Presently Dominica does not have a Bail Act and according to the Commissioner this has been a challenge for law enforcers.<\/p>\n
\u201cWe do not have it at this time and you find that there are persons who use to be remanded in custody, and because of the absence of the Act there is no specificity with regards to what you do to the individuals,” he said on DBS radio.<\/p>\n
In legal circles bail is referred to as the temporary release of a defendant from custody. The defendant is usually released into the custody of a bondsman, who acts as a surety. The agreement basically is that the state will release the defendant from custody, the surety will undertake that the defendant will appear at a specified time and place to answer the charge made against him. If the defendant fails to appear, the surety become the absolute debtor of the state for the amount of the bond.<\/p>\n
According to Carrette because of the absence of a Bail Act many persons who commit crimes are released and they go on to commit the same crimes. “You find that persons who commit heinous crimes are on the loose to repeat the crime again and you need to keep them behind bars because there is nothing in law forcing you to keep them,\u201d he explained.<\/p>\n","protected":false},"excerpt":{"rendered":"Police Commissioner Cyril Carrette is looking forward to having a Bail Act on the nation’s law books.
