James calls for constitutional review

United Workers Party (UWP) President Edison James has called for the Constitution to be reviewed, renewed and revised as it is not the product of a concerted effort by the populace.

James was speaking at a special meeting of the Citizen’s Forum for Good Governance at Harlem Plaza last evening, marking International Day of Democracy as declared by the United Nations General Assembly in 2007.

James said, “The Constitution is not the product of intense, widespread public debates and understanding and participation of the people. Although the Constitution talks about freedom and democracy, I fear that by its construction it has provided a way for unscrupulous men to hijack our democracy. And so I say that the Constitution that we have must be reviewed, must be renewed, and must be revised. The Constitution was given to us over 30 years ago and I think that it is time that we subject that Constitution to a thorough review.”

James also called for administrative and electoral reform and he said there needs to be a review of the responsibility of parliament in a democracy.

“As we talk about constitutional, administrative and electoral reform, we need to look at the parliament and the extent to which the parliament is expected to play a role in maintaining, preserving and modernizing our democracy, what we have here now is a total sham because the parliament is being manipulated by someone who has no rights to be in the parliament,” James stated.

The theme of this year’s International Day of Democracy was “What do citizens expect from their Parliament?” International Day of Democracy was celebrated on 15 September 2008.

    you know…I agree with Mr James…maybe its time we look at that constitution more closely…since ofcourse, Mr. James has recognised the flaw in its construction, we do not want to leave it as is so that unscrupulous men such as himself, can hijack our democracy.

    I am not religous or political. but I agree with you there MR.JAMES. DOminica’s constitution is a joke. Our constitution and laws of Dominica are implemented by some, enforced for some while others get around it. The court system is a joke. Complete review is required. If we want to build a better nation we need to put down politics, religion and focus on education and nation building.

    Skerrit must sink the country in a hole so deep that it may look impossible to get out of… He must sell Dominica then go live with all his money in the other country where he holds a passport for… Yea its true that Eddison should have addressed the matter when in power. The point is we Dominicans should demand that the minister make a choice as to which country he is willing to stay and struggle with if needs be. We don’t want someone who has the option of fleeing legally should such situation arise… And that should be for all politicians.

When the UWP controled parliament and government US CITIZEN Ron Green, former peacecorp() and representative for the laplaine costituency, was part of that team. It was not a sham then because though Mr. James knew that Ron Green was a US citizen and was the proud holder of a US passport which he used to travel, Mr. James considered him a Dominican.

    The sham is Mr. James call for constitutionn review. Big joke!!

      Hello LOPS(loss of power syndrome) a deadly virus concocted in James Lab is the only thing that is not a sham, because he is displaying all the symptoms: anger, greed, rage, restlessness, wrinkles,delusion and hate.     There is nothing wrong with our constitution on the whole. Yes, I have read it from A to Z. The only amendment I would make is to remove the immunity from prosecution of the President, which has no place in today’s age. The divine right of kings is dead and everyone should be responsible for his/her deeds in equal measure before the law, regardless of their station in life.

    It seems to me that the constitution was only established/instituted/implemented when the Labour Party became the Government. It was the same constituition under which the Fredom Party won and governed, the same when Workers won and governed. So what is different this time? I quite agree that some reform/changes are necessary, however its not going to change by making a mockery of the Parliament, its not going to change when you and your crew collect tax payers money and dont show up to work, its not gonna change when those like you only want power.

    It will only change when you all get serious about doing the work of the people and not try to oust ” a democratic elected government” through other means than a democratic election. MAYBE U SHOULD BE REMINDED OF THE RESULT OF THE LAST ELECTION – 18,3.

Like getting elected, getting paid and not attending Parliament simply because you cannot have your way. Like getting elected and while u are an elected member u are working in the USA coming back just to register present at House of assembly meeting and before the session is over u are back in the USA clocking in for work.

    But I must say better late than never, attempts have been made at reviewing the constitution but because of ploitics nothing happened. The ungoing dual citizen court case revealed that both the UWP and DLP fielded candidates in the last election that might not have been qualified because of dual citizenship. This has been going on for years, perhaps since 1980, but it only took poor loosers disgruntled politicians to bring this matter to court even if they were themselves guilty..again I welcome the call for consttutional review.

