UWP leader takes issue with court’s trial date

DLP supporters brandished placards outside the court on Thursday saying: "Those in favour - 18 seats. Those against - 3 seats. The eyes have it. Th people have spoken."

Opposition Leader Ron Green said he has a serious problem with the date granted by High Court Judge Justice Birnie Stephenson-Brooks for the election petition trial.

The United Workers Party (UWP) and members of the Dominica Labour Party (DLP) appeared in court for the first time Thursday, to address matters relating to five election petitions filed against five members of government.

The trial date was set for June 17 and 18, 2010.

But Green told reporters outside the court building yesterday that the June 18 date will be six months after the elections was held.

“Six full months to get a hearing and to get justice is of very serious concern to me and we are hearing that the Senior Counsel Anthony Astaphan is trying to extend that and delay it. We are looking to get things on expeditiously and now they are trying to stretch it and delay it,” he claimed.

Green said he was also concerned with the behaviour of DLP supporters outside the court, who were “attempting to intimidate the lawyers.”

He accused Prime Minister Skerrit of “sending these persons to interrupt the proceeding.”

Green has also accused Prime Minister Skerrit of evasion. Skerrit was absent at the High Court for the matter.

“I wonder why the prime minister of the country is trying to evade being served. We have evidence that he has evaded service. The petitions were placed in the courts 21 days after elections and he has continued to evade being served,” he said.

Heather Felix-Evans was served on behalf of the prime minister Thursday morning.

    Ron must tell Dominicans how many passportys he holds. Has he given up his African and American citizenship? Perhaps he should back … he cannot cope with our Constitution.
    He must understand that God appoints who He wants as head or kings of nations and not he Ronald Green and the UWP whose onetime leader said “I am in charge”.
    These guys are too pompous and aethistic. They hate everyone that do not agree with their points of view.
    On December 18, 2009 Dominicans spoke and the UWP should accept their wishes and take their 3 seats in the Parliament to represent the interest of the very person they want to elect them back into government.

    I am of the opinion that Ron Green and company did not anticipate the judge to postpone the case to June 17 and 18. It is fair to presume that they were hoping to have the court case rectified before the third session of parliament so that there would be an excuse for the three UWP parliamentarians to participate in parliament. Now that three sessions of parliament will have taken place before June 17 and 18 which the UWP said they are boycoting, consequently, the holding of bi-election, the pressure is on Ron and company. The UWP is in an uncomfortable position right now. From the very beginning, had the UWP decide to participate in parliament and still have the lawsuits, they would have been in a much better position. In the event of a bi-election, it would be extremely comical for the UWP to have candidates representing on their behalf. One must never let emotions take over their ability to think and act rationally, hence being in an uncomfortable and irresponsible situation.

    If it true that the PM holds dual citizenship the question is, Where does he pledge his allegiance?
    We have always heard the saying that you cannot serve two masters and most, if not all of us argee to this statement and the case is somewhat similar to the statement.
    Having said this, I believe there should not be any delay whatsoever in interpreting the constitution in this regard.
    At the end of the day it is either you are eligible or not, based on the law.
    This is a serious issue and the legal representatives on both sides are at it heads on. These are reputable individuals, who have good command of law language, as well as interpretation.
    So, it is all well and good for the citizens to side their party based on their voting rights. What is before the court is written in black and white and it is not a matter of who has the most support.
    I sincerely hope that all is well for the ruling party, for if the table turns, I anticipating some kind of uprising in my country.
    I implore the Commissioner of Police and the men under his command to pay particular attention to this matter.

    Why are we people criticizing Ron when you are the same ones who are using the same Constitution to declare the three UWP seats vacant. Wow!

    I do not agree with the present interpretation of the Constitution as is relates to the prohibition of dual citizens from being elected to Parliament. I don’t think it was the intention of the authors of our Constitution to prevent Skerrit (Dominican born) alone from being elected but at the same time allowing white men or even Chinese men born outside of Dominica to be elected as Parliamentarians. In fact, this is also the case with Ron Green, Sam Raphael and Earl Williams. Was this their primary intention?

    Now, do we believe that it was also the intention of the authors of the Constitution to have an electoral matter take six months and over to be dealt with before the Courts? Wasn’t it the intention of the authors of our Constitution to deal with these matters expeditiously? Why dictate that these petitions be filed within 21 days but at the same time the Court is taking over six months to deal with these matters? Is it because they had foreseen the Constitutional crisis that may come out of these matters so it would be best to deal with them before the Courts swiftly?

    What if Skerrit’s election victory is declared null and void? What would happen to new legislations, agreements, appointments, etc that were signed off by him?

    I believe that this case should be dealt with swiftly so we could start working on changing the constitution and building a beautiful Dominica.

  21. Any man who would more or less criticize a judge over the setting of a court date by which time he the petitioner is expected to present his case to the same presiding judge, is a man who is destitute of knowledge.

