Unavailability of key witness forces adjournment of dual citizenship case

The hearing in the election petition matter involving Prime Minister Roosevelt Skerritt and Education Minister Petter St Jean has been adjourned until September 29 due to the unavailability of a key witness.

On resumption of court this morning, Senior Counsel Anthony Astaphan informed of the intent to close the matter of the first respondents, meaning that the statements of the last witness was accepted into evidence as it stands without cross-examination.

Attorney for the petitioners, Douglas Mendes requested an adjournment due the to unavailability of Felix Prosper, one of the key witnesses who was expected to give testimony tomorrow. That expectation, according to Mendes, was predicated upon Prosper flying into Dominica by Friday morning, but he revealed that further communication with Prosper’s employer showed that he would only arrive next week and that he will remain in Dominica for two weeks thereafter.

Mendes requested that Prosper’s witness statement be entered into evidence on September 29 and that written submissions be filed by 28 September. Astaphan had no objection to the requests, but did express concern that since the trial had already taken such a long time and at the prospect of moving it back further stating, “There comes a time when the evidenciary part of the trial must end, so we can move on to submission.”

Though she took Astaphan’s concerns into consideration, Justice Gertel Thom decided to adjourn the matter until 29 September, insisting that written submissions be filed by September 28 before oral submissions on October 3.

    I have done business overseas and done business in Dominica, lived overseas and lived Dominica. So i know what i am saying when i say the country backward. You cant deny that Dominica lagging behind in terms of education, healthcare, infrastructure, entertainment, quality jobs, sports, and even agriculture.
    Have you ever been to Pakistan or Bangladesh?Besides we don’t want to be compared to the least but rather to the best, that’s what a progressive mindset is about.
    Just because someone has to come last in a classroom, would you accept your child being last? I think not, so why want that for your country you so love.

    This dual citizen fiasco has made the Dominica Constitution and it’s framers look silly.I maybe wrong but the question is .Why is it that a born and bred Dominican who acquires another country’s nationality can freely vote in any election held in Dominica and in the country where he resides but cannot run for office,in other words he can elect but cannot be elected,something is wrong with that document and should be rectified before it,s too late

    Dominica is not backward, it was never backward. In fact Dominica was ahead of the Caribbean region. We have our difficulties but we are not backward, the only backwardness i see is this nonsense of UWP. They set the precedence, with Ron Green, so I don’t understand why they are making a case now against Skerrit and ST. Jean. If they had not done it, Skerrit would never think he could do it also. The case should be dismissed, but Skerrit should step down as leader of the DLP because he has served three terms in office, and it will be good for the country and democracy.

The Dominica I visited on numerous occassions, is not the Dominica we have now. We are not backwards, we have developed and are still developing.     As for my children, dont even go there. University graduates, born in the UK working abroad and running their own businesses. All were (including me) educated in the UK.

      By the way if you think that dominica is developed, your standards are set low. It is developing but it is still backward.       I feel you @ Fed Up Dominican. I feel the same way about the so call intellectual elites.Like you I must say that Dominica is developing. I have been living out of Dominica for over twenty years. Every time I go home I identify a progressive change whether small or big, infrastructural or other wise.The government is not perfect but I do have to commend our fellow Dominicans at home and this present administration for their efforts. Lots of Dominicans in the diaspora need to be commended for their contribution as well.
      I support constructive criticism because it is necessary for growth however I have to say that I bleed for my country when i read some comments and commentary on this site as well as other sites( news sites pop ever so often).from the some disgruntled so call intellectual elites who claim love for country. Their insults and disrespect for the ” not so intellectual” Dominicans bothers me. I always ask these question, what are their motives? I pray that opposition and government would deem it necessary to work together for the further development of our beautiful country and wonderful people!

    To all the people with very limited mental capacity who cannot speak to any issue except to attack me personally and say all kinds of things real, imagined, or wishful thinking about me.. There is nothing you people can say about me that will stop me from expressing my opinion whether all you like it or not, so give it a break!!

    Now get that and process it well… Even if I was homeless, jobless, penniless I would still be speaking my mind, I would go to a library to speak my mind.. There is nothing that can stop that except if I am medically/physically incapable of doing so, or I am dead!! Put that in your little heads.

    Now I have a suggestion for you limited people. Go read a book, go to some night classes or something, when you do, you will realize that you can make a contribution without attacking anybody personally.     I never knew Felix Prosper was so powerful boy. You mean the man is so important that he is referred to as a key witness? How is he a key witnees? Did he or does he have a copy of Mr. Skeritt’s passport. The accused PM is not allowed by the court to testify, yet Felix we are hearing is a key witness. Bon Dier HO!

    Another thing I don’t understand is, how is that Tony Astaphan had no difficulties in delaying the case until Felix comes. I mean Tony is even pushing the court to excelarate the case. Aben me debah!

    With Felix Prosper being from Vielle case like Mr. Skeritt, I would be surprised if the man did not pay Felix to short up just as he had a secret settlement with Matt Peltier. According to Matthew Walter, let’s keep our fingers crossed.

        WIKILEAKS, thanks for your observation in pointing out that Felix Prosper is from LaPlaine. It was just a mistake and by the time I noticed it, it was already sent and could not be corrected.

        However, the truth of the matter is, whether Felix is from Laplaine, Vielle case Warner or even as far as Japan, when at fault we all know that the Prime Minister has established a reputation of making secret deals to cover him up like he did to Matt Peltier and others. That’s the fundermental truth and if you are in doubt ask Matt and attorneys of both sides.

