Magistrate Michael Laudat has recused himself from\u00a0 a court matter to do with an attack on a mentally ill Grand Bay man describing the action as inhumane. The Magistrate adjourned sentencing for the offender who pleaded guilty to the assault.<\/p>\n
Taurus Leatham of Grand Bay appeared before the Roseau Magistrate court charged with battery and throwing missiles.<\/p>\n
Information from the court states that on April 12, 2021, at Lalay, Grand Bay, Leatham beat Patrick Ferdinand with a six-inch concrete block several times.<\/p>\n
Regarding the charge of throwing missiles, Leatham is accused of throwing the said block in a public place to the danger of other persons.<\/p>\n
Leatham pleaded guilty to both charges following which the prosecutor began reading the facts of the case.<\/p>\n
After hearing some of the information, Magistrate Laudat said he had seen the widely circulated video and images of the incident on social media and as a result, told the accused that he would not be able to deal with his matter impartially.<\/p>\n
\u201cThe video and images I saw were very gruesome. As to why I watched it I don’t know but I believe me having seen the video and images is prejudicial to your case, so I’m going to send you before another Magistrate,\u201d Laudat stated.<\/p>\n
He continued, \u201cthere is no way the images and video I saw I can divorce myself from it and give an impartial judgement, so I\u2019m recusing myself to be fair to you.\u201d<\/p>\n
Before adjourning the matter, Magistrate Laudat reprimanded the accused for his action.<\/p>\n
\u201cI don’t know what gentleman could have done to you to cause you to hit him with the block but I will say that your action was inhumane,\u201d he stated.<\/p>\n
The matter was adjourned for today, April 16, 2021\u2013before the Chief Magistrate, Candia Carrette-George for facts and sentencing.<\/p>\n
