The opposition United Workers Party has waded into the controversy surrounding Tommy Lee Sparta with its leader, Lennox Linton, questioning the government’s handling of the matter.

“Is there anything the government can get right?” Linton asked during a forum with visiting and returning Dominicans on Tuesday morning.

According to Linton, although the Jamaican artiste had the right to enter Dominica and perform, the government also has the right to refuse entry out of security concerns.

He said the government knew from a meeting last week that Tommy Lee would have been refused entry into Dominica but the promoters were never informed.

Linton stated that instead, the artiste was allowed to come to Dominica where he was denied entry and detained, which he said now opens the island to international ridicule and lawsuits.

Tommy Lee was denied entry into Dominica and detained on Sunday afternoon. He was set to perform at a concert in Portsmouth on Sunday night.

He was deported on Monday afternoon.

The government said he was denied entry, detained and deported in the interest of public safety.

Meanwhile Senior Counsel Anthony Astaphan, told the Caribbean Media Corporation (CMC) that the authorities in Dominica “had jurisdiction under the relevant laws to make the determination whether or not somebody ought to be allowed into the State whose utterances, whose conduct and whose past could either trigger some form of breach of the peace or affecting the whole concept of public morality”.

“A significant portion of our communities are Christian and they have expressed outrage of this particular individual. The Ministry of National Security and Immigration would have had to consider all the factors,” he told the CMC. “Our Eastern Caribbean Supreme Court has made it clear that it is a matter for the Executive Branch of Government to ensure that steps are taken together with the police authorities and otherwise to protect the integrity of the State on matters concerning public order or public morality.”

Attorney for the artiste, Tyani Behanzin, has said the matter would go before the Caribbean Court of Justice (CCJ) for ‘massive claims’ of damages.

Recently the CCJ ruled in favour of Shanique Myrie, a Jamaican who was denied entry into Barbados but according to the CMC, Barbados is yet to pay the fine imposed since lawyers have said that the CCJ may not have the mechanism to force the country to pay.

    Linton and his new UWP imposters are the ones who should get it right. He should realize by now that he cannot use DNO to promote his agenda.
    He should realize by now that he cannot persuade Dominicans who love their country to put foreigners before OUR national loyalty.
    Look at his tract record . Stone thrower in the downfall of the labour party in 1979. With his two sisters closure of the hospital and agitation at the royal bank .Hiring of foreign lawyers to take the PM to court. Boycot, demonstration , falls aligations and hatred. Bullying Alex Boyd Knight so Dominica would not have a first lady President, using children on independence day as political weapons…attacking church and religious officials, verbally abusing the police … the list goes on.
    IF the government was not going a good job Dominica would be like Syria ,Turkey and Ucrane and some countries in the east where nationals are killing each other ,even their children. So the government has definitely got it right. Soon all Dominicans will see that you and your new UWP gang of crooks and liars are the ones who have it all wrong. The mask and sheep clothing will be removed.

    Just because the Opposition believes the only reason for their existence is to oppose everything government says or does; I have a light bulb moment for them.

    There are times when your country comes first even if you are in opposition. In fact your country should always come first even if you are in opposition.

    There are times when an Opposition should allow the government to deal with the security of the country and they stay away from certain things, because it makes us believe you are not interested in our safety, when you appear to take a side against our government. It looks bad on the opposition to even give a hint that you disagree with the government on matters of National Security without having all the facts.

    Would the UWP be pleased that a lawsuit would be filed against Dominica? Would all UWP supporters, be pleased with a special tax on the people to help the Government pay lawsuits against the country? I mean if Dominica is sued, we are all sued, not any one individual. That would be all Dominicans.

    I would not support any opposition party or anyone wanting to be in government if they believe the security of the country should be jeopardize for any reason.

    An Opposition Party should not see them self as opposing everything. A main Opposition should see themselves as a government-in-waiting. The UWP shows me; shows Dominicans day after day that they are not ready yet, to run the affairs of the country.

    Where is the Leader of the Opposition anyway? Why is he allowing a non-parliamentarian to usurp his position? The man voice is seldom heard? Has he gone MIA?

