free, being in a leadership position what comes out your mouth means a lot to your followers. You cannot openly disrespect Dominican women by stating, “Dominican young women are prostituting themselves because of the labour party government”. You are disrespecting the young female populace in Dominica. That statement is reckless. Yes, Mr. Baptiste, and Linton, uttered these statement during their visit to the VI. How many of you men think it is OK for such ridiculous innuendoes to be mentioned overseas? That’s poor choice of words and recklessness. How many of you will allow a grandpa to call your granddaughters a HORE! You have to take responsibility at some time or another. By uttering these sentiments you are disrespecting the young women, true or not.

That a man who is presenting himself to be the future Prime Minister of Dominica could make such a mistake is, to use his favourite expression, “mind boggling”. I listened to Mr. Linton’s statements on the matter of this legal action and came away with the impression that he is not even aware of the action actually being taken against him. The evidence he has hinted at does come anywhere close to addressing the complaint. The accusation he made was of RAPE, which I expect is the only thing addressed by the action. The will be the ONLY concern of the court. He expects the Ministers to be required to take the witness stand. Well, as I understand it, the action is accusing Mr. Linton so it is Mr. Linton who will be required to take the witness stand. The man has not learned his lesson. Such poor judgement does not qualify one for the office of Prime Minister. Sorry!!!

    What Lennox Linton said?

Ministers of Government “prostitute our young women for public assistance from the purse.”

This seems a general statement to me… or I may be wrong, according to legal papers served on Mr Linton, the statement of claims of 18 Ministers who are suing him for defamation.

A simple word of advice to you Mr Linton!

If your general remark is interpreted negatively by D/can Cabinet Ministers then you need to call the UWP serving MPs and Senators for evidence in your defense.

Never in the history of Dominica that any Govt. is so haunted by the TRUTH. They resent the saying, “The truth shall set you free.” The Cabal will not let truth reign. Truth is a thorn in their side.

Remember what happened to Lawyer Emanuel and his wife? The attempt to kill them by firebombing their home? That horrible criminal act will continue to hunt those who will not follow truth.

It was because of Emanuel’s bravery, sincerity and honesty, as pertains to exposing fraud in the millions, that he was targeted. Who were those defending, protecting, the alleged culprit or culprits and twisting the truth, but unsympathetic to those innocent victims?

The truth revealed by Lennox again and again cannot be refuted. This time around again, his frank revelations have touched the nerves of those who cannot stomach the TRUTH.

Are we serious? There are no abuses of our women going on by some in authority? who all you fooling? but everybody know about those abuses.. It is real. It is TRUE.

The cabal really think they could intimidate, victimize and prevent Dominican patriots from expressing their concerns about immoral, illegal, unethical acts. We must SPEAK. The TRUTH we must Speak about at all times. We Fear no more. Truth is on our side. The world is against women abuse.

  23. June 27, 2014

@Mary June 27, 2014 “One thing I know , Tony nor Skerrit is in control, The Almighty is the one in control”

Normally I would not comment to this kind of news article—especially that today is Friday, most likely DNO will not print it before Sunday night or Monday; by then my message would be lost to the audience.

But your words above sounded very loud in my ears—I am repeating it for you: “One thing I know, Tony nor Skerrit is in control, The Almighty is the one in control”—these are your own words!

But is that not what our Prime Minister acknowledged, when he said: “I receive my guidance from above”, as he continued to give God the glory for being able make that contribution of money to his Church and on behalf of the rest of the congregation—who are the majority of Dominica\s people?

But all of you, who are against his leadership tried to ridicule his claim which was the same as you said it above—“God the Lord the Almighty is in control”!

So that tells me that you all do not know what you are supporting; but Mr. Skerrit knows what his work is about and by whose control, he is able to do that work.

This means that you people need to be careful of what you think, say, and do—at least we know that God—who is the Lord of heaven—His plan is a good plan; Mr. Skerrit knows that as well, and his declaration to the public, that he receives his guidance for above, means that his work will continue to be fruitful—only those who are blinded by negativity will not see that fruitfulness.

For there is also the god of the world who will cause people to create a calamity which will affect all those who are following with him; this god does not want peace and harmony for God’s chosen people.