    I really don’t mind a review, renew, rewrite, amend or anything of that nature. As long as it makes the constitution better. But i must ask, is this not the same constitution that was here when uwp was in power? And did they not have the same dual citizen people in office? That’s my only problem. I can understand uwp have valid points, but it is hard for people to listen to those points when their members did the exact same things in office. And now that the tables turn and it doesn’t suit them, they refuse to let anything go. And I agree, we need to make sure that no political leader or member of office has dual citizenship. End of story. But the hypocrisy is sickening

    Constitutional review or reform is really not an issue that should be tainted with a political partisan approach. As a nation evolves and matures it is important that from time to time that this very important instrument is revisited with a view of making it more relevant, fair and just to all the citizens of the state. I may not always agree with the former prime minister but on this issue this is certainly not a fight to be belly aching about. It is time to reflect on how much have we grown as a nation after almost 33 years of nationhood,are we maturing to be more toleraant and respectful to othetrs who have a different view to us and still be respectful to them. This will only help us as a nation to be more informed in making important final decisions that will benifit us all as citizens.

    It is a good idea to have a constitutional review but we must be careful what consttutional amendments are implimented. It must not be a simple reaction to the dual citizenship fiasco. Party leaders probably have their sight set on candidates with dual citizenship.

    While we may entertain simpler methods for citizens in the diaspora to vote, we must continue to demand that our leaders bear allegiance to Dominica, and Dominica only. We may live to regret it if we lower the bar. Birth right should play a crucial part if we need to be flexible in that regard.

    After all, US Presidents must be born in the USA. We may end up with a Chinese President and Prime Minister one day, if we rush to act on our political impulse. Please make sure we adhere to stringent checks and balances, otherwise, we will become second class citizens in Dominica while economic citizens are treated as being first class. The operating word is CAUTION!!!

        The racist South Africans came from Europe and they took away all the land and resources from the native Africans making them second class citizens in their own homeland. That’s exactly the point I made above. Europeans said that Blacks were INFERIOR. Nobody is saying that Chinese are inferior. The mere mention or disagreement with another race does not make one a racist. In fact, I am in favour of the relationship with China, but at the end of the day, Dominicans must rule Dominica! The Chinese are our guests and they must be treated kindly but we must never let them dominate, otherwise we will be like Tibet (the country).

    I REALLY CANNOT BELIEVE THIS !!!

    I sit with my mouth open reading this. Does Mr. James, as well as so many of these posters on this site, not remember that we have had TWO constitutional reviews of the Dominica Constitution. INCLUDING ONE DIRECTED BY MR. JAMES WHEN HE WAS PRIME MINISTER! And the respective governments of the day, DFP and UWP did nothing about the recommendations.

    Let me hand over to the President of the Commonwealth of Dominica, Dr. Liverpool, when he addressed the House of Assembly on Thursday 10 July 2008 on the topic “Constitutional Change and Advancement”. He stated:

    “Since Dominica attained independence in 1978 two commissions have been appointed to review the Constitution. The first presented a report dated August 10, 1983 but no action was taken on the several recommendations which it made. In 1997 a second Review Commission (the Telford Georges Commission) was appointed. It reported in February 1999 and made extensive recommendations for reform. No action has been taken on any of its recommendations.”

    So you see. Does Mr. James forget? Do our so called educated posters forget? Edward Le Blanc was right when he said “Domnijen ni memoir poule, you ka onbilyay vite!” (Dominicans have the memory of chichens, they forget quickly.)

    Yesterday marked the fourth aniversary of International Day of Democracy as decleared by the United Nations General Assembly in 2007. With Democracy being such an important subject in world politics today, I was rather shocked that neither the Prime Minister nor Goverment ministers addressed Dominicans yesterday since we are still suppose to be a democratic nation. It had to take the Citizen’s Forum and other concerned citizens to remind us of that.
    What does the silence of the nation’s prime minister and his administration on such an import day say to us? Since he did not address us and said nothing, than I am left to wonder if the following might not be his reasons:
    1. Because he knows that we no longer have a democratic government.
    2. Confirmed that his style of leadership has more to do with DICTATORSHIP
    3. Afraid of causing offense to other dictators like Chavez, Castro, China and Gonsalves.
    It is not too late and I hope he just forgot the date since he had such a busy week at the court listening to people lie for him.

        BUWO I am very embarassed to write this name “BUWO” because it does not speak well of a person. To me it is like someone changing his given name to ‘Satan’ and that’s not who you are.

        To your response, I am not concerned about the USA because according to you, the world knows they are the stalwart of democracy and they really do not have to do anything to proove it. In our case, Skeritt needs to prove to us and indeed the world that we are still a democratic country because of his style of leadership which is very similar to that of Chavez, the old Castro, Gadafi and others. My point is, yesterday was a good opportunity for Skerit to proove to us that we are still free after statements like “All you too free” and his associates.