    Being in Opposition does not mean you automatically oppose your country. The UWP must show us that is NOT what being in Opposition means. Why would we vote for you when you show me your dislike for our country that you wish to govern? There are times when you MUST leave the governing of the country to the government and not interfere. It seems that you would put our country at risks at any given time.

      The responsibility of the Opposition is to give practical and meaningful alternatives to that proposed by government on any issue. You missed the point. Unless the government can show that it did communicate in writing to the promoters that the artist would be refused entry after Cabinet took that decision to refuse him entry then the govt. mismanaged the situation and the opposition must point it out. Stop being politically blinded. It is people like you who continue to encourage the mismanagement onging in this country. You seem to support issues based on who says what than the content of the message.
      Also, if the Christian community was so convinced that the youth would not have attended the show why did they not put up a religious concert at Benjamins park that same night to compete with that Jamacan artist to prove their point?

    Linton stated that the government knew Tommy Lee would be denied entry and the promoters were not informed. Is this correct? Was he informed by them? Why is Ian Douglas not making a statement including the promoters?
    Who knows if they were informed and they still allowed the man to travel to Dominica? Did I not read that he recently performed in Russia (or is that true)? Were they able to contact him at all?
    Whatever Linton says he is believed by his supporters. Whatever the PM says he is not believed by his opponents.
    Some of you swallowed what Linton stated without knowing whether what he stated is true or false. I doubt this really occurred.
    Linton, show us real proof that the government knew Tommy Lee would have been denied entry.

    I don’t support the Government, politically, but I agree with the authorities in this matter. No one who promotes violence, evil and lawlessness should be allowed to enter our shores! The Government should simply have informed the promoters ahead of this man’s entry so all of this fracas could have been avoided.     i dont think its a good thing to try to stop this artist from coming to do his performance because remember when its world creole music festival,they usually send for jamaican artist and if thats what really happen to tommy lee especially putting him in jail and giving him bad treatment,i wonder how other people from jamaica gonna see it.its bring dominica back because at least we getting some enjoyment of a different culture but to me its just wrong. he there already,just let him perform and finish with that

    The truth is that we’re not getting anything official from the authorities on the details of what happened.
    We need to know if due process was met. If the individual was treated promptly and properly with the proper documents and procedures at the airport, but he persisted in getting through, then he is in default and his arrest may have been warranted. However, if due process was not followed, then the individual is allowed to protest his disapproval without need for arrest.

    We need a official statement from the appropriate authorities to help us clear the air and know where we stand.

    Just a thought. Wouldn’t it have been easier to have let him through? Today, we would most likely have finished speaking about how disappointing it is that people still attended the show but we would already be forgetting who the individual is because Richie Spice is carded to come to Dominica and he’s a much bigger and better love artist.
    I’m just saying.

    So a fellow West Indian is not welcomed in DA, the government knows it, yet that West Indian is not informed, so he waste his time and possibly his money to come to DA only to get deported!!!! More over, I thought performers required permits in advance that they can perform in DA.. Did this artist get a permit? Was his permit revoked? Was he informed? We are setting DA up for a lawsuit..

      If I am aware that I am not welcomed in a place, I would not dare venture to go there. The organizers made arrangements with him to come to Dominica and he did.
      Consider, if he had canceled, legally, they would not have to pay him for breach of contract. In this case, he came, was not allowed to enter and now he will be suing the government. This could have been his intention in the first place.

    can you imagine what could have happened if both sides of this problem had converged on the arbeedee cinema ?some praying and singing while others heading to the concert. Then the police would have to disperse the crowd with whatever means. Can you imagine the cries for the PM to resign for turning on his army on his own people. If what you are saying was what the church intended to do then I am left to believe that the church has not known the way to peace. Also, if that’s what they intended to do because they were not in support of TLS, would they not be setting an example for others to follow especially when they are having crusade? If that was the plan, then we have to applaud the efforts of the speaker when she tried to stop our crusade. These religious people need to study the bible to see if that pattern was ever set by Jesus, our savior and Lord.         The Church had a right to get involved, to speak out and to rally against this man coming to Dominica to perform. His performance is below an acceptable level.
        Our Lord Jesus Christ does not expect the Church and his followers to keep silent under this circumstance.
        The Church did what it is obligated to do and is expected to do by Our Lord Jesus Christ himself.
        Our Lord did not say to start a fight with fists and weapons. He said to do so prayerfully, peacefully and singing songs of praise and intercession. It worked, thanks be to God!