However, come what may God will have victory, then so will His people—people of Dominica, I am asking you, whose side are you on?

Are on the side of the God of heaven? Or are you on the side of the god of this world, who wants nothing for you, but the pain of death both of the flesh and of the Spirit? Only you and you alone can answer this question for yourself

This is very serious for Lennox. And we all have our own opinions on what was said. But if Lennox knew of any woman or women who were sexually assaulted by a minister or ministers, he would have encouraged these people to sue this administration, instead he choose to talk about it in a public forum. Even if it is true or false, its an insult to the ministers who is currently in office. My concern is Lennox does not have the wisdom and tact to lead Dominica. If Lennox want to continue to chastise this administration, he would be better at it as journalist. Now lennox , you have short yourself in the foot as always, prove your case.

its clear the uwp didnt learn from the prime minister passport case….
where the courts ruled that u making the complaint had to show proof they held passports and couldnt force them to present the passports ?

and who is advising him is also very wrong….
no minister has to come and defend themselves for the simple reason, none of them have been charged, or convicted of any sexual offense…
so while ministers may be involved based on the law lennox is wrong, and will loose on those technicalities…..
cause in court is not what you know is what you can prove….

and the ministers dont have to prove they didnt do anything, and u cannot use a civil case to try prove that they did engage in any act….the civil court wont have jurisdiction….

its like asking the civil court to settle a traffic matter before the traffic matter is heard in traffic court…

where is the proof that they are engaged in this accusations ? the so called victims that never went took the matter to the police or to court ?
i mean really ? lets be honest here and put aside politics….
so if lennox comes with 100 women claiming to be abused the court is going side with him ?
what you should do is get ur victims to file criminal cases and see what happens……..
otherwise u going have to pay

People are making their love for party or party leader to govern their bias in this matter but this should not be. Let us look at this from the unbiased court’s perspective.

      1. Mr. Linton is taken to task for slander by all 18 Ministers of Government. Some comments are saying this is wickedness 18 against 1 or why would the female ministers be on the suit etc. Well the answer is Mr. Linton did NOT use the term alleged and stated categorically that the GOVT MINISTERS raped or upheld those who raped. this is slander against all the ministers male and female.

      2. Mr. Linton accused the ministers of rape. There is a difference between RAPE,, Sexual harrassment, adultery, consenting adults having sex. In the case of rape, there must be proof of forced intercourse. Is there a case file of any minister forcefully having intercourse with anyone? Are there medical records, eye witnesses who saw any minister forcefully have intercourse with anyone? So you see, it is possible that a minister could have continuously asked a woman for sex, it is possible that a minister had consenting sex outside of his marriage with another woman but these do not prove rape as defined by law.

In the court of law Mr. Linton, based on his allegations (no not allegations since he didnt say alleged…he made a definite slanderous statement), me Linton must prove with eye witness and medical records that a minister/s had sexual intercourse with a woman against her will. If he cannot do this then crappo smoke his pipe.

I have no doubt these women will have more balls (although they were born with non) than the men in Dominica to stand up in an effort to protect themselves against this atrocity by the know ministers using the tax payers dollars to lure them.

Can they not speak up for themselves? Should such occur to them, why did they not speak up and immediately object to their approach? The perpetrator(s) could not deprive them of their badly needed funds.
If someone spoke to them harshly or told them off they would have a voice to retaliate and in no uncertain way, shouting at the top of their voice.
Why did they not use that voice to immediately stand up for their rights and as a woman? One serious look or as it is called “a dirty look” from the women could have done it. This could have deterred them once and for all.

  31. innocence betrayed
    June 27, 2014

This is one of the most immoral and dishonourable thing I have ever come across. Lennox Linton has been brave enough to speak out about the abuse of our young women. Abuse of our young is common practice and common knowledge in Dominica. Ministers are not immune.
What the government should have done was to begin an investigation to determine who the culprits are, if indeed there are any culprits . This would have been the moral, honourable thing to do. There are young people whose innocence and trust are being betrayed by people in charge of their welfare and well-being. If it is true that ministers are involved in this shameful act, an unbiased and thorough investigation would have been the best course of action. Instead the government has chosen to besiege Lennox Linton and drag him to court for libel. This is truly a shameful thing to do and demonstrates without a doubt the direction in which this government is heading. There is no doubt in my mind that this country is on a slippery slope towards a dictator. The majority of Dominicans are already living in fear, afraid to speak out about the things that matter. This is designed to put more fear in the hearts and minds of every Dominican. Dominicans WAKE UP! before it is too late. We need to stand behind those who are brave enough to stand up for what is right and just. What Lennox Linton has done is right and just. Support him! Stand behind him! One day you may wake up to find that you have lost your freedom of expression and your right to be free.