    Ron fail to even recognize that once someone file a petition in someone’s court, he or she has given the court, which actually is the presiding judge all power over him to decide the outcome of the case. The human element is as such we tend to act on our emotions, knowing this I would be careful not to get on the wrong side of any judge or magistrate!

    Nonetheless, it is said to some people ” ignorance is bliss.”

    So, while Ron may be burning in hell, he may hold the opinion he is in heaven.

    Someone need to advised Ron Green that the worst thing he can ever do is to offend people who has power over him.

      Steve, you are legally bound to attend court only after you have been served. The PM was never served, so legally he was not obliged to attend court. I would do the same thing.

      First of all, the PM committed NO CRIME. The election petition filed against him is simply implies a procedural error and does not result in any criminal charges, hence no “crime”. Also, as pointed out, he has not been served and therefore has no reason to appear in the court.

      The fact of the matter is Hon. Roosevelt Skerrit won his seat in a FREE AND FAIR election and is the Parliamentary Representative for the Vieille Case Constituency. Should the court rule in favour of the petitioners (UWP) a by-election would be called and Hon. Skerrit would no doubt win again, after officially renouncing his dual citizenship.

      So, all the crying and complaining my Ron, Eddy and dem is just a big waste of time. But then again they don’t have anything else to do… especially since they cannot be bothered to attend the House of Assembly and represent their constituencies (at least those very few that were elected).

    So when the 3 parliament seatings pass in April, and Ron et al no longer qualify as representatives, in what capacity are they going up against the government in June?

    As non elected, expired or to be relecetd leaders of the opposition?

    Would the bi elections be forced to take place prior to the court case, if they are fighting for seats that expired in April because of absenteeism in the House?

    Boy, dem people really have tings twisted in Dca for simple voting, non legally minded dominicans like myself.

        Stay Tuned I have a copy of the Constitution, tell me what exactly is our case here in regards to the citizenship?

        None, even if I want it to be different I know and have read the constitution and it says nothing.

        Many people talk about Skerro not serving in French Army…Rubbish!

        He was a citizen of France by being born, irrespective of where he was born. My two kids are full fledge Dominican citizens even if they are not born there.

        Where the seat of a Representative or Senator falls vacant otherwise than by reason of a
        dissolution of the Housea.
        if the vacant seat is that of a Representative, a by-election shall be held;
        b. if the vacant seat is that of a Senator who has been appointed, an appointment shall be
        made; or
        c. if the vacant seat is that of a Senator who has been elected, such electoral proceedings as
        may be prescribed shall be taken,
        to fill the vacancy within three months of the occurrence of the vacancy unless the House is
        sooner dissolved.

        Disqualifications for Representatives and Senators.
        is by virtue of his own act, under any acknowledgement of allegiance, obedience or
        adherence to a foreign power or state;

        Read the whole statement from the constitution….by virtue under his own act which is at the age of 18 and above. The PM did not become a citizen of France at or after 18. He was one before, as was Ron Green and a couple others.

        Now with respect to Green Cards/Citizenship a case can be made for for this if the person gets this document at or after 18 years of age. The reason being one has to pledge an oath upon entering the US with the documents for the Green Card….they make you swear. If you are in the US and apply for this (Green Card) you do not have to swear.

        So Norris Charles, Loaraine Bannis-Roberts and others who had/have Green cards were not able to serve, as to the time they got it-after 18 years of age.

    I am not taking sides here, but Mr. Ron Green being a man of intelligence (I hope), must know that this is the way that the court system works throughout the world. In fact, he should feel privilidged and be very happy that he is getting such an early date for the case bearing in mind that many high profile cases are often adjourned for periods in excess of 1yr.

    Ron Green won’t be satisfied until he is made Prime Minister of Dominica. If the judge rule in Skerrit’s favor in June Ron is going appeal because is not going to be satisfied with the ruling. If the appeal fails he is going straight to the Privy Council. If the Privy Council rule in favor of Skerrit, I guess Ron’s next move … I think he is that desperate. LOL

    Do you have to serve the Prime Minister personally?

    Why are these people never satisfied? They wanted an election, they got one. They wanted election observers, they got them. They wanted to go before the court, they have a court date.

    Do they not appreciate that the court already has cases scheduled? Do they think that every thing must stop for them and fit around their convenience? These people need to grow up and stop crying conspiracy and injustices when they can not get things their own selfish way.

      I agree with you totally. So many cases that haven’t been called for how many years now!!! So what he think their case have to be top priority then. I cannot understand these people at all. Wasting so much time with their foolishness. They can never be satisfied.

        Why are so sure I am not a UWP supporter? First vote I cast in life was for UP in 1995 and I was 20.

        Right now, I am ashamed to say I am a UP, but I will not lie.

        We need to purge the party of these grumpy old men.

        Do you honestly think that should all the matters before the court go our way, it will change 2015 election?

        Dominicans will continue to punish us, while we have Lenox et al speaking but not taking part in the elections.
