Nigel Massicot goes to jail

Nigel Massicot, who is well known by law enforcement, was on December 18, 2012 sentenced to 9 months in jail after he pleaded guilty to stealing a laptop.

He was sent to the slammer despite his pleas that he wants to spend Christmas at home.

It is reported that he stole the item from a Haitian national who lives in Bath Estate.

Court documents show that in the wee hours of December 1, 2012, the complainant was awakened to noise and he saw a hand pulling the computer through a window. Massicot was chased but he managed to escape. He was later found in some flowers but managed to run away, dropping the laptop in the process.

The lap top was found but it was permanently  damaged.

The police were called and 15 days later Massicot was arrested. He admitted to the crime and said he was “sorry”.  “I am sorry for my actions, is long time I doh spend a Christmas out of prison and don’t want to return there,” he told the police.

In a mitigating plea his lawyer, Bernadette Lambert, asked the court not to impose a custodial sentence on him. “He is remorseful for his actions and is trying to turn his life around, he has not wasted the court’s time, he is the sole provider for his 14-year-old daughter. Your Honour it’s the time of giving and joy, he is begging for mercy from the court,” Lambert stated passionately.

But her pleas fell on deaf ears as magistrate Candia Carette-George,  while admitting to the passionate pleas, said that Massicot was “not learning”. “You were on the verge on spending Christmas out of prison but you messed it up … you have yourself to blame for spending yet another Christmas in prison,” she said.

She also spoke of the “high prevalence of theft” and said she had a right to protect the society. “Theft is on the rise and every day … it is growing and is on top of arrest matters before the court,” she said.

Only in May this year the Court of Appeal freed Massicot after he was jailed for another case of theft. They viewed his sentence as “excessive” and treated his time of incarceration as “time spent” and released him.

Sorry do not cut it. If you did not want to spend Christmas in prison you should not have done what you did to get you there. Shame on you, you should have thought of your daughter.

How remorseful can one be if that person continues that pattern of theft. Trying to turn his life around? what does that mean? Of course he has wasted the court’s time. When is he going to stop? Oh year, it is the time of giving and joy, not the time for stealing and hope not to get caught.

I wish his daughter well, and hope she do not follow his path.

Are you kidding? People should not steal from each other anyway, but I do not think anyone steals more than these people.

He is a chronic thief and he asks for mercy? How can the magistrate believe his remorse? He could have been sentenced for one year. He needs counseling and rehabilitation to curb his thievery ways. What will he do when he completes his sentence and is released? Will he return to his old ways and then be imprisoned again? The cycle will continue. Something should be done about him. Dominica should have a rehab centre to assist those criminals.
Our Lord Jesus Christ said, “Apart from Me you can do nothing.” They primarily are in need of the blessing and grace of God. Give them Jesus while they are in prison and hope they will change, worship God and pray to Him. In the long run they will be happy and peaceful people and free of theft.