Sometimes I wonder, what is Tony’s motive for wanting to take a sensitive case like that to court. Is it because of his political dislike of Mr. Lennox Linton. Is it because of his alleged dislike of certain Ministers of Government. Is it because of the financial returns. For a statement which has been floating around the airwaves in Dominica for months, why now. For a statement which is associated to an alleged report to the Dominica Police Station, aren’t the persons whose names have been implicated in the alleged report to the police, concerned. I hope the Ministers of Government are aware what they are getting into. I hope they realize that all eighteen Ministers of Government including the ladies will have to stand in court individually and be grilled by the lawyers representing Mr. Linton. This is serious business, therefore, Mr. Linton, I believe, will get the best in the Caribbean. I also hope they are prepared to handle the popularity this case is going to get all over the world.

Why he did not get the police to investigate the matter, was a doctor called to check the person/s, are there any pictures of the events, and the list goes on.i hope he is well prepared, otherwise i see him looking at a difficult case to win.

Again because no one was not convicted does not mean the acts did not occur. There is no benefit to any one to say things that are not true. The people of Dominica who are pretending to hide behind this unjust court system will have a taste of it one day. This so called sue will come back to hunt Skeritt and his ministers. What is done in darkness must come to light. The trap that you set for another will be the same one to trap you. God will judge the wicked.

Tony is really leading the sheep to the slaughter! Commonsense dictates that when accusation is made about a child the parent first seeks the truth, if the child is guilty he/she is punished, if proven otherwise the accuser is admonished.
The same applies to a government, when accusations of this type is made about cabinet ministers, the leader’s immediate response is to investigate the veracity of the accusation, if necessary set up a commission of inquiry, then the legal process takes its normal course.
But in Dominica where no law, no constitution can stop the cabal, the only route is to go to court to stop freedom of expression.
I really hope commonsense will prevail and those idiots in cabinet will not allow themselves to be lead by a wolf who is clearly looking for more generous legal fees.
How can a government really believe that they can win a case like that unless the Court is in their pocket.

It is a shame that some of .us cannot defrentiate between free speech and character assassination. It is high time that we learn to say things in public, only when we have the proof. The UWP still has not learned that no one should make false accusations unless they can substantiate their claim. I thought that they learned their lesson coming out of the bugging allegation. We should not forget that GONZALEZ was willing to go to court in order to tell Dominicans how deceased PRIME minister Eugenia Charles wanted to bug the office of the UWP. Eddison James fell for it……hook, line and sinker. I can remember the trial of that case. Eddison James and the UWP WERE HUMILIATED. THE AMOUNT OF TIMES THAT THE LEADER DRANK WATER AND WIPE HIS FACE, WAS NOT FUNNY. They had to pay for their lies. I am afraid that the same thing is going to happen to Lennox Linton. He never thought that he would be challenged. That was the miscalculation on his part. He even continued to show some level of arrogance, by beating his chest and saying “bring it on”. I am sure that he now has a few more regrets. We shall wait as the saga unfolds. “Bring it on!!!!!!”

This is an act of desperation by the DLP, aided and abetted by the one who is the greatest enabler of corruption in the country.
Lennox, you need to know that you are not alone in this quest for justice in this country. Do not for a moment believe that there is any merit to this act of desperation. When 18 ministers are named in a law suit to silence the voices of dissent in a country that is reeling from corruption of all kinds, and in particular, well known and well documented abuse of women, we can cay without equivocation that we have a problem of monumental proportions on our hands to deal with, and Lennox is not the only defendant.
The news of this spurious lawsuit encourages the belief that this administration is behaving like a regime that are in its last throes. They have lost sight of the reason for their existence and are behaving irrationally like wild animals that are cornered and have no where else to turn and have taken to lashing out indiscriminately like wounded beasts, devoid of any reason or the capacity to reason. Their worst fears appear to be haunting them, ie, that they will be held accountable for high crimes and to preempt their day of reckoning they are sowing seeds of fear, this lawsuit against Linton being exhibit A.
But one thing is clear to all and sundry: To everything there is a season; a time to sow and a time to reap; etc etc.
The winds of change will not pass them by. You can take this to the bank.