        You see, a woman does not always expect her husband to say “I love you” to her for her feel loved. But there comes a point in their relationship when she just needs to hear that especially when the man’s name is all over with other women. I hope you understand my point. It’s not the US or elsewhere but Dominica, based on statements made by the nation’s PM.

      We had our Democracy Day on December 18th 2009 and the UN and Dominica won by 18-3 and the 3 have refused to go to Parliament and the UN is telling these 3 Little Boy to please go to Parliament to represent the Democratic Right of the people that elected them. But these 3 little boys keep acceptin the tax monies of the people and then in return they tell their constituents o pound salt.

      Sir,

      Whilst I am not sure how many observances have been held, yesterday was not the inaugural day for observing that particular day. Since it was not the first observance of Democracy Day, the question remains, why is it the first time that the opposition is observing that day when they have been crying fowl about our democracy for a decade now.

      On the matter of Skerrit being a dictator. That too is laughable. Question. In which dictatorship, anywhere, where a dictator is summoned at the last moment to appear in court , the results of such court proceedings could determine whether he continues in his position, and the dictator has to run for a lawyer just like every other citizen to plead his case? Is there another dictatorship anywhere now and in history where such a behaviour is tolerated.

      Let be hinest with our conscience. As Prime Minister Mr. James commissioned a review of the constitution. The commission fro reviewing the constitution met, held meetings with citizens, convassed their opinoons and submitted a report. For eight or so months, Mr. James did nothing with the report. Instead he went on and attempted to “manipulate” the boundaries of three or five constituencies just to give Prevost in Roseau, teh Francis girl in Petite savanne and the Hunter man in Paix Bouche the advantage over three incumbents. he attempted to make large constituencies larger and small constituencies smaller. That was the extent to which Mr. James sort to lead an electoral reform program. You will understand the hatred that Mr.james has towards Tony Astaphans for it was Tony Astaphans representing Urban Baron (now firmly in Mr.James’ company) who went to the court and reversed or frustrated Mr. james’ brand of electoral reform.

Infact you could even go online to check when last a dictator was summoned to appear before the court. You call that laughable? Your statement is not just laughable but is unbelievable. Are you trying to imply that Mr. Skeritt was summoned to appear before the court at the last moment? You must be out of this world! You mean to tell me that Mr. Skeritt did not know he had to appear before the court until last moment when he was served notice? I know you meant to say that he had been running from it. How could it be a last moment thing and his attorneys, witnesses, secuity were all ready ahead of time? Your statement is very misleading and such statements will continue to keep our country in darkness.

        Wasn’t Saddam Hussain, another dictator given a chance to defend himself before he was executed? The difference between the two are: 1. Dictator Saddam as bad as he was, spoke and testified with his own mouth so that the public could get his side of view and then judge unlike ours here who played his cards in such a way to ensure that he does not testify and incriminate himself. Instead he allow others to incriminate themselves for him.

        One reason why addressing the nation was so import for the PM yesterday is because most honest people both at home and abroad feel very strongly that our democracy is quickly taken from us. By his refusal to affirm that democracy is still alive and strong in Dominica went very far in confirming that we have lost it under Skeritt. No excuses!
        Democracy is different from an election result which went 18-3. Democracy is freedom to express yourself without any sense of fear of victimization. When you cannot express yourself freely because you are afraid that your job will be taken or you might be demoted if not secretly executed then you do not have Freedom and that’s what we mean by democracy. To proove me wrong, go and listen to the interview of Ian Douglas on the character of Mr. Skeritt and see how he had to quickly make a Uturn.

    I am just a young man in my early 20’s pursuing higher education in law, and as a Dominican, I’ve always felt that the constitution of DOMINICA needs revision urgently! I have been speaking about and repeating it a lot of times. I am a labor supporter from a very tender age, but I believe that Mr. James is now making some efficient use of his time. I do not need to read the rest of the article cause the media can be (we all know). But Asking for a revision of the Constitution is a great move and I SUPPORT IT 110%.

        thank you Sout man, but I would have welcome your input on the fact that the Ron Green did not have a Dominican Passport since he was 17 years old yet he was in the House, Earl Williams was born in England, I am sure he never gave up his EEC Passport, and he was in de House, but I guess that is OK, because they are not or never will be PM of Dominica.

      I agree with Mr. James that the Constitution needs review. When we have people running for electoral(public) office saying that “No Constitution can prevent me from being nominated for elections”,then if the Constitution cannot be respected then why have one?. It is no wonder that Dominica has degenerated into this atmosphere of lawlessness because its leaders disregard the Supreme law of the land and others defend this disregard of the Constitution. If one can disregard the supreme law of the land then disregarding the lesser ones shouldn’t be difficult at all.