    Is it right for any member of the ‘Independent’ Electoral Commission to seem to be taking sides in that dual citizenship case? Isn’t the matter having something to do with the alledged disregard for the Constitution and electoral laws of the country?

    What is lawful? What is undemocratic? What is conflict of interest in my land? What is right and what is wrong? it doesn’t matter? Oh !! it depends on who do the act and not whether what was done was wrong or against the law?

    The child takes money in the home without asking the parents. it is OK? Next day he/she takes $2. Still OK? the child goes by Nassief, steals some clothes, that’s Ok too. The child grows up not being scolded by the parents at all for adopting a habit of stealing and lying. Tell me frankly, what do you expect as that child gets older? Dominicans must regret supporting what is wrong. That attitude will surely come back to hunt the nation. Some people are afraid of the TRUTH. They are afraid to hear it, speak it, or support it. But no lie could last forever. Truth must prevail.

      Trust among all those asking for our support in the bid to be our leaders should be across the board. It should not be for one and not the others.

      It is indeed about the constituion which is not reflective of the society we have become. It is evident during this court proceedings re the dual citizenship, that there is a need to change the law.

      Dominicans will regret if they fail to use this opportunity to have an open discussion of changes to the constitution.

      We cannot place a blind eye those in the past who have done the same wrong and is trying to bring down and democratically elected government.

      This is also an opportunity for the opposition to take there rightful place in parliament and raise and discuss the issue.

      Trust I agree is expected from all those who wanting to take up any leadership role. It is apparent this dual citizenship will continue to be an issue. So my proposal is to be inclusive and allow native Dominicans the opportunity to actively particiate in our elections.

      American has a huge part to play with the economies of the Caribbean especially those Banana producing islands when they push for the WTO to remove the perferal treatment we had with Britian. They gave us not option but went with chiquta and others because of funding support to the campaign of a former American President. They main who we know. So what are we supposed to do, ly down and play dead. Hello no. It is a survival game and because of the charities of others most Caribbean Island are experiencing some relief.

      Dominica is not a colony of the United States. Though we live in a global village we have to respect the sovereignty of a country. Dominica is not married to the US.

      Sometime ago the United States withdrew military assistant to some Countries in the Caribbean who voted for the establishment of the international criminal court. Why is it that it is only the leader of developing countries are referred to the court. In my opinion Gorge Bush Junior, Dick Cheney, Donald Rumsfeld, Tony Blair among others should be tried for crimes against humanity. More people have died in Iraq since the Americans invaded than under Saddam Hussein yet he was executed.

      Our foreign policy should be driven by our domestic interest plain and simple.

    Trouble intended:

    Felix Prosper, the key witness for the petitioners, is quite an interesting character. We need to know more about him. An investigative journalist must check out his profile.

    Does he work in a CARICOM country, French, British or US Territory? Is he a citizen of another country? I know that Felix is not on trial but he may help us crack another part of the case. We may finally have a name, a face and a country from which a member of the diaspora came to vote in the 2009 general elections.

    I am just speculating but it would be interesting to know more about this guy.We know who he supports, campaigned and voted for. Was he already in Dominica or did he come specifically for the election? How soon after the election did he return to his place of residence? Who paid his fares? Those who have the answers, please clarify. It may just be a case of the pot calling the kettle black. Do you remember the UWP accusing the DLP of bringing people from the diaspora to vote? They had no evidence so that part of their case was thrown out. They may well be presenting DLP with evidence that accuses UWP? Where is an investigative journalist when we need one?

        Last time I checked, many cruise lines have their headquarters in Miami and Fort Lauderdale. Many cruise ships have home ports in Tampa, Alaska, Bahamas and Barbados so cruises can originate from those home ports. I can’t recall Dominica being a home port. Can you? So the ship captain could not have hired Felix while making a porl call in Roseau. He had to follow the normal application process, whether online or in person, and be interviewed by human resource personnel. So although I am not going to call you TI SOT, like you did to me, I still want to know more about this guy. DA’s Wikileaks said that he works with Royal Caribbean. Did he apply at their Miami headquarters? Tell me more! Trouble intended!

      This Wikileaks moron seem to think that the Treasury has to pay for the case now going on. Pay who? The wages to the Judge and Court personnel are fixed whether case calls or not. No one is expecting the Treasury to pay the UWP Attorneys and their witnesses. This never happens. Similarly, Skerrit and St. Jean will have to meet their defense costs.

People that is not how the court works? The petitioners need to prove their case. The Judge always says that the “person is considered inocent untill proven guilty and it is the duty of the prosecution to convince the jurors that the ‘person/s brought before the court” is guilty beyond a reasonable of a doubt.

      Go to school and learn about those things.

What is the UWP’s Legal Team really trying.         Naturally the respondents – This is a civil matter and the Treasury cannot pay for it. They were brought to court as individuals and not as Government Ministers. If they cannot pay Tony then I guess you can contrbute ( you are so interested) or the supporters especially the Old Folks ( whom he has taken care of – remember they pray blessings over him all the time) will donate. If Eddie could get donations when Mamo sued him for again ” a foolish allegations” then why can’t PM / Education Minister not get donations to foot Tony’s bill. Even in the Diaspora , students and all will donate to this bill.

        So you should not worry who will foot Tony’s bill.

        You should be concerned that you learn something from this foolish saga.

      When uwp lose their case,they have to pay both their lawyers and the respondents lawyers fees.The judge has to direct them to pay cost.Total fees is in the region of 350 thousand dollars.Guess they will be back on q95 askink for pledges.
