Statement by Kieron Pinard-Byrne

I continue to respect the media’s right to freedom of information in the public interest matter of the LOP’s mandatory financial restitution pursuant to the October 12, 2015, Privy Council Judgement.

Social media threats and trespasses cannot alter the legal rulings e.g. “Linton’s demeanor in the witness box was more consistent with personal animosity towards the Claimant rather than an unbiased search for truth. The overall tone of the offending publications also reeked of rancor rather than even handed reporting”.

Thus, the legal record and the public record are ad idem – Mr Linton publicly claimed the head of Kieron Pinard-Byrne on a silver platter. Linton propaganda junkies should meditate on that, at least every June 24th, the feast day of St. John the Baptist, who rests in (fore finger salute) peace notwithstanding his egregious beheading.

There could be no legal mitigation for the unapologetic Mr Linton. Likewise, in a Christian culture Commonwealth like Dominica, there is no genuine general or private absolution absent repentance and restitution for character assassinations of Dominicans from Presidents and Bishops to Commoners like me, names too numerous to mention.

I reconfirm I shall through Counsel invoke the full force of the law against Mr Linton to obtain full and complete satisfaction of the financial restitution judgements against him pursuant to 13 years of calumny against me. So help me GOD; Be avenged; To the victor go the spoils!

    Mr,Keiron, in the first paragraph in your above statement, you aquiesce to respecting the right of the people to know (freedom of information) yet you keep holding hostage the answer to the question, ‘where is the money’? You may now gloat in your victory of having had a favorable ruling in this matter against Mr, Linton; however you fail to realize that this fight involves the people and that the power in All-of-us is greater than the power in any One-of- Us. As an honorable man, who you purport to be, do you believe in justice to the same level that you believe in the freedom of information act? If the answer is negative as it seems, then, the people have won.

    So sad to hear a man embittered like that. Yes, you won your case and mr. Linton will pay. Do you have to sound so vindictive and bitter about being victorious? I am sure you are familiar with the British satirical magazine Private Eye. They have been sued so many times for slander they keep a contingency fund just for that. For them being sued is an occupational hazard. Yet it is very popular and still going strong. You have won A Purrhic victory at best. You won the battle but not the war because from what I can see that Layou saga is still not resolved …… The court did not rule on that.

As this Ceremonial Body, rejected and replaced by the European Court of Justice, has demonstrated. I am wondering in what other country could such financial misappropriation be rewarded: I used to believe it was only in America were colored made to ride in the back of the bus.

      There is a difference between a failed project where it is evident that some level of mismanagement, perhaps even fraud took place. Investigate that by all means, but accusing a particular person who was involved in the project in his professional capacity of illegally syphoning money from the project for his personal benefit without the hard facts and proof is not the same. —-A HUGE DIFFERENCE SIR!

      And since you appear smart and knowledgeable perhaps you can do some national service and assist the less IQ endowed to stop misinterpreting language,facts and events and repeating what uninformed people keep repeating after similarly uninformed people, thus earning Mr. Byrne’s colourful epithet “Propaganda Junkies”

    Mr. Pinard-Byrne, you won at the Privy Counsel but do not expect any congratulations. The fact that you, through your Attorneys, are taking pride in giving a man seven days to pay 80 thousand dollars and further threatening to take the roof from over the heads of his wife and children says a whole lot about you, your heart and your character. You won, yet you appear to be overly bitter and vindictive, proving that you are more guilty than Mr. Linton when it comes to “personal animosity and rancor”.

        You see me, every decision that I make I think of the implications for me and members of my family. If I feel constrained to take an action in spite of the implications then I have to be prepared for the consequences.

        I do not particularly like Mr. Byrne’s response but please do not shift the responsibility for bringing harm on wife and children to Mr. Bryne. It is not right or fair. Mr. Byrne has a constitutional right like everyone else to protect his reputation and other assets and by the way he has a wife and children too who have had to live in and with the allegations made about him for many years.

        If you continue with that line of argument you have no moral authority to criticise the people who defend their leader on the other side right or wrong! It also gives a foretaste of what is to come if the government were to change, so you may not be doing your pm-in-waiting any favours you know. He would be better off with people who give him reality checks!

    My Lord! Mr. Kieron Pinard-Byrne now compares himself to St. John the Baptist!!!! As Mr. Byrne dances around in his living room celebrating his GREAT victory over the committed Dominican patriot, the Honourable Lennox Linton, he still refuses or fails to give a full and comprehensive report on what happened to the Layou Hotel Project and the millions of dollars that was earmarked to finance the same. Of course, the loss of these revenues and the adverse effect it had on our rapidly sinking economy is of no relevance to Mr. Pinard-Byrne. What is most important is that he won, whether or not that win was of any benefit to Dominicans is for you the readers to decide. It is so sad that a black man or woman finds it extremely hard to get a fair shake in the United States, Europe and elsewhere in the “white man’s countries”, but black men and women right here at home will gladly celebrate a white man’s victory in the white people’s court against their own. My God!!!

    What we would like to know did Kieron Pinard Byrne or Tony Astaphan or the Courts received a letter from Mr. Lennox Linton saying that he is not going to comply with the decision of the court . I believe what happened Tony came up with this hurry up plan believing that would halt the information of corruption circling all over Dominica by his administration, they thought let’s try to shift the talk to Lennox instead but it back fired on them. Instead the people of Dominica have decided to let their voices be heard loud and clear by making them know it’s a peoples fight and they are on the move..

    Dominicans are showing Tony and others that the Power is greater in the people than those that are in Government , they started to flex their powers by standing up with Hon. Patrick R. John today he is on his way back to good health.
    I hope Dominicans at home and in the diaspora continue the movement of taking there Island back and teach Tony a lesson he will never forget..

When I read the man said 13yrs Linton been after him, just made me remember the people in Antigua who suffered the same fate. These people cried because just last year after all these years the court ruled that these people did nothing wrong in obtaining their land, Linton hounded them for years too till they ended up in court. The old saying goes when you let people cry like that because they did nothing wrong their tears will fall on you, that’s all I will say. Today you going public and say Mr. Byrne wants to take your house away from you, but when you know you have the Dominicans I spoke of above in your corner you know pity will be coming your.     Man all i hearing is blah blah,,,some Dominicans think that once you go to court and the judge rules against you you are guilty. Giving a guilty verdict doesn’t necessarily mean one is guilty. Not enough evidence to prosecute doesnt mean that the accused is innocent either.

      I listened to an interesting discussion on American TV today. Remember how Obama, as a Presidential candidate was hounded when some people said he was not a born American and not eligible to run for President? Thank God he was able to show his birth certificate.

      Now it is discovered that Senator Cruz a Republican presidential hopeful was actually born in Canada of an American mother and you should hear the spin doctors arguing that he has automatic “American born” status because his mother is American, but so was Obama’s mother.

    You will live a very long time before you see one Dominica plastic nickel out of Lennox pocket.

    The findings and rulings of the British Privy Council is unconstitutional, and is null, and void! The ruling came along when Dominica was no longer a member in the jurisdiction of the Privy Council, we had long become a participant of the CCJ!

    Unless, the litigants, and defendant agreed to accept the Privy councils rulings under every and all circumstances meaning even if Dominica is not within the British jurisdiction; the execution of judgment against Lennox has become null and void!

    Right now that is a matter to be taken into the International Court of law in the Hague in the Netherlands. Don’t be overwhelm yet boy Pinard, it is not all over! A precedence will be set on account of this one!