        That review must also include a provision for elected members of parliament not taking their seat for more than a year. It must also state that any prospective member vying for the position of Leader of Opposition must have a tract record of participating in the parliament subject of course to other qualifying standards. We have a Leader of Opposition who after more than a year in the position has not made any presentation to the parliament except to take an oath. That too cries out for constitutional review, mr. james. you must allow the young man to say soemthing in the House. You are denying him that opportunity only to come back for your party. but we in Bawie are watching and waiting to see where your heart is.

    This is why I don’t like politicians. Always when they are on the outside they see what change is needed but when they are elected they suffer from a sudden onset of amnesia.

    Those in the know have been calling for constitutional reform for years. Like it or not, Mr. Gabriel Christian and Thompson Fontaine were the most vocal people in this regard but no one including Mr. James listened. Now he here braying like a drunk donkey. Having said my piece I fully support the call for Constitutional changes once again.

    I think that sitaution was a reality check for mr James and that Mr Skerrit have been listen to Matt when he says IT IS BETTER TO BE THOUGHT OF AS A FRENCH MAN THAN TO OPEN YOUR MOUTH AND REMOVE ALL DOUBT. We really do need a review.

    I for one think that the speaker in the house need to go! then there needs to always be two parties in the house with equal amounts of seats so that any affairs of state will be debated in forum between those in position and opposition. our parliament needs to act as the deliberating and discoursing body of the state. and just as an individual needs to have balance so too does the house of representatives, which is what any true democracy entails. on another note, it is sad to say that the men we look to as our leaders both in position and opposition, don’t understand that RIGHTEOUSNESS means doing the right thing even when nobody is looking. can we trust our leaders to act RIGHTEOUSLY? i say we need a Martin Luther King.

    I do concur with Mr. James that it is time to revise the Constitution. More than 30 years since political Independence, we see shortcomings in the Constitution: inadequate checks and balances, lack of clarity on some important matters, non-inclusion of some important matters,too much power in the hands of the Prime Minister and very little for the Head of State.

    We have had two Constitutional reviews, and there has been no follow-up action. A new review should include mechanisms for implementing agreed changes.

      i concur with your comment as well…….particularly as relates to the mechanisms of identifying and implementing the changes that are needed. i dont think that this should be governed by any political body but by an institution for the people and by the people… and by the love of god we need a body to govern the financial aspect of governance, the PM should not be the financial controller of the state. that is a recipe for disaster…

    It’s about time! Surprise, surprise… guest it did not suit your administration at the time, when it was called for back then? Sir, this was brought up during your rain, and you said or did nothing to address it them; however, again a review is needed, better late then never. Let’s hope those in authority will not call for it when they’re out of office.

      If I do recall correctly, the UWP Government did in fact appoint a Constitutional Review Committee headed by the outstanding jurist Telford Georges.

        Let us not fight over this statement regarding constitutional review,It is a fact that work was done during the UWP fellas reign in gonvernment, let us not fight dem fellas on things that we cannot win. It is A FACT that Telford Georges and some other workd on a review of the constutution of Dominica in the late nineties. so let us agree that they made some effort in that regard

    1st amendment is the clause which says a born , raised and living dcan, although holding dual citizenship can’t run for public office

      The constitution already contains a clause the prevents dual citizens from holding elected office in this country. Hence the petition against Messrs St. Jean and Skerrit.

    we need a review… can’t have a francaise playing hop scotch with us… while spotting a bright smile… i remember when i began posting on dno… in order to seperate the sentences to make it readable for i use to write pages back then… i used (…..) for it made it ‘cool’ and understandable for blogging… i was called foolish… ignorant blah blah… so no one else used it… that was my ‘trademark’… but i see a bunch of ‘new’ bloggers hijacking my trademark without showing just due… some off my head are…tiny,, queen,, femme dominique,, yes irie and sweetness… though i appreciate the following… show some respect… so all u have to do… is simply put a reply saying ‘we adhere and acknowledge u MASTER MOTS’

    Where was James about 8 years ago, someone please tell me? As the Prime at that time he had the opportunity to review, renew and and revised the constitution. And he choose not to. We Dominican are not foolish as he may want to let us believe. The grapes must be very sour now, seeing that it is in another ones mouth.

      you need a 2/3 majority to revised the constitution. You all Labour people turning everything red or blue. The PM can only make a call for a review but to get it to actually hapen you need 2/3 majority.
