Astaphan questions DPP’s decision on Earl Grant

Senior Counsel, Tony Astaphan, appears to have taken issue with a decision by Acting Director of Public Prosecution (DPP), Julian Prevost, to have Earl Grant come to Dominica to assist the police in the alleged firebombing of the home of former magistrate GON Emanuel.

Speaking on the Next Level radio program Astaphan said the entire matter involving Grant, also known as Seko, involves ‘hearsay and conflicting evidence’ and there is no evidence of a case.

“The magistrate in the US can make the decision that there is no basis here to warrant extradition because there is no prima facie evidence of a case,” he said.

Astaphan argued that if an extradition request is brought before the authorities in the US, the defendant has a right to be heard and he can say there is no case against him. “Assuming the authorities there decide to take it to the magistrate’s court, the so-called fugitive, the alleged fugitive, has a right to be heard and he will be able to come to the court and say this is total hogwash,” he said.

Last week Prevost made the stunning announcement that Grant is wanted in Dominica for questioning in connection with the alleged firebombing incident which took place on Christmas morning in 2010.

“So we would like to put him on notice that unless he comes willingly to the country before the end of the month, I will be seeking the assistance of the attorney general to have him extradited to Dominica,” he said.

It is reported that days after the incident Grant left the island and he has allegedly been seen in New York and St Maarten.

Following the fire, he was implicated in a confession by Denny Shillingford who claimed that he set the fire on his (Grant) orders.

Shillingford confessed that he was paid in part to conduct the bombing on Emanuel’s home. He said he was coming clean because the organizers did not stick to their end of the bargain.

“I went in and I spread the gas all in the kitchen, all on the cylinder. I almost even burn myself …” Shillingford told Q95’s Matt Peltier in an interview in 2011.

Shillingford said he was paid $400 “but after I realized who it was and whose home it was and I understand what was really happening I proposed US$40,000. He said he would give it to me… up till now”.

But Astaphan had always questioned Shillingford’s crediblity. “Dominicans need to know who Denny Shillingford is. He has over 50 criminal convictions,” he said back in 2011 in reaction to Shillingford’s ‘confession.’

For his part, Grant has denied hiring Shillngford and promised to return to Dominica to clear his name. In a live telephone interview with Astaphan in 2011 he also revealed that he was currently doing jury duty in the United States and had spoken to the police over the phone.

With the latest development, Astaphan is once again questioning the credibility on the evidence in the matter and said it could be rejected in the US. “If there is a matter involving hearsay and conflicting evidence and there is no coherent credible evidence, then it can be rejected at that level (in the US),”  he pointed out.

He noted that some of the allegations made in the confession was done by ‘notorious criminals’ who have convictions ‘stretching from Capuchin to Scotts Head.’

Astaphan also stated that extraditions, as pointed out by Prevost, don’t work so easily. “So people must not believe that anyone in Dominica can wake up one morning and say if one doesn’t turn up at dawn we are going to ask for him to be extradited …. that it means automatically and we can go and extradition will take place and somebody comes back here in chains,” he stated. “That simply doesn’t work.”

Prevost has said that he will need the assistance of the Attorney General to have Grant brought back to Dominica, if he doesn’t come voluntarily since it is only the Attorney General who has the legal authority to make such requests.

    Someone has suggested that the call between Astaphan and Seco was personal in nature. How then was it possible that the same personal call was aired live in the public domain and we all heard what was asked by Mr. Astaphan and what was responded by Seco!!!!     sekko has been going to the US and Dca Back n forth every year…senjo i living so i know…why hasnt he come for almost 3 years now?..why would a businessman jus up and leave his rental business just like that? all vehicles jus stay there until they were ended up being sold and fixed up by family members? why cant he jus come and answer a few INNOCENT questions…my opinion in this is GUILTY until proven INNOCENT

    I don’t know why you did not post my comment; I don’t think I said nothing that could cost you a lawsuit. It is a fact and public knowledge that Mr. Tony Astaphan had a live radio interview with Seco days after the bombing. It is a fact that on air he questioned Seco about the bombing. It is a fact that both Tony Astaphan and our paid Security Minister, Mr. Charles Savrin, dealt with the matter on live radio programs and I recorded two of their programs. On this article released by DNO on May 21, 2013 @12:22pm, Astaphan referred to the Seco story as “Hearsay and conflicting evidence” and went on to say “There is no prima facie evidence of a case.” All I am saying is, based on all what Mr. Astaphan has said in public it seems to me that he has some information on that firebombing and as a Senior Counsel both he and the minister should be seen as people of interest based on the way they handled it on live radio programs, and in any Democracy, both would be investigated for information they have made and continue to make on national radio program. I don’t see how that can land DNO in trouble.

