High Court criminal session opens

courtOnly one guilty plea was made when the Criminal Session of the High Court opened on Tuesday.

John Seaman pleaded guilty for burglarizing M&S Cusine in Canefield in 2011. He will be sentenced on October 16, 2015 after the facts of the matter are ready and a social inquiry report is submitted from the Welfare Division.

Justice Errol Thomas is presiding while the State’s cases are prosecuted by DPP Evelina Baptiste with assistant from State attorneys Sherma Dyrample and Fernilia Felix.

Meantime, the murder trial of Herbert Xavier, Lauretta Xavier and Manuella Williams of Soufriere is now set to commence on November 23, 2015.

The three siblings are charged with killing their brother Harrison Williams a few years ago. They were found guilty and jailed for 15 years but appealed the matter. The court of appeal upheld and quashed the conviction and remitted the matter to the High Court for retrial.

Also down for a murder retrial is Shane Degallaire, whose conviction was quashed by the court of appeal, after he was found guilty by a nine-member jury and jailed. A date for his retrial has not yet been set.

Vivian Charles will also have to wait for a date for his murder trial along with Asha James. James is charged for the September 2013 murder of Kenny George.

Three other persons also appeared in court on charges of murder.

Included on the list were a number of sexual matters plus theft, burglary, unlawful wounding, grievous bodily harm and causing death by reckless driving.

Also Kenroy Paul is to be sentenced on November 2, 2015 for a matter dealing with the proceeds of crime Act.

    Some people have no conscience to murder their relatives and other Dominicans.
    What has happened to these people of this era? A place as Dominica which hardly had a murder in bygone years. It shows how evil some people have become.
    What about the man who murdered the Bertrand man from Laudat? He was charged and granted bail.
    The DPP gave him permission to leave Dominica. He was supposed to return in September 2014. Did he return? Dominicans have not heard about his return and to face murder charges.
    What was so important that a murderer was allowed to leave the State? Given permission to leave, do you think this man would return? I do think, by no means and not alive.
    The DPP must answer to Dominicans for that.

      Ur name says real fact but u are a low minded stupid individual to even waste ur time writing this comment. There are ppl who kill for no reason and there are those where unfortunate inccidents happen.. U must never rejoice or call ppl names when things happen to them. U never know when that same inccident will be on ur door step.. U might be seating in ur house when someone break into it then u try to defend ur self n then he falls n die, now ur in deep shit because u kill somebody. Dominicans must learn not to rejoice when things happen to ppl and mind there business, and pray that it doesn’t happen to them or any family member. U never know when u will fall in a situation like that.

    Many murders in a small, violent, barbaric country. Appeals go on forever, without basis.
