Seven, charged with attempted murder, granted bail

BailDespite strong objection by the prosecution led by inspector Michael Laudat, acting chief magistrate, Candia Carette George, on Tuesday, granted bail in the sum of EC $100,000.00 to seven men from Kings Hill charged with attempted murder.

The seven were charged in connection with the stabbing of police officer, Jeremy Leblanc on December 24, 2013. Leblanc received multiple stab wounds to his stomach, head and chest.

However, not all the men were able to present a proper surety and those who couldn’t, have been remanded until this is done.

Qwam Fontaine who is represented by lawyer Glen Ducreay, was bailed by Oliver Grell, while Luke Fabien’s bail was secured by his mother, June Joseph and her brother, Maynard Joseph. Fabien is represented by Zena Moore Dyer. Joseph Letang’s surety is his father, Henry Letang and his lawyer is Joshua Francis.

The other accused still awaiting sureties are Kevin George, represented by Saudia Cyrus, Johnathan Matthew represented by Wayne Norde and Jackson Williams.

As part of their bail conditions they are to report every Monday, Wednesday and Friday to the Roseau police station, surrender all their travel documents, not interfere with prosecution witnesses and not commit any offenses while on bail. The trial date is set for April 8, 2014.

The prosecution argued that while Jeremy LeBlanc was discharged from the hospital, the police is still in search of 7 other persons and if bail was granted, they fear that it will interfere with their investigations. They also contended that LeBlanc was due to travel overseas to seek further medical attention, given the severity of his injuries.

But defense lawyers Ducreay and Dyer told the court that the grounds put forward by the prosecution were “inadequate” to withhold bail. “They have had ample time to search for the weapon and as far as I am aware, the investigations are complete…under the Constitution, they have a right to bail. They are innocent until proven guilty. The grounds put forward to deny bail is not credible that is why we need a Bail Act,” Ducreay said. The Chief Magistrate agreed that a ‘Bail Act” was indeed urgently needed for Dominica but after reviewing the matter, she decided to grant bail to the accused men.

    please parent take your children with you to church so they can learn God moral standards, every saturday or every sunday take them to the house of the Lord and even in your homes teach them wright from wrong, and stop cursing bad words around them and to them, train them up in the way they should go and when they are old they will not depart from it, even if the father leave you for another, don’t leave them to raise themselves, some may come out good, others will turn out bad

    this is purely a financial decision by the court and not one based on justice. I understand it would cost money to house these wanna be cop killing criminals in jail, I understand as a police officer the victim ‘s medical bills and travel are also the expense of the government, i understand that the prosecutor is paid by the government and the Judge but by no means in any way should someone or some people who stabbed a police officer should be walking the streets… unless is blow allu giving them after they leave the courthouse!

    Before judging anyone, why don’t you all first listen to the sides of the story. Labeling them as thugs and behaving unmannerly is quite despicable. Firstly, the victim statement wasn’t event stated, nonetheless, how the event took place. We are all human beings, just because its a police office doesnt deny the young men their rights as a human. Who is to say that the police officer wasnt wrong in the situation…Think twice, a book is only as good as its contents the cover is only a distraction.

        were u present at the crime scene for you to be making such accusations?…Maybe the officer didn’t identify himself as one and was actually involved in the throwing of bottles under his alcohol….The stabbing was definitely wrong, police or not. However, think of it do you really think all this young men stabbed the officer? and yet no weapon has been found as yet.

        If i was the victim i would have come forward and say exactly what happened. If im a officer of the law, I will stop crime, not get involved. Do you really think anyone in there right mind will lash a police officer if he knew that person was one.(picture this), a young man running away from bottles and stones. a couple lashes him whilst doing so. looks up and sees one person actually fire the bottle. Runs up to him, his friends follow. More people come, the other gang has already flew and yet still the said person is making confrontation with the guys. One or maybe two fellas got really pissed( which was wrong) and stabbed the person. The others are not aware that this took place. After awhile everyone left the scene. YET STILL THE PERSON HAS NOT MENTIONED HE IS AN OFFICER. ……listen to both sides of the story, sometimes bad things happen to good people. sometimes its the good people that turns crooked.

    Folks are we missing something here? On the surface I don’t think the young men should be given bail but I am not aware of all the facts. But the larger issue is that in a small society like ours for the past 14 years we have being living in a lawless society. When a PM says that his does not care about the constitution this is what happens downstream .It only today that it is now in the living rooms of the people who are suppose to protect us. I guess the officers here who want to dish out extrajudicial justice now know how Mr. Emanuel Feels. For the police officers who want to hurt and disappear those young men, you are not the judge, jury or executioner. What do say when you co-worker shot the poor man in Calibishe recently who was already handcuffed ? What do you say about Inspector Corbett’s acquittal.

