Austrie appeared before Magistrate Candia George Tuesday morning after being arrested on July 29th at Trafalgar.<\/p>\n
According to Police Inspector Claude Weekes, officers, including constable Kimani Peters, were on duty in Trafalgar when they saw the defendant with a marijuana cigarette. Constable Peters approached the defendant and asked him what he had in his hand. Austrie replied \u201ca joint\u201d.<\/p>\n
The defendant then ran away destroying the “joint” in the process. A few minutes later the officers caught up with him \u00a0and informed him that they were arresting him. As the accused was being handcuffed, he began fighting with the officers, tearing the uniform of constable Peters and the t-shirt he was wearing underneath.<\/p>\n
The defendant was warned that he should respect the uniform and was told that it was the property of the state.<\/p>\n
He was fined $500 to be paid by 30 September, 2012 or one month in prison for obstruction and $100 due by 31st October or two months in prison for resisting arrest.<\/p>\n
In addition, Austrie is to pay compensation to the government of Dominica in the sum of $211.50 by 31st August or spend one month in prison and compensation to constable Peters in the sum of $90 by Friday 10th August or spend one week in prison.<\/p>\n
Meanwhile Kernel James Jack of Loubiere, who was arrested for assault on police, battery on police, resisting arrest and malicious damage pleaded not guilty to all five charges.<\/p>\n
Jack is accused of damaging a silver chain and two silver pendants valued at EC $200 belonging to special constable D. Blanchard while he was in execution of his duties.<\/p>\n
