On\u00a017 March\u00a02026,\u00a0the Caribbean Court of Justice\u00a0(CCJ)\u00a0delivered reasons for its decision in\u00a0Harry Panday v Malcolm Panday and Deosaran David,\u00a0a matter originating from Guyana. On\u00a017 December 2025,\u00a0the Court had granted\u00a0special leave<\/a>\u00a0to appeal, that is, permission to appeal, allowed the appeal, and remitted the matter to the High Court of Guyana to be heard before a different Judge. In its reasons,\u00a0the Court outlined the procedural framework on how courts should approach striking out applications and\/or deficient statements of claims\/pleadings,\u00a0that is,\u00a0those that may lack a reasonable cause of action or sufficient particulars\/facts.<\/p>\n

The case involves a partnership dispute between two brothers, Harry Panday (the Applicant) and Malcolm Panday (the First Respondent). The dispute in this matter centres on a judgment sum of USD\u00a0733,451 plus interest which\u00a0the Applicant claims\u00a0belongs\u00a0to the partnership. The Applicant’s Statement of Claim was\u00a0first\u00a0struck out by the High Court.\u00a0Both the\u00a0full Court and the Court of Appeal\u00a0then\u00a0upheld the striking out on the basis that it\u00a0disclosed\u00a0no reasonable grounds for bringing the claim due to insufficient particulars.<\/p>\n

In its\u00a0reasons, the Court articulated the\u00a0appropriate approach\u00a0for striking out a claim\u00a0using\u00a0a framework anchored in the Civil Procedure Rules. The Court held that cases should, wherever possible, be\u00a0determined\u00a0on their substantive merits rather than being dismissed for curable procedural deficiencies.\u00a0Under this approach, where a court\u00a0identifies\u00a0a potentially deficient statement of claim, it must first\u00a0determine\u00a0whether the pleading\u00a0discloses\u00a0a reasonable ground\u00a0or cause of action\u00a0for bringing a\u00a0claim ,\u00a0and whether any deficiency in particulars is curable. If the claim\u00a0discloses\u00a0a cause of action but lacks sufficient particulars, the court must then conduct a balancing exercise considering: the effective use of resources, proportionality, fairness to all parties, and the overriding\u00a0objective\u00a0of dealing with cases justly.<\/p>\n

Following the Panday Approach, the Court found that the lower courts’ failure to consider whether the Applicant should be given an opportunity to amend his Statement of Claim, before striking it out, amounted to a misapplication of judicial discretion and an error of law.<\/p>\n
