Maynard Joseph, Dave Bruney, other witnesses testify in dual citizenship court case

Maynard Joseph and Davidson ‘Dave’ Bruney were among fourteen witnesses to enter statements into evidence and be cross-examined yesterday in the election petition matter involving Prime Minister Roosevelt Skerritt and Education Minister Petter St Jean.

Joseph, one of the petitioners in the matter, shocked the entire court when he admitted that he had neglected to read the witness statements of Edison James or Bruney in preparations for the trial and further stated that he had not read any of the witness statements.

Senior Counsel Anthony Astaphan claimed that a Notice of Disqualification which the petitioners said had been distributed in the Vielle  Case constituency had not been distributed but Joseph insisted that copies had been circulated under his supervision prior to election day.

Joseph further admitted, when probed by Astaphan, that James gave oral notice of Prime Minister Skerritt’s French citizenship via the radio, as is included in the pleadings. The pleadings, however, do not include any mention of dual citizenship allegations made in the Veille Case constituency. Still, Joseph insisted that James had said those things at meetings in the Veille Case constituency.

St. Jean leaving court yesterday

Billed as the Media Coordinator for the UWP during the election campaign of 2009, Bruney stated that it was a title he chose for himself and he was responsible for all internet related tasks for the party during that time. It included the dissemination of information and the party’s Youtube, Facebook and Twitter accounts. He also stated that he was not a member of the party but was a long time supporter. He said that he also records shows or live broadcasts from a number of radio stations for his personal use.

He said that he first learned of Joseph’s filing of the petition in 2010 and his witness statement of 12 August 2011 included two transcripts. He insisted, despite Astaphan’s contention, that there had been a meeting on 17 December, 2009 at Laplaine.

Other Witnesses

Other witness statements and testimonies on cross-examination supported Bruney’s assertion. Marley Hurtault, a bartender from Laplaine, claimed that both political parties held meetings at a bus stop in the community of Laplaine on 17 December, 2009, the United Workers Party first from about 4 PM to about 7 PM and the Dominica Labor Party later that evening.

He said that while he could not see James speaking as he sold drinks from a tent near the bus stop, he heard James say that St. Jean had a French passport and citizenship. Astaphan pointed out that both Green and James never made reference to a passport in their witness statements and suggested that there had never been any UWP meeting there on that date and that Hurtault had never heard those statements at that time. He proposed that a meeting held in the Carib Territory on the same date was the only one held by the party that day. Hurtault reiterated his statements, insisting that he had heard the statements at Laplaine on that date.

Xavier Jules admitted that he was avid member of Ron Green’s campaign staff in the Laplaine constituency and that he had attended a number of meetings with Green. He also said that Green had spoken to him before filing the petition.

Jules stated that he could not recall having seen a leaflet outlining reasons why the constituents should not have voted for St Jean, even though Green had said that some of his activists in the community had prepared it and Astaphan suggested that he was not being truthful.

He also said that he had advocated for people to go to the Carib Territory and that both James and Green had spoken at Laplaine, before moving to the Territory. He further claimed that the issue relating to St Jean’s alleged passport was an issue prior to election day, despites Astaphans’s suggestion that it was not.

Clement Douglas of Penville testified to having handed out copies of the Notice of Disqualification against Skerritt although Astaphan claimed that no notices were circulated. Douglas claimed to have distributed approximately 1,100 copies along with a number of persons from the constituency, posting them on walls, trees, electric and telephone posts and handing them to all who would accept for two days beginning on 13 December, 2009.

Alexia Dubois, Vernice Bellony, Irving Seaman, Julian Royer, Renald Jean, Fabian Antoine, Jane Bellot, Julian Newton and Coneil Athanaze were the other witnesses in the day’s sitting.

Adjournment

The three witnesses still to be called by the petitioners were not available yesterday and a request was made for adjournment.

Two of the witnesses are expected to give testimony when court resumes at 9 today. The third, Felix Prosper, is currently employed out of state and arrangements are being made to have him brought home to testify, but he is not expected to be in Dominica until Friday at the earliest.

    I am so disappointed in MJ. We are all from V/case instead of supporting Skerrit u joining Edison and Ron green to bring down Skerrit. You have a party with 4 leaders and between them they have no idea who is incharge. MJ as one of your former students i am very disappointed in you.

I want to able to say that I am Dominican out there and not be ashamed about it, and to be honest right now I am not too proud of being a Dominican.. It sucks!!

    I do not have to belong to any political party, or to be living in Dominica speak up for the country of my birth.. This is a misguided notion of the YAHOOS! And they will not or cannot stop me!! Not even the Dominican secret police that can stop me.. o don’t even try!

