Surety to pay fine or go to jail

A Roseau Magistrate has ordered Curtis “Shakes” Richards of Newtown to pay EC$4,500.00 by December 31, 2012 failing which, he will go to jail for 6 weeks.

Richards stood surety for Elio Edwards of Pointe Michel but Edwards has failed to appear for his matter. Richards told the court that Edwards was in jail in Guadeloupe.
“You have not given me any good reason why he “Edwards” is not in court you were the one who signed as surety on his behalf and so had to ensure he was present,” the magistrate said.

In the meantime, a warrant remains in force for Edwards.

In another matter, Jamel Celaire of Pointe Michel who pleaded not guilty to battery on police and resisting arrest on November 4, 2012 at Pointe Michel, will need to get a proper surety to secure his release from the remand centre at Stock Farm.

    Unbelievable. He was out on bail and he went to Guadeloupe and is in prison there.
    Being a surety is like signing for a loan for another. He will have to bear the consequences. What trouble some people find themselves in. If the man is in prison in Guadeloupe, he should be deported back to DA. The DA Court should contact Guadeloupe authorities about him.

      $4,500.00 man that is peanuts for shakes, they should have charged him $45,000.00 ten times what he was charged what a joke system, only in DA, shame on the justice system

        you see in the first place there should be no bail for these guys. the magistrates need to work with the police to find out the character of these criminals before granting them bail. so the system is a big joke. police working in vain for little pay.the needs to profile some people before agreeing to grant them bail. the politicians need to work on a bail act ugently. and there must be a list of offences for which no bail will be given and certain offenders too.

    One first needs to consider the bail conditions before passing sentence. Was he required to surrender travel documents?

      I think people on bail should not be allowed to travel, they sould be made to report to the police weekly and surrender all travel documents.These people can hop on a plane or boat and ran away

      Passing sentence for who. No one was convicted and sentenced for any crime. Point is Edwards didn’t show up to court when he was suppose to. Edwards most definitely didn’t go to Guadeloupe through the front door so whether he surrendered his travel documents or not is irrelevant. Shakes duty was to ensure Edwards appeared at court and Shakes failed to do so.

    Ha ha ha Elio Edwards from Pointe Mitchel is in in Guadeloupe, In Dominica they put him on bail and flee to Guadeloupe, ha ha ha them Guadeloupe police caught ….it was time, I hope he rot in jail,

    The only sad thing about this is that after serving his jail time he will be deported back to DA

    That’s good. We need to see more of that for those suetiwey and wicked people who are quick to bail out known criminals just to get them back on the streets to continue to terrorize the society. If you are going to serve as surety for someone you better be ready to face the consequences if the person doesn’t meet up to the conditions of the bail!!!

    The court should have charged Shakes more than that….I sure is his drugs the guy handling in Guadeloupe why he’s in jail…just how he sent those boys back door to be executed …I just hate that man. Exploiting those young vulnerable boys like that.

      shakes might not pay because there is no bail act. the bottom line is that these criminals should not be bailed.