    That magistrate is not stupid. She has boundaries and limits she has to operate within. Blame the politicians that are dragging their feet to change the existing legislation.

    Giving those punks bail is almost like a death sentence. Both the magistrate and the lawyers know it so don’t think it’s a favor they were getting.

I also want to thank the officer for his service and call on ALL Dominicans at home and abroad to cry out for justice on behalf of the officer. Such senseless, brutal and cold hearted criminals have no place in our society.

    To the Chief Of Police I say let me hear your voice on the matter and STOP hiding behind your PRO. You are constantly singing that you are the “People’s” Commissioner so show some gull now and tell the people what is your plan to address the rising crime in Dca. STOP playing politics and believing that the Police Force will run itself. Mr. Commissioner PLEASE change the culture of unarmed officers and arm your officers 24/7 so they can first protect themselves and in turn the public at large.     The Police Command Structure must change to better serve the public. This antiquated structure designed to protect the public is failing officers and the public. Also, we cannot have a command structure where it is “ALLEGED” that the two top men are incommunicado with each other. Dominica and the junior ranks deserves better.

    I will say a prayer for the officers’ speedy recovery. But, Change Must Come and that will be soon.

I have spent time in parts of Africa, and the best experiences of my life were in Ghana. Ghana is very much like Dominica in appearance and demography, in ethnicity and sociability with a very interesting difference. Tremendous reverence was accorded to a Dominican who built several high schools, churches and other institutions in Accra and other cities. He did not do this for his tribe and certainly not because he was Bantu. His name is Bishop Bowers. Tribalism is not unique to Bantu, rather it denotes a stage in social development experienced by traditional societies; and that includes the mzungu as well.

        Your assumption regarding my location and living in developed country is incorrect. My observations based in day-to-day experience living in Dominica. I disagree that Dominica tiny population is a source of the troubles this island has. There are a lot of places which managed to build up their economic niche where they can prosper. Contemporary history knows a lot of good examples.
        I believe that Dominican society is very unsettle: look how Dominicans treat each other, how you treat your women, your kids, how you treat animals. Of course its generalization and there should be good people but in your vast majority you are unsettle. Look on kids growing without fathers because their father having other women, drinking with friends or doing their time in jail somewhere in the US. I can bring more and more examples. Such kids are the thugs on the streets. They are just mirror of who you are.
        Now comparing Ghana and Dominica is very incorrect: only similarity is the race. In no way culturally Dominicans are Africans. Of course Mr Honeychurch would argue but let it be.
        Same way you cant really compare people in Honduras with people in Spain: they are just different.

        Im clearly not a person who can tell what to do with all that mess but I firmly believe that a lot of social and moral structures in Dominica are upside down and people living here just forget that it shouldn’t be this way and people should live better and be more human for themselves, for their families and for other people

    This bail issue is just a big joke, given the the nature of the crime. An attack on a police officer online of duty cannot, and should not be tolerated. And what is worst is the weak rebuttal by the judiciary system itself. This will surely undermine the confidence of the officers in maintaining law and order. We have lost a perfect opportunity to send a clare message to future and present criminals. No wander in situations like this law enforcement officers are seen running away like civilians. If that becomes the norm who will protect us. officer Leblance must be promoted for his stance and bravery in doing the job his paid to do.

    Dominica is quickly turning into a modern day Gotham City. The law makers and law enforcers of this country need to foresee what is about to happen. Their decisions and actions can make all the difference. This recent event is going to make more and more officers turn a blind eye when they see criminal activities happening. If my life as an officer is not valued and I am not allowed to carry a firearm to protect myself i will not find myself anywhere there is potential danger especially try to stop young men from throwing bottles at one another. I hope these lawyers, magistrate and even commissioner realize what their decisions are doing to this country. we need to be more strict in enforcing out laws. Dominica criminals take our laws, officers and magistrates for a big joke. This is evident through recent events. Also hearing them speaking on the streets, they always say “I must get bail.” Thats their excuse for deciding to commit a crime or hurt someone.

    I hope the police finally realize that holligans have taken over the City of Roseau….It is very unsafe to walk in Roseau at nights, especially for foreigners…Up to now we have not heard of any arrests in the death of Grell… The police get serious do continuous surveillance and break up gangs on the street corners. I lived in Barbados and the police were very visible….on patrol day and nights.. They also responded promptly to any report no matter how trivial it may seem…They would appear at entertainment spots in the tourist areas promptly at 2 am and stop all music….A country must have laws and people must fee that the police are in control…You must be visible at every entertainment stop or event..day or night, because young people use such opportunities to settle scores….We also need more lights on the streets of Roseau, There are too many dark streets. As sad as this event is, I hope is is a wake up call for our Police.

