ECCO sues Island Communications, Krazy Kokonuts

ECCO LogoThe Eastern Caribbean Collective Organization for Music Rights (ECCO) has taken court action against Island Communications and Krazy Kokonuts for copyright infringements.

Chairman of ECCO, McCarthy Marie, told DNO the two companies were served with legal documents two days ago.

“Both companies have been served with the appropriate documents,” he said.

The matter goes back to December 6, 2013 when ECCO filed an injunction against Krazy Kokonuts to prevent the staging of a concert featuring Trinidadian soca stars, Bunji Garlin and Fay-Ann Lyons.

Back then Marie said the copyright organization had contacted the organizers of the concert to inform them that they needed permission from ECCO for the use of copyright music at the concert. He said the response was negative.

The injunction was served but the concert went on as planned due to what Marie described as “technicalities.”

But ECCO has not given up.

“So now we have amended our claim statement and filed an amended statement of claim against the two companies for copyright infringement at the same concert where they had our music played,” Marie said.

He said the legal documents seek an injunction prohibiting the two companies from playing ECCO’s copyright music without authorization.

The documents also claim for damages for any infringements which took place at the concert “and any other relief that the court thinks suitable in the circumstances.”

The songs named in the lawsuit were written by Phil Collins and Terry Arthur, who Marie said are both members of the Performing Right Society of the United Kingdom, to which ECCO is affiliated.

Both companies are expected to file a defense within 28 days.

Marie said it is the policy of ECCO to take similar action within the OECS against “all users of music that refuse, after reasonable entreaties, to take our licence.”

    It seems like on one will be able to stage a concert in DA with Mark Marie suing every concert promoters for copyright. maybe Mark Marie should stage all concerts in Dominica.

    Mr. Marie, I’ve always wanted to know, what happens to the monies that you collect for and on behalf of ECCO? Am I to believe that Phil Colins and the other artists (dead or alive or their estate) receive those monies?

    The saying,” what goes around, come around,” is true. The evil that men do lives with them. Just this morning, Krazy said on Kamala show, he was going after Mat and Q95. He accused them of disseminating wrong information to their listeners. According to Krazy, Matt had made statements to the effect that Kairi had edited a news item concerning Linton and the Ministers of Government involvement in the alleged rape case. Now Krazy has more serious matters to deal with. God is good all the time, all the time God is good.