    I am reading some of these comments and I just have to laugh. These people have turned lennox words into some type of approval of Tommy Lee performing in Dominica. Can you imagine that? LOL

    All Lennox is saying is what many of us have been saying. If you do not want him in Dominica, after Cabinet take the decision, inform the promoters or even release a public statement on it. You don’t stay quiet, allow him to land, and on the runway you telling him he cannot enter. HE ENTER ALREADY!

    Where a CARICOM National is being refused entry into another CARICOM country, the Court has determined that the following procedures should be applied –

    • The State must promptly give written reasons for a decision to refuse entry.

    • The State must inform the Community national of his or her right to challenge the decision.

    • The State must provide an effective and accessible appeal or review procedure with adequate safeguards to protect the rights of the person denied entry both administrative and judicial.

    • CARICOM nationals refused entry should have an opportunity to consult an attorney or a consular official of their country or to contact a family member.

    So tell me where they having time do all that while the man on the runway standing up???

You must also realize that all arrows fired at him (Lennox) so far have missed, so this is really cause for desperation by those who felt that their master Skerrit would never be sent packing by anyone.     If the government has the right to do so then maybe the governments of the Eastern Caribbean should deny entry to some senior counsels who interfere with their electoral politics and causing division by spreading blatant lies and even telling the people thst they are intellectually challenged and suffering from all kind of diseases.

      I guess you consider running a country is like running your house.
      In your house, your home, you’re the boss. You make the rules as you see fit and you ensure adherence to them. If someone wants to come to your home it is ultimately up to you to decide. You have to answer to no one about your decision.
      When you’re charged with running a country, you have to consider other countries as your allies. You actually have laws that govern your ports and accesses and these laws are not yours to till and toy with. We have to ask ourselves, did we follow all the procedures necessary to deny the individual access to our country? Did he break any laws that would have him as a security threat in our country? We have to investigate the type of reaction that his being in the country to cause. Are we saying that the Christian community would have gotten to a violent protest that would have disturbed the peace of the country?

      I’m sorry, but if the Christian community’s protest action is so threatening to the peace and sanctity of our nation, they should be under careful watch. Also, I want them to make a serious case against the gay cruises and gay rights movement coming to Dominica.

      If we’re gonna protest to keep the evil out let’s just do it on all levels.

    Politics is a game of wait and see, especially when you are in opposition.The opposition did what every other opposition would do wait and see what The Government statement would be regarding such controversy and them make their statement and thy did, which of course trying to gain political mileage from this controversy.

    This whole controversy was badly handled by the Government.The reason given by The Government as to why Tommy Lee was denied entry has nothing to do with security, but all to do with The Government bowing to pressure from religious community.Senior Counsel Anthony Astaphan, statement to The Caribbean Media Corporation is is well crafted with reason and abstract legal language which is fine and perfectly true, but he real issue at hand is what is the evidence of a security threat posed by Tommy Lee.The Law enforcement personnel had enough time and opportunity to work with the Promoters and the Artist to establish a protocol removing the threat to security perceived.Tommy Lee issued a statement addressing what was perceived of him and who he is as a person making a living as a performer this does not sound like a person who is going to be a security threat.

    Let us make no mistake the UWP also has to face the religious community on certain issues so Linton should not pretend that his Party is at log ahead with The religious establishment The UWP needs the support of the religious community. I’m sure there are candidates running for the UWP right now who agreed with the religious people stand regarding Tommy Lee music and keep silent about their opinion regarding the issue,but as to The Government decision Politics is the dividing factor.

    This controversy has set a president in our Country and I’m sure this will not be the end, this is just the start.

    If the United Nations had declared Tommy Lee Sparta “Citizen of the World” it would be within the rights of every individual to question the decision to deport the entertainer; but the Treaty of Chaguaramas does not supercede State or Constitutional law. Vested in every customs officer in any country is the discretionary power to refuse entry to any person reputed for exhibiting acts of moral turpitude. I do not know Tommy Lee Sparta and neither does the law. And as long as there are no exclusionary provisions in the law to protect him, he must abide by the decisions of the Powers that be.

