Roseau man receives hefty fine

Hefty fineA Roseau man, who a few weeks ago was found  guilty by a nine member jury of wounding with intent, has been slapped with a huge  fine.

Clever Burton was fined $ 60,000.00 to be paid in six months by September 8th 2015, or face 8 years jail.

Burton had stabbed Brian Dominique in Virgin Lane which resulted in Dominique becoming incapacitated. He can no longer work and is walking with the aid of a walking stick.

The two men were friends at the time of the incident but Dominique told the court that on the day the stabbing occurred, he was coming from work at 12 noon to have lunch. He said it was an unprovoked attack.

State attorney in the office of the DPP, Fernila Felix, presented the State’s case while Burton was represented by Peter Alleyne.

Justice Errol Thomas is the presiding judge.

    What got into this man to cause him to harm his friend? He could have killed him. I wonder if this was his intent.
    I think, considering his health is impaired for life, as the years progress he will need much more than that amount, whatever is left of it, for his livelihood. Consider the funds he has already lost and also expended since he was injured.
    The fine is $60,000. I suppose by D/ca standards being a small country, it is sufficient. After distribution of Court and attorney costs how much of it will be left to sustain him for life?
    The question is, if Burton has assets will Dominique be able to sue him personally? Sometime ago, I heard an attorney stated on Toronto News, “Do not sue their assets. Sue the principal.” Victims could then collect more money from those perpetrators who injured them.
    If Burton has no money he cannot be sued. I suppose this is why he is fined. Failure to pay he will be imprisoned. Some people can get themselves in trouble.

    Let me see if I understand this:

    If I want to incapacitate a competitor, I simply need to place EC $60K + $X contract on that person. If the person who carries out the contract is caught and convicted, he simply needs to pay $60k of the contract money. He then gets to walk away a free man with the $X leftover from the contract. And they say crime doesn’t pay!

    I would be laughing if that wasn’t some serious BS going on in my country. God help us!!

      We hope. The victim must be compensated for injury, pain and suffering, loss of work and being incapacitated for life. The poor man.

    I wish he cannot pay the money , so his A*** can go to jail for the entire 8 years. On the other hand i also want the guy to get some monetary compensation. I wish he had to do both .

    Hold up a second.

    Someone stabs another person and the victim is incapacitated and left unable to work and needs the aid of a walking stick as a result. The court sees it fit to slap a huge fine instead of an immediate custodial sentence? This legal system seems to be acting on behalf of the treasury in this particular case. Why wasn’t the defendant sent straight to jail for inflicting such an injury to his victim? Instead he is left with to roam the streets with a huge fine which most likely he is unable to pay and the possibility of re offending.

    Bestow an immediate custodial sentence on the accused, keep the country safe instead of trying to play tax man. What is that all about. The poor victim might even have the disservice of seeing the accused on his travels enjoying 6 months of freedom and might be even scared that her might be attacked again.

    I just don’t understand this judgement at all. Some crimes must be punished by a custodial sentence, this is one of those…

      I am not a lawyer and I certainly wished I knew how the Law in D/ca operates. Sometimes we have to think through this and beyond. He is fined and so he must be given time to pay the fine. He may not be able to pay it if he is in custody. Failure to pay it, he will be imprisoned for 8 years.
