New Public procurement and disposal of public property act to come into effect

The Public Procurement and Disposal of Public Property Act No. 14 of 2021 will come into effect on April 1, 2022. The Act was passed by the House of Assembly on December 1, 2021.

Cabinet has approved the commencement date according to Section 86 of the Act, which provides for the Minister of Finance to make regulations to give effect to the provisions of the Act. Cabinet has further approved the Public Procurement and Disposal of Public Property Regulations 2022.

The key objectives of the Act are to modernize public procurement in accordance with the principles of good governance and to establish the institutions required for the implementation of new legislation, namely the Public Procurement Board and the Procurement Review Council.

The Act also aims to encourage participation of suppliers, contractors and consultants in public procurement proceedings.

The Regulations outline procurement criteria including the requirement to publish open, competitive procurement opportunities; contents required in the bidding documents; as well as the required bid security. It includes measures to promote domestic industry and social and economic development through procurement by micro, small and medium- sized enterprise; enterprises led by women, youth, the elderly and persons with disability; and other groups identified by the Minister.

According to the regulations, bids will be examined by an evaluation committee to ensure they meet basic eligibility criteria prior to a more exhaustive evaluation.

The regulations provide for two-stage bidding for an open, competitive procurement process – the technical evaluation and the final bid containing prices and other financial details. The procurement methods set out the terms of a consultancy contract and require that selection processes are based on the quality and cost method. The quality and cost method uses a competitive process among shortlisted consultants, which considers both the technical quality of the proposal and the cost of the services.

Regulations for the Disposal of Public Property are also outlined, as well as procedures for Challenge and Review. A request for review will be assigned to the Review Council after it is lodged with the Secretariat. The responsibilities of the Secretariat in supporting the Review Council are also defined.

    This bill is an exercise in futility. Firstly, all rational and honest Dominicans know that the national parliament is a useless instrument. Parliament is presided over by a rogue, Skerrit-pleasing, frenzied defector desperate for money. Austrie vehemently stated such, not me.

    ‘…..bills will be examined by a consultation committee’. This committee will be composed of only Skerrit’s diehard renegades.

    I’m positively certain that this legislation is only to please foreign, financial institutions as a requirement to procure loans and grants. After twenty two years this disgraced, money-grabbing, overly corrupt regime it sees it fit to legislate on the bidding of public procurement.

    Will this committee ave power to recoup all the ill-gotten gains from those who have swindled before the passing of this legislation? Just a rhetorical question. Not a chance.

    Can someone who speaks normal English explain what this is about? Also why are enterprises led by women have to be given special treatment/notoriety in an economy/country that already has equal opportunity and rights for all genders/sexes? We need to be careful, least we fall into the american new age feminist trap of “I am woman so treat me special based solely on my gender/sex.” Women already make up the majority of all desk jobs and positions of power in most enterprises here on island so why this sudden race to ensure they get special treatment. have we given up on our men so much that we have to be doing this now? There are men begging for work right now, work that is passed on to women simply to fill the “pink quota.” If you are going to make some sort of allowance for women then you should do the same for men. We do not have a battle of the sexes here or an imbalance in job opportunities based on sex so stop making it look like we still live in the 50’s or 60’s .

      All this gender and disability crap is part of the UN’s new world order agenda. All the countries that sign on to UN pacts like the Paris Accord and global sustainable etc etc have to implement those types of policies. Is a good thing that we majority black here or they would be going with the race thing too. And we not ready for the LGBT part yet because man will get tense :lol: :lol:

      But as to what all this mumbo jumbo means I think it has to do with fairness in giving out contracts for public projects like building roads and such. Maybe I’m wrong, I can’t understand this lawyer/politics mumbo jumbo either.

So, we already know where Dominica is headed no matter what law or Act of Parliament is passed! It is a sad day for democracy and rule of law in Dominica as long as Roosevelt Skerrit is Prime Minister! “If you not red, you dead!” “Sosay sel”!

      The Despot sees that the viability of CBI is coming to an end sooner rather than later. He desperately needs money to continue to get his beggarly supporters to adhere to him and his noxious political party. Here comes this legislation to fool the intentional lending institutions.

      The heightened interest in increasing agricultural output, the hastened flurry of activities and planned projects, tell us that panic has begun to take hold of these plutocrats in the illegal regime.