An officer was stabbed multiple times and investigators seeking the 7 others so why grabt bail!!! Put them in jail till case is called; some kids all they do is bring shame into their parents eyes….

    A “Bail Act” is badly needed in DA, An other thing is: There should also be a “Bonds Man” In that case, when one is granted bail, a 10% of the amount of the bail should be paid forthwith and deposited in the Govt.’s treasury,(this is happening in the USA and other places) that fund could assist in many ways. At lease this would curb the amount of violence taking place on island.

    many magistrates have resided over our court system .when mrs George was appointed I was appaulded ,because of her lack of experience .whoever appointed her should reconsider their decision for such poor judgement.there are many competent and qualified people who could have held this position and were rejected .our primeminister is demonstrating his lack of leadership and his failure to govern the common wealth of dominica.i do respect the head of state but his advisors lack the skills needed to run this country smoothely.

    Seven against one, the Police Officer? They stabbed him with the obvious intention of murdering him and they were granted bail? What type of magistrate is this to grant them bail?
    They were not given a restraining order not to go near the Police man or contact him including witnesses. They are now rejoicing with their family and friends to be out on bail and to enjoy their lives for especially the New Year while the policeman is still sick and has to undergo medical treatment. Those men should have been kept incarcerated until the case is heard.

      Talk to the Commissioner because in this day and age I still don’t understand why our officers are not armed 24/7. Also, why are they not issued hand cuffs etc as part of their gear. Looks like we now have a command structure that no longer see the need for tough no nonsense policing but rather crucify the lower ranks when they try doing their jobs because of politics. But Change Must Come..

    If it was her or one of her family members, she would never bail them. They are out and Gods knows what they are going to do. They might try to get away. Criminals are Criminals, they don’t change. I don’t blame no lawyer, they have to defend their client. I feel sorry for the police officers. Next time they get a criminal, beat them badly and ask questions later.

      No dis respect but the last set of Real Officers were trained back in 1995. The current Chief was one of them but he is sleeping on him.

    I understand, and agree, that everyone not changed with a capital crime should get bail, but why only $100 grand for such a serious offense? Anyone on this blog have any insight as to why the bond was so low?

        Poor policeman. Is it any wonder that he has to undergo further treatment overseas? Doing that to a policeman and they were bailed? They were really out to murder him. I would keep those men in prison.

      Agreed. I do hope that those guy’s go after these so call lawyer’s and do the same to them. It is a damn outrage the kind of things that is going on in the court system in dominica today. As for the magistrate he/ she should be taken of the bench. It’s just a SHAME.

    Well when the police infringes the law, or does anything that I perceive is wrong, I lash out hard on them. I have done it in the past, and I will continue to do it in a bold way. However, I categorically condemn attack(s) on the law officers of the state, whether they are in or out of uniform. If those concerned are found guilty, I believe they should receive their maximum punishment.A lesson needs to be sent out to all and sundry that you do not viciously attack the law men, when they are executing their duty.

    It is shameful that the so called Acting Chief Magistrate did not see it fit to allow the police more time to complete their investigations before granting bail. In such a serious and complex matter it is not rocket science to see the police need more time especially since they are still seeking persons of interest.

    One may blame the attorneys but let us all remember that they are only doing their jobs and are not personally involved in the matters. Hence, I make no apologies to say that the magistrate has failed us and slapped the police in their face big time. And to think her father was once Chief of police…..hmmmmmmmm! But, Change Must Come and that will be sooner rather than later.

        I totally agree. if it was in the US these guys would not be granted bail for hurting a police officer . DOMINICA law is crappy and that magistrate should have used better judgment. IF it was her father they had done that to she would definitely have a different opinion. the family of this police officer should seek retribution and get a damn good lawyer. how can you let loose criminals?

      This would make any law-abiding Dominican national angry and disappointed in this Court System. It is obvious the intention of those men was murder. They no doubt plotted it and when to conduct it.
      It is the height of wickedness and heartlessness to attack someone and a policeman at that and plunge a weapon twice into his stomach. Those men should never have been bailed out.
      I am unable to comprehend that they were granted bail while the investigation is not yet completed. The bail amount is very low. Some Dominica Court System eh.

      that is what the opposition needs to focus on real issues like the bail act. instead of focusing on one man everyday. skerrit skerrit skerrit. challenge the government to these issues man. as far as i concern this is a federal offence and no bail. how can a gang try to kill o police man who is there to protect all citizens and you grant them bail. time for a bail act come on Mr. Levi peters stop getting a big salary under false pretense and police there risking their lives for the country. wake up man.
