Attorney cited for contempt of court

Court SentenceDominican attorney at law, Henry Shillingford, is in hot water after he was cited for “contempt of court” by Justice Errol Thomas.

Shillingford is a lawyer in a matter dealing with Farah Theodore versus Jacqueline Theodore which came up in court on Monday, March 14.

During the proceedings, Shillingford made some comments which the Judge regarded as contempt and asked him to return to court at 3:00 pm to deal with the matter.

Shillingford returned with lawyer, Cara Shillingford, who told the court that she was just retained and had not yet received proper instructions from her client and was humbly asking for an adjournment to be better prepared to deal with the matter.

She also asked for the particulars of the contempt to which the Judge said it was contempt in the face of the court and asked that she speak to her client.

He adjourned the matter to 3:00 pm on Tuesday, March 15th, 2016.

Someone commented that Shillingford might be disbarred in the future, that to me is rubbish, I have never heard of a lawyer been disbarred for contempt of Court.

Sometimes when judges and magistrates holds a grudge, they display their ambiguous conduct and expect the lawyers and sometimes witness to subject themselves as children in their court. Contempt of court is no big deal, the court can only send one to jail for few days, or impose a find dictated by law! I doubt one can be disbarred registering their disapproval to the conduct of the judge.

Contempt of court is the offence of being disobedient to or disrespectful towards a court of law, and its officers mainly the judge or magistrate, in a form of behavior that opposes or defies authority, justice, and dignity of the court.

It would have to be something of willful disregard of or disrespect for the authority of a court of law. There are basically two types of contempt of court: one being rude, or disrespectful to the judge, other attorneys, or causing disturbance in the court room particularly after being warned by the judge. Secondly it could be wilful failure to obey an order of the court. Contempt proceedings are used to proceedings are used to enforce equitable resolve, such as injunctions.

When it is decided by a court that some actions constitute contempt of court, the court can issue a court order that in the context of a court trial, or hearing declaring an individual, entities, or organization to have disobeyed or being disrespectful of the curt’s authority, called found or held in contempt.

That is the judge’s strongest power to impose a sanction for the act, that disrupt the courts normal process or proceedings. If Shillingford would be disbarred Dominica would be the first place on…

O Henry! You are in hot water again? You are a rebellious person.
Sometime ago did he not throw a chair at someone in Court? One of these days you will be disbarred.
You are from a good family and also nice people . Why do you not conduct yourself accordingly?
Some people would love to have a career as you do, if only they could. Why do you not project an exemplary attitude for one who is a Member of the Bar?

The judge must submit the basis upon which the contempt charge(s) was based. The lawyer may not be have been cognizant of the fact (lol) that his action was in contempt, which is why he said what he said in the first place.

It is about time that people stand up to Justice Thomas and let him and others understand that we will stand for justice and will not be perturbed by their partisan based judgment that is destroying our land. I don’t know where this Justice is from but he and others need to understand that we are fed up with them and desire nothing but justice. I hope many more attorneys will follow Henry’s lead