The article clearly states that “the government knew from a meeting last week that Tommy Lee would have been refused entry into Dominica but the promoters were never informed”. If any one of you making comments missed this basic piece of info, why comment?
    The government has the authority to protect the state from any alleged or perceived threat. It simply comes down to the way the situation was handled. All they (the government) had to do was inform the promoters. This would’ve been an open & shut case. Knowing is half the battle. On the other hand Mr. Linton is right in addressing the issue; “the government can’t get it right”.

    I just cannot understand a thing here. If according to Lenox Linton, government knew from a meeting last week that this artist was going to be denied entry to Dominica, why then did they not make it known to the public or the organizers that there man would not be allowed?
    According to the minister of national security / minister for port and tourism Hon. Tony Astaphan (he seems to be that minister), “A significant portion of our communities are Christian and they have expressed outrage of this particular individual” then I am left to wonder if it is on that basis the government concluded that it was not safe to have TLS detained and the deported. If that is the case, then why did the government not use the SSU to ensure the safety of all?
    On Sunday Sept. 29, 2013 UWP called on supporters to converge on Roseau and assemble outside the new State House around 5:00 pm to “protest” against Savarin taking up the office of president. Next thing we heard was that SSU surrounds House of Assembly with machine guns. My question to you Tony and Skerrit is, if the government could detain and deport TLS on the basis of a large portion of the Christian community showed their objection to him, then wasn’t it very clear to the same government that a significant large amount of Dominicans from all walks of life also objected to Mr. Charles Savarin’s nomination? Why did you not encourage Skerrit to boycott the idea because of national safety? Why was the armed SSU used instead? You guys always seem to find a way to do what is in your best interest

    Anyway…I must say I agree 100% with Lennox on this one. Govt have the right to refuse him entry but promoters should have been informed and it should have been handled in a different manner.

    Typical example of the laissez faire attitude of the Ministers and civil servants in government. Nothing is done on time nothing is done right. Procedures are not followed.

    You know in my humble opinion this saga was not properly handled. I have been reading about this guy on DNO long before this unfortunate incident took place at the airport.
    This could have been handled much differently. If the Gov’t didn’t want him to perform in the State, because every Gov’t has a civil right to take actions to protect it’s citizenry if it suspects that there can be a problem in allowing any show to go on. With that being said the Gov’t had a civil right to inform the promoters of the show that such an individual is not allowed to enter the State to perform. Then and only then I think the gentleman and his entourage could be detained at the airport and disallowed to enter the State. If they were not notified and they landed without knowing they were not welcomed they still have rights. Every criminal has his/her rights. If what I am reading about his treatment after being detained is correct, then there is going to be a problem if this reaches to a court of Law. People being detained at airports happens around the globe. But we must remember that all detainees have a right to speak to an Artorney if they wish to. They have Miranda rights like every body else. And I am really hoping the the Evangelicals did not have anything to do with preventing this man to perform because your have a God given right to attend or refuse to attend the show. There was a woman who was caught in the act of ADULTERY and the church leaders brought the women to Christ and informed Him that she should be stoned because she was caught committing adultery. You the Evangelicals know the answer to this. And lastly if my memory serves me right didn’t one of your own have a problem one Sunday morning where his GIRLFRIEND exposed him while he was on the pulpit preaching with his wife sitting in the audience? I am in now way condoning this incident but would just like people to know allow this guy to perform is in no way going to make the State a worst place because the same Bible has prophesied that these things will happen at the end of time,just make sire it doesn’t happen to you.

    Both Linton and Tonny/Skerrit cannot provide leadership on this issue. The Singer had a right of free entree for 6 months. There is no justification that he posed are risk, neither have his actions lead to probable cause to refuse him entry. This is the CARICOM law. Skerrit was Chairman of CARICOM he should know that. On the issue of compliance with the orders from the CCJ the countries has a responsibility to execute the court orders in good faith.

        @2cents, that is not true! This has nothing to do with morality or spirituality. It is a political issue that was mis- handled by the government. Skerrit just once again used a fragment of the church as a cover up. I am not by any means I like TLS music because I only like real gospel music. To me, whether is Bob Marley, Peter Tosh, Tommy lee or others, their message always promote something contrary to the beliefs of Christians. Furthermore, not too long we had a gay and lesbian boat in Dominica and the church did not protest and Skerrit did not deport them. In fact they even had public sex for which they were charged. So don’t tell me about morality here.