    Never in my life living in my country did i believe i would see justice being denied to such a high profile person like a lawyer. Who would you hire to do a crime a person without a criminal background or the opposite of that profile, Jesus walk in our land and save us from the hand of the devils work. Where are all the god fearing people in Dominica like the priest bishop pastors nuns lay persons on this land of the lord where are our union leaders and defenders of our right and priviledges and our constitution Magwa sa why are we allowing Tony to contradict our laws to suit himself. All secko’s action point to someone with something to hide the man left his business of rentals of heavy equipment and cars and ran away, is yet to return.

    Some people have questioned why is Tony commenting and on whose behalf is he doing so? Some have suggested that he believes that he is above the law etc. But are we really surprised that Tony is speaking? And why shouldn’t he comment?

    Mr. Astaphan has a right to speak on issues as a Dominica like each and every one of us, maybe more so on matters like these because of his training, qualifications, experience and connections. He is entitled to speak on matters of public interest as a legitimate citizen of Dominica just like every other Dominican is entitled to do so in a respectable and responsible manner.

    Therefore, my people, please let Tony talk. Let Lennox talk. Let Charlo, Mammy, Marlene and Blessings talk while members of the legal fraternity, except for a few, remain mute individually and collectively as members of a non-functioning /defunct Bar Association. No one has heard a word from anyone claiming to be representing the Dominican Bar Association in Dominica lately, even when their own nominees to the IPO and other constitutionally mandated or statutory bodies are under public scrutiny or attack?

    So, please, let Tony speak because he has something to say and interests to defend. After all, Tony made his statements not as a government official or as the legal representative of any of the parties concerned. He spoke on a partisan political radio program – there is nothing wrong with that people. Let’s not get too emotional, when Tony speaks. Let the man speak but analyze his trend of thought carefully.

    Tony did not say anything that he had not yet stated publicly. What he stated on the Next Level program is the usual partisan political “hogwash”- and Tony knows that when he says “the entire matter involving Grant involves ‘hearsay and conflicting evidence’ and there is no evidence of a case.” That is not gospel but Tony has the right to talk just as we have the right to comment.

    The questioning of the credibility of Mr. Shillingford as a criminal is yet another fat red herring that Tony repeatedly throws out there, which he is well aware, is not the only factor to be taken into account in determining the evidentiary value of the statements made by Mr. Shillingford. So let Tony speak people. He has the right to speak.

    Moreover, Mr. Astaphan is right that US authorities will examine the case file and the evidence presented by the AG of Dominica before proceeding to make a decision on whether the information warrants extradition. He is also right that if an extradition request is brought before the authorities in the US, the defendant has a right to be heard and he would be entitled to post a defense. Furthermore, although an extradition order issued pursuant to an extradition hearing is not appealable (by either the fugitive or the government), the fugitive may petition for a writ of “habeas corpus” upon the issuance of the order. The decision of the court on the writ is subject to appeal and the extradition could be stayed if the court so orders.

    I am unable to comprehend why Denny Shillingford would make up such a story if it is not true. Even though he is a criminal and is presently in prison, why would he concoct it so as to implicate someone else? Smoke without fire? Who else did he implicate in this story?
    Does Dominica not have a lie detector system? If not, Ag DPP this is one which you should implement. It appears to be necessary. How costly is it? A person like Denny should be given one to ensure that he is telling the truth and nothing but the truth.