    The true definition of a patriot to me is “A person who will defend his country against his Government” Do you even know that there is a difference and they are not one of the same? Huh??     Since when I have to prove that I did something qwrong or criminal in a court of law. Those who brought Skerrit have thje burden to prove their case. Skerrit does not have to prove anything. they have a right to remain silent. Should bubbles now ask Lennix to prove to the court how he Lennox, wronged Bubbles? I wonder how Lennox would react if he was summoned to prove to the court how he wronged Bubbles. Bubbles has the burden to prove to the court how Lennox wronged him.

    Well everytime anyone come to Dominica they most likely produce a passport therefore Immigration has the record. All they have to do is check the Prime Minister travel records prior to the elections then they will see what passport he produce. Second, they can send a subpoena to the French Embassy or the their United Nation Office and asked them to produce the Prime Ministers application for french citizenship. Tony Astaphan is just playing games with this court proceedings to prevent the people from finding out the truth. The same way they used their family money and name from preventing anyone who do not have family name recognition from opening business in Dominica, to compete with their business. Open your eyes Dominicians. (Love from New York).

    Why should we have to waiste so much time and well needed tax payers money on a case that we all know about?
    I know the court has already ruled that our beloved prime Minister Skerrit and Mr Petter St. jean do not need to testify in this matter. But we know both of these gentlemen as born again, God-fearing and in the case of St. Jean, a preacher of The Truth.

    Because these men are both spiritual men according to themselves, their pastor friends:Rev. Bill Daniel,Evangelist Peter R. Augustine and Spiitual Advisor to the PM, Rev. Bernard Joseph, I think this is a good opportunity for these God-fearing men to take a stand for the truth and contrary to the ruling of the judge, I would like to see these men decide to be frank and honest with us and decide to speak the truth. They both know that they have lied to us and that is not a good Christian testimony. Since they both believe in the truth, both God-fearing and they are both sorrounded by some of our most highly respected servants of the Lord in Dominica, I am calling on them to speak the truth and we will forgive them. I am also calling on those servants of God who took a vow before God to speak the truth, to encourage these men to speak the truth. If they fail to do so, they would be saying that they are not as God-fearing as we thought and as a result, servants of God, should withdraw themselves from people that are telling lies. This is the true test of one’s faith. If they take my advise and confirm to the nation what we all have already known, we will wrap ourselves around them and forgive them. So let’s put the truth to test. Do I get an AMEN?

      Your are seeing things that are not there. What you are describing is visual hallucination,It could be a sign of some form of mental illness or a symptom of some form of dementia.

      There are many possible causes for this mental sickness but most common cause is, my political party no longer holds power. My political party no longer hold power disease causes people to hear and see things that are not there.

      The most important thing for you to do is to get a good physician who can do a thorough work up.This includes lab tests and you getting a good grip on reality.

    This is pure foolisheness in the name of justice. What sense does it make to have Maynard Joseph, Dave Bruney and others to testify about about skerrit dual citizenship, when the key piece of wintness and evidence was rejected by the court? This same Court refused to allow Skerrit and St. jean to testify and turn in their passports. All this is all about now is Tony, Skerrit and his team trying to make witness dapalay. Does that make any sense when a crime against the nation and its constitution was violated by the one who was put in charge, and yet he is not allowed to say yes he did, or no, he didn’t.
    There is not one Dominica including the Prime minister himself, Petter St. jean, Tony Asdtaphan, the police, lawyers and the judge who does not know that the crime was committed by Mr. Skerrit. If anone doubts that and really wants to know the truth, all they have to do is get Immigration to give a copy of the passport which would include the bearer of the passport, date issued, Passport number etc. and that would takke care of the case. But that’s what they have blocked and they are trying to see what witnesses know. RUBBISH!!!

    If someone took a gun and killed a person, why would the police say they don’t want to see the gun and neither would they want the criminal to testify, while they only want to hear what witnesses have to say. If that happened wouldn’t you all say that it is a set up to free the criminal? Well that’s exactly what is happening in this story which is a waist of tax payers money and will set a bad example for othercriminals who would want to ignore our constitution. A simple question like, Mr. PM, do you have or did you ever possess a French Pasport? If they were interested in protecting our constitution and democracy, this case would only have lasted 1 hour. But because that’s not goal, Tony Astaphan has already told us that it will be a long case. You be the judge

      I fully aggree with your comment because this is a simple case to determined if the Prime Minister is a French citizen. Just have him produce his passport but since the court already block that we will not get the answer. Have the French Embassy produce his citizenship application. (Love from New York).
