Prosecution to close its case in Green murder trial

court1The prosecution in the murder trial of Edward “Alcapone” Green is expected to close its case on July 5, 2013 after calling well over 20 witnesses since it began on June 17.

Investigating officer Inspector Robertson Laurent is the State’s final witness and is being cross-examined by defense counsel, Peter Alleyne.

In his evidence he told the court that he had spoken to various people while he investigated the matter and had released Green after he was first detained. Under cross examination, Laurent told the court that he had gone to the crime scene at about 12.30pm on the day that the body was found after being detailed as the investigator.

He said Green was first arrested on June 12, 2008. When questioned about Green’s deposition while he was in police custody, Laurent  replied “normal”.

Inspector Laurent told the court that he had gone to the home of the accused in Morne Daniel and had seen what appeared to be “blood stains” in the yard. He said samples of the soil of where the blood was seen were taken and sent to Barbados for forensic analysis.

He was asked if he had attempted to get blood samples from Green to which he relied “yes”. He went on to tell the court that he had also requested a blood sample from Green for testing to which he initially agreed but later when that request was again made he declined.

Laurent also told the court that Green had told him at his home in Morne Daniel that he had not seen the deceased Damian Dorival, in two weeks but later during a question and answer session said he had seen Dorival drive by in a blue jeep while he (Green) was sitting outside the “Lab” in Mahaut.

The prosecution had also heard testimony from Franki Sheldon Carter of Canfield who stated that on June 12, 2008 at about 7am he found a body at the end of a precipice in Elshmall. According to Carter, while walking, he had seen what appeared to be “blood trails on the road” he followed it and it led him to the precipice where he saw the lifeless headless body which also appeared “pale.”

Another witness for the prosecution, Raymus Auguiste, who briefly shared the apartment with the deceased, spoke of coming home on the evening of June 11, 2008 at about 6pm and not leaving untill about 7am the following day . Auguiste told the court that he had seen the deceased Dorival at about 7 o’clock on the evening of June 11. He said he last saw him at about 10 o’clock that same night and about 10 minutes later he (Auguiste) retired to bed. He also stated that he did not hear any gun shots that night and said he had a “big noisy Chinese fan” in his room which made hearing outside noises almost impossible.

Two sons of Edward green also testified on behalf of the prosecution.

The prosecution is led by Trinidadian Keith Scotland assisted by State attorneys Sherma Dyrample and Athleyn Nesty while Green’s defense comprises Peter Alleyne, Darius Jones and Vincia Auguiste.

Justice Bernie Stephenson is the presiding Judge.

I was at the court on Wednesday and listened to the Doctor give her testimony. That young lady impress me. Well spoken, knowledgeable, confident. Peter Alleyne try to cross examine her, but she had all her answers on the tip of her tongue waiting for him. Trust me I enjoyed that. Alcapone sit down there like as if he is still the man that used to ride horse in town during carnival. But the reality is that he’s a broken old man. May he rot in jail.

He may be “guilty” but a good lawyer could get him out for lack of hard evidence. Blood in his yard does not necessarily means that he killed the man. Listen: “Samples of the [SOIL] of where the blood [WAS] seen were taken and [SENT] to Babadose (out of the Country)for forensic analysis”. A good lawyer could use that and make the prosecution team grope for answers. Did anyone travelled to Barbados to inspect the lab where this “forensic analysis” was to take place?

To make a very long story short: In a certain State in the US people were locked up in prison for various crimes like DWI, DWI resulting in death and sometimes bodily injuries etc. Some sentenses were very steep whereas others were not so steep. An inspection was done at the “forensic lab” and found it to be highly contaminated resulting in the wrong results being given. Lawyers of clients jumped on this finding and secured release for their clients. In a nut-shell, there are so many ways to “skin a cat.” Did anyone involved in this case inspect the lab in Barbados? or is their lab results “INFALLIBLE?”

You have no idea what you are talking about. The eye witnesses evidence is strong enough to convict Edward Green In the absence of eye witnesses, the science must speak, but this case will rest on whether the jury believe the version put by the witnesses. The defense Attorney, Mr. Alleyne, have actually strength the Prosecution’s case with respect to time!!