    Just listening to Kairi at 1020 pm on Tuesday, 21st May. My goodness, how foolish are our people going to be??? These guys talk and talk for three hours and then take five phone calls!!! My people, this is classic propaganda strategy!!!! Belt out the propaganda and then take five calls and if they speak against your government, cut them off!!!!       Please note also, Tony isn’t even in Dominica, he is at his home in Florida with his wife and new baby while his home here is under repair and makeover. Tony has another home to go to but the rest of us stay here and take all the rubbish being handed out. While the rest of us stay here and invest and try to keep this country going.     Somehow why is it I still believe all this is staged?
    Prevost is appointed to act DPP by the government which is really Skerrit who appointed him. A few days later he makes an announcement that he is asking Sico to return to Dominica end of month or else. Rumor has it that Sico says he will come very soon. Wow that was quick. Then Astaphan steps in right on Q to attack Prevost’s decision knowing that if he does not say something people will smell a rat. But in saying something he also is telling us that there is no case for Sico to answer. So why is he coming back? He is coming back for show after they have killed the case. It seems like a diversion. It is as if they planned together that when you say this I will say that so as to fool the people. It is just too neat. Sounds like a well cleanly rehearsed play. Also does Prevost get any benefit like renting his house for big money to government or anything like that? Was not Prevost on the court case as a lawyer of Isidore and Emmanuel in the early stages? They seem to have some trust in him. My advice is to watch them all carefully as this progresses.

    Dominicans should not be surprised at Astaphan’s statements.This was the same man who advised Seko to come to Dominica to clear his name.This flip flop attitude of Tony can no longer convince Dominicans that he is a credible lawyer. In my opinion, Tony Astaphan’s protection of the Skerrit Labor Government has gone beyond all borders of probity, unfortunately, many Dominicans cannot see through this heinous man.Mr. Prevost has opened Pandora’s Box,it is going to be interested to see wether Dominicans are going to allow, the Cabinet,Tony or the Attorney General to close that provobial box.

    No surprise here! This individual does not want to see this case gets investigated. Why? Well, by now he knows that the majority of Dominicans knows exactly who perpetrated this heinous crime, and the probable cause behind it.

    I’m confident that if this was in any other civilized country, they all would be in singing a totally different song, to include the one who is alleged to be the mastermind and financier of this criminal activity. We all know who they are trying to save, but it’s all a matter of time for them to fall.
    DNO, what’s wrong with my comment? Is it because the truth hurts? Anyway I’m a strong defender of “FREEDOM OF SPEECH”. I do have other means to get my comments out to the Dominican public.

      He is also a Dominican citizen. If he had committed a crime on U.S. soil the likelyhood is that the would be expelled from the U.S. to Dominica after completing his sentence. At this point he has not been arrested, let alone convicted but he is wanted as a “person of interest”. I can not see the U.S. not cooperating unless they are convinced his human rights would be violated by the authorities here in Dominica.

      BS, his is a US citizen that may be true but if the evidence is enough to prove any sort of association between Seco and the guy who set the fire, he will be sent back to face trial and if found guilty, his citizenship could also be revoked. He is not a born American.

Then why does the US Oath of Allegiance for new citizens states: I hereby declare, on oath, that I absolutely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state or sovereignity of whom or I have heretofore been a subject or citizen? Sounds like denouncing to me.

        In any event, extradition is still possible. It will just take a long time.

      He does not have to renounce his Dominican citizenship to be a US citizen. He has dual citizenship. The same applies for those who reside in Canada and Great Britain and are citizens of those countries.

    I am not a lawyer but it would seem to me that Mr. Shilligford is the perfect candidate for such crime. His criminal background would make it easy for the co- conspirators to question his confessions if in case they are caught. So it seems like it is playing out as planned.

    The fact that secko name came up as part of the investigation he should be questioned. The DPP has simply asked him to voluntarily return for questions. If he knows he did nothing then that should be very simple.

    Mr. Astaphans instead is suggesting crap and i would personally charge him for interfering in an ongoing investigation if he is giving active advice to secko not to return based on hearsay. When crimes are committed we ask the public to speak up. Are we going to consider that hea rsay when they do. Mr. Astaphans need to be part of the solution and stop being part of the problem with the justice system

        Why is this one so important. Victims of crimes have rights also. The right to have Justice. All Secko has to do is assist the investigation and if Tony was not appointed as counsel by the state or the individual then he should let justice prevail instead of giving an opinion as to why he should not return for questioning.

Are you saying after promising to return almost 2yeas ago, and signing power of atourney over to your sister and residing in the US ? Are you saying, you would do all that just to prove that you were innocent ???…….Beats me…