    I think there is too much publicity on this Tomy Lee Sparta situation….I’m all the way in the mile high city and that’s all I’m seeing on the news on the internet concerning Dominica. Well, I đo understand it is a hot topic for the nation. In my point of view I think the nation has a right to allow entrance and deny entrance to whoever .If there is an issue of concern then they have their rights to deny entrance just like they would here. On the negative side I think that not everything was handled in the best way possible.

    What crime did Tommy Commit How was he treated ? If he committed a crime or not hew was supposed to be treated well like not have him sleep on concrete as stated in other news. I hope the or police and our citizens treat visitors and each other how the would like to be treated at home and abroad. It doesn’t sound like Tommy committed a crime and he was supposed to be given a decent bed to sleep on (even a Cutt)and food and water. It is sad what I hear.       what r u asking…what crimes he committed in Dominica or on a whole…well he just got out of jail in Jamaica for some lottery scam…the law he broke in Dominica was when the law officer ask him to return to his plane he refused. Some of us just don’t respect law officers. If he came in at the Puerto rico US border and was denied entry I am sure he would still be locked up somewhere waiting for a judge. he turned his rights into wrong when he cursed off the officers asking them who the F** Dominicans think they are to Deny him……So he had to be shown who they are.

    Blah blah blah….. every country has the right to protect it’s boarder from any threat of it’s security whether perceived or otherwise. All these talks and lawsuits are just useless noise. Thesr things happen to artists and individuals across the Caribbean on a daily basis. Behanzen knows it but has to represent his client. Was he serious when he asked for TL be placed in a hotel??? The next Dominican who gets detained at an airport in Guada or St. Martin or Antigua or USVI should try that and let us know how it worked out. Good luck to the Lennox and the UWP for trying to gain political mileage on this one.

      this is not new,that might be the reason why so many sitting Prime ministers are clamouring for it to be our final court of appeal lol. cause they know that since they are the ones choosing the judges it will be difficult to get a judgement against them and if per chance there is a judgement against them then the court has no mechanism to enforce that judgement. lol this is why i would not support no ccj no time in the near future, maybe after this crop of volehs in the cloak of politicians die.

      I suppose for chartering a jet, the other three people on board, loss of contract for performance and what he claimed as maltreatment. This case should be interesting.
      I hope the D/can government gets the last laugh and all of us who opposed his visit. God help us!

    Tortola is way more religious than Dominica. He performed in Tortola last month .. though the religious persons objected prior .. he was not refused entry. He came.. he performed, he went back .. no harm or security concern to anyone , not himself and not to members of the public … everybody nice .. only in Dominica

      I’m amazed that so many people are prepared to defend the indefensible.

      I’m still trying to understand what kind of security risk TLS posed to the people of Dominica.

      This refusal was not justifiable. In fact the impression I have gotten from reading all the comments was that TLS was discriminated against because of his nationality, the fact that he’s an urban youth and powerful people in Dominica just do not like him.

      IMHO it is immaterial if TLS worships the prince of darkness (I am not saying he does) as my understanding is that freedom of expression is allowed in your country. If this is the reason why he was denied entry it is really sad.

      Whatever the circumstances of his denial and detention as a Jamaican my expectation is that there must be minimum standards of treatment for refusal. This is the part that I’m most outraged about (as are many other Jamaican) and I would feel the same way if a Dominican was treated this way in Jamaica. I see no reason why TLS could not have been allowed to consult with his lawyer.

      It is not right that a Caricum citizen journeys to you island and is refused and then is made to sleep in jail, floor or on a bench. That is so inhumane and unchristian like.

      There is no escaping the fact that TLS was invited to Dominican and to treat a guest this way is frankly embarrassing. While I have never been a fan of TLS and never will be I think that every well think Caricum citizen should be outrage at the treatment he received. At the end of the day no matter if you like him or not the man is only trying to make a living.

      Examples like these illustrate to me that RTC is not worth the paper it is written on. Why do we bother to pretend that it has any meaning.