Man, I don’t support one party or politician over the other, but it is huge hypocrisy in Dominica.

We Dominican men are hot blooded, we know that, tell me which government has had ministers that have not tried and succeeded in coupaying young ladies for favors. Which one?

That has always been going on in Dominica.

Too much divisiveness and hatred just to try to choose masters over us man…

18 ministers; the entire class! What a show of unity!

The lesson to learn from this is that along with free speech goes personal responsibility. Words do matter. Defamation for political gains is a serious matter. Personal attacks must be substantiated. What has happened to Thomson Fontaine’s law suit?

I heard Lennox Linton on Matt’s “hot seat” programme this morning confirming that he is being sued by no less than 18 Govt. ministers. I have to raise my eyebrows trying to believe that all feel personally aggrieved. Anyway, this is going to be a trial of enormous public interest and I hope it will be held soon and in open court with full access by the media. None of that “!in camera”! stuff please!

By the time Linton realizes that this is a case he cannot win, there will be a out of court settlement. Please not the accusation is RAPE, which is impossible to prove in the circumstances.

Lennox Linton is not afraid,” he said. Be brave!! Our readers must understand that to date – June 26th 2014, there has not been any government minister who has ben found guilty of the crime of RAPE. So lennox knows very well that this court matter will not examine whether we have “RAPIST MINISTERS” but rather whether Lennox was right in his claim that government is infiltrated with rapist ministers. In other words there will not be anybody on trial in this matter to determine whether any minister has been tried and found guilty with the crime of rape. Linton’s statement is conclusive. There are rapist ministers in government. He has to prove which minister of government has been found guilty with the crime of rape – when, where, by whom? That he has to prove. No body will go on the stand and stay so and so minister raped me and he was found guilty on that date and time etc.

I look like these ministers are after money man.

What was wrong with the statement? I though Dominica was a country of free speech.

I’m not interested in the politics of the land but come on guys, why step so low.

Hello, since when free speech means that you can say what the hell you want about someonelse to the point of defaming that person’s character? So why did Eddison James take offence and sue the man for saying he had a big house in Barbados? Was there not free speech at that time? None of youall took offence to that; so someone calling another person rapist is not a big deal? I hope when other people call youall names youall don’t send lawyer paper for them since we live in a country of free speech.

Whom was called a rapist by Lennox Linton? Go on, I challenge you to say a name. In the Edison James case, the latter was specifically mentioned.

Dominica justice system is becoming a joke. The DPP deciding to not pursue murder case because of lack of evidence and everybody wants to sue everybody. Although the statement by Mr. L is far-fetched and idiotically stated, I do not see it paramount to a lawsuit by 18 Ministers of Government. In my mind it is a waste of time and a distraction to the issues at hand. I am not any “rite” like most of the people who respond to these posts, but just a concerned Dominican Citizen who wants the best for my country. Enough already with the frivolous lawsuits! Maybe Mr. L should come out and make a statement saying that he has no proof “of rapist ministers who uphold extortion of sexual services from young people seeking the facilitation of ministers to get personal development assistance from the public purse.” On the other hand if there are any ministers who have done what he has stated, they should stand up and say that I have been “a rapist ministers who uphold extortion of sexual services from young people seeking the facilitation of ministers to get personal development assistance from the public purse.” Do you see how laughable this is, both the statement and the lawsuit!

      One Love Dominicans!!!

@ABITRATOR! Cum Cum said something about Edison James he got sued and paid more that 20K. Just wondering if that does not fall within the context of freedom of speech?

Guess Edison is a dictator also, even if he is not a government minister.

The problem is too many of us misunderstand freedom. While we are free to damage other people’s character, the law requires that we are accountable for our action. The victim is entitled to claim damages. Freedom is not about reckless behaviour…the rest of society are entitled to freedom as well.
