{"id":301616,"date":"2023-04-15T16:58:59","date_gmt":"2023-04-15T20:58:59","guid":{"rendered":"https:\/\/dominicanewsonline.com\/news\/?p=301616"},"modified":"2023-04-15T18:33:31","modified_gmt":"2023-04-15T22:33:31","slug":"antiguan-judge-says-dominican-police-obligated-to-probe-choksis-kidnapping-claims","status":"publish","type":"post","link":"https:\/\/dominicanewsonline.com\/news\/homepage\/antiguan-judge-says-dominican-police-obligated-to-probe-choksis-kidnapping-claims\/","title":{"rendered":"Antiguan judge says Dominican police obligated to probe Choksi\u2019s kidnapping claims"},"content":{"rendered":"<figure id=\"attachment_269051\" aria-describedby=\"caption-attachment-269051\" style=\"width: 640px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-269051 size-large\" src=\"https:\/\/dominicanewsonline.com\/news\/wp-content\/uploads\/2021\/06\/Choksi-still-in-hospital-642x517.jpg\" alt=\"\" width=\"640\" height=\"515\" \/><figcaption id=\"caption-attachment-269051\" class=\"wp-caption-text\">Choksi entering the Magistrate&#8217;s court in Dominica<\/figcaption><\/figure>\n<p style=\"font-weight: 400;\">Dominican police are obliged to probe Choksi\u2019s claims that he was taken to the country against his will.<\/p>\n<p style=\"font-weight: 400;\">That\u2019s according to an April 14 court ruling handed down in Antigua and Barbuda.<\/p>\n<p style=\"font-weight: 400;\">The judge also ruled that Choksi can\u2019t leave, or be removed, from Antigua and Barbuda until he exhausts all his legal remedies.<\/p>\n<p style=\"font-weight: 400;\">The court went against the defendants\u2019 claims that Choksi\u2019s claims were \u201cfrivolous, vexatious, and an abuse of the court\u2019s process\u201d.<\/p>\n<p style=\"font-weight: 400;\">Choksi, an Indian businessman is accused in the Rs 13000-crore Punjab National Bank fraud case.<\/p>\n<p style=\"font-weight: 400;\">He had filed a civil lawsuit\u00a0arguing that there is an obligation on the part of the defendants, the Attorney General of Antigua Steadroy Benjamin and the Chief of Police Atlee Rodney, to carry out a thorough inquiry and that he has an arguable claim that he was subjected to inhuman or degrading treatment or punishment.<\/p>\n<p style=\"font-weight: 400;\">The wealthy businessman insisted that an investigation be made into his claims that he was kidnapped in inhuman circumstances on or around May 23, 2021, and reportedly sought relief from the court and demanded a prompt judicial or a police probe into \u201cthe circumstances surrounding his forcible removal from Antigua and Barbuda\u201d.<\/p>\n<p style=\"font-weight: 400;\">While hearing Choksi\u2019s plea, the court in St Johns prohibited his removal from Antigua and Barbuda without the court\u2019s approval, subject to an inter-party hearing and exhaustion of all legal remedies by Choksi.<\/p>\n<p style=\"font-weight: 400;\">Choksi maintains that he was abducted from Antigua and Barbuda and taken to Dominica forcibly in a boat on May 23, 2021, allegedly by officials of India.<\/p>\n<p style=\"font-weight: 400;\">He was charged with illegal entry into Dominica but the charges were later dropped.<\/p>\n<p style=\"font-weight: 400;\">Based on Choksi\u2019s petition in Antigua and Barbuda, Interpol\u00a0<a href=\"https:\/\/timesofindia.indiatimes.com\/india\/interpol-junks-rcn-fugitive-mehul-choksi-now-free-to-travel\/articleshow\/98833712.cms?from=mdr\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/timesofindia.indiatimes.com\/india\/interpol-junks-rcn-fugitive-mehul-choksi-now-free-to-travel\/articleshow\/98833712.cms?from%3Dmdr&amp;source=gmail&amp;ust=1681677850733000&amp;usg=AOvVaw1RiNL6LfDeXwZWlttrfIx8\">had also withdrawn its Red Notice<\/a>\u00a0against him, setting back the plans of Indian enforcement agencies to extradite the absconding diamantaire.<\/p>\n","protected":false},"excerpt":{"rendered":"Dominican police are obliged to probe Choksi\u2019s claims that he was taken to the country against his will.
