Kirby Carver Jno-Baptist, 30, appeared before Magistrate Ossie Lewis yesterday at the Roseau Magistrate Court and changed his plea from not guilty to guilty to the charges of possession of cannabis, possession of cocaine and possession of cocaine with intent to supply.<\/p>\n
According to the facts of the case, police attempted to arrest the defendant in Montego Bay, Newtown on August 14, 2010. The accused fled the scene and in the process dropped two clear plastic bags containing 56 pieces of cocaine wrapped in silver paper.<\/p>\n
He was arrested by police on August 24,2010 after authorities executed a search at the defendant’s home where they found one gram of cannabis.<\/p>\n
\u201cOnce you have control of it and you have knowledge, control and custody then you possess the drug,” Magistrate Lewis told the defendant who previously denied the charges.<\/p>\n
Jno Baptist, who was unrepresented by counsel, told the court in his plea of mitigation that he has changed.<\/p>\n
\u201cI have been looking for a job,” the unemployed man said. When asked how he was able to pay fines of former convictions, he said, \u201cI work tiling and construction.\u201d<\/p>\n
In handing down the sentence Magistrate Lewis cautioned the accused.<\/p>\n
