Linton, Blackmoore clash on protest action

Opposition Leader, Lennox Linton has responded to comments by Justice Minister, Rayburn Blackmoore as it relates protest action on the island, saying Dominica’s Constitution guarantees civil liberties to citizens.

“A Minister of Government spouting such uncivilized foolishness in 2015 is indeed a disgrace to our humanity here in Dominica,” Linton said.

There have been a few protests in Dominica recently.

The UWP staged protests outside the office of the Electoral Commission demanding answers on the result of the seat in Grand Fond following the general election last year. Linton had also led a delegation to deliver a petition to DASPA boss, Benoit Bardouille, on behalf of Vescort Jones who was fired as a port security officer on December 10, 2014.

Also recently, bus drivers plying the Marigot to Londonderry route held protest action near the Douglas Charles Airport, complaining that seawater was invading the road nearby, causing damage to their vehicles and demanded that government do something about it.

Blackmoore said on state-owned DBS Radio that these actions were attempts to “to provoke the state into an overreaction and create a 1979 situation.” He said “unlawful” protests will not be tolerated in Dominica and the government will clamp down and prosecute those responsible for staging them.

But Linton said the Constitution guarantees certain civil liberties as part of the island’s practice of democracy.

“The Constitution of Dominica – the supreme law of the land – entitles the citizens of this Isle of Beauty, this Isle of Splendor to fundamental rights and freedoms including but not limited to the right to life, liberty and security, protection of the law, freedom of conscience, freedom of expression, freedom of assembly and freedom of association,” he said.

He continued, “So it is that we join the rest of the free world in the enjoyment of civil liberties as part of the practice of democracy. These civil liberties are personal guarantees and freedoms that Skerrit, Blackmore and company cannot tamper with, either by law or by judicial interpretation.”

According to the Opposition Leader, Blackmoore sounds “angry and gives the impression that he is holding grudges against, and would therefore like to harm those who embrace the civil liberties that define our democracy.”

“Tell him to take it easy, show some respect for the constitutional rule of law,” Linton said.

Linton also advised Blackmoore to read the following quotes from Proverbs in the Bible.

-Those who guard their lips preserve their lives, but those who speak rashly will come to ruin. Proverbs 13:3

-Wisdom calls aloud in the streets, she raises her voice in the public squares; she calls out at the street corners, she delivers her message at the city gates. Proverbs 1:20-21

-Speak up for those who cannot speak for themselves, for the rights of all who are destitute. Speak up and judge fairly; defend the rights of the poor and needy. Proverbs 31: 8-9

-Be not wise in thine own eyes: fear the Lord and depart from evil. Proverbs 3:7

    It’s a sad day in DA.Blackmore you need to more deplomatic with your words.You know fully well the DPF is not capable of taking on the masses.As your ex course mate you must choose your words wisely.You are basically daring people who live in a democratic society.Reminding someone of a bad experience only strengthens their resolve.Protests are a part of a free society,as long as it’s done in the right way.We only have one security force.Use it wisely.

    Blackmoore quickly referenced 1979 in his response to bus drivers protesting unsafe road conditions during high tides and rough seas in the Marigot area. It is quite obvious that the bus drivers in question simply wanted an answer or possible solution from the government regarding this stretch of road.

    How do we equate their actions with the events of 1979? I believe that Blackmoore is the real agitator here, by referencing 1979. Let the bus drivers know what methods or plans that the government will implement to solve the issue and they will return to work peacefully. We should not create phantom issues that do not exist.

    Since Blackmoore made reference to 1979, maybe he needs to be pulled aside by President, Charlo, for a lecture of the events leading to 1979. Furthermore, Charlo also needs to remind Blackmoore of how we (back then I was a laborite) protested downstairs of then PM, late Dame Euginia Charles building on Hanover street, since Charlo was on the other side of the fence back then. Charlo needs to remind Blackmoore how we laborites washed our hands in the face of a former government minister who served on the same side with Savarin. Charlo, educate this little boy and tell him to shut it up ………….

        A peaceful demonstration in order to affirm something positive is one thing. A protest is sometimes quite different.

        Most Dominicans would rather not protest unless they feel thy must do so in order to grab the attention of the government to effect what they think is a change. This does not make them cowards.

        In my country (Canada) there are trouble makers who never miss an opportunity to stir the pot. They have nothing better to do, not even a worthwhile recommendation to offer. In the end they become part of the problem.

        If a change is perceived necessary an intelligent well written petition signed by a significant number of voters is usually more effective than a public protest. The reasons are (1) A protest draws the curious, the ill informed. and the rabble rousers. (2) A petition gets the signature of people who are not afraid to be identified, and are willing to speak for the cause.

Let me tell you: It is a government in which the supreme power (the people) has an unquestionable right to the possession of the people’s property in this case: (Dominica), this gives the privilege to the people so that they may exercise their rights directly through a system of representation which involves periodically held free ELECTIONS.

    What is “unlawful” protest, are we talking about the disruption of the public? The rights of the public to conduct its affairs limits the nature of protest action. Peaceful, non-disruptive protest cannot be unlawful in Dominica given the present constitution. Therefore, I must assume that the minister is referring to public disruption.
    I would have thought that this mistalk would have been explained to the public by now. What does the minister mean when he used the term “unlawful protest” Someone in the press should have asked him to explain.

    Linton knows fully well that he needs a permit for his so called crab backs yet he takes,farmers crying about take,take,and take,land take,no one cares about asking or applying.Blocking roads and causing obstructions means the innocent suffer,If you request for permission,other people will know this taking place and find alternative routs to get themselves to school or get to and from work.To stop these takings we have to start somewhere,well done to Mr. Blackmoore. we cannot build an airport over night $196,000,000.00 one hundred and ninety-six million dollars

And the second is like it: ‘You shall love your neighbor as yourself. On these two commandments hang all the Law and the Prophets” Matt. 22: 37-40

    Jesus called those two commandments the “New Command” as He continued to stress on the call for us to love one another. Where does “demonstrations and protests fit in the attitude and conducts of Love–the activity which causes nothing but unrest in peoples minds?

    this comment is in response to people like zuma, observer, wow, truth, and real possie, I am wondering what world you all are living in. certainly not the same one I am living in because the more I try to understand your comments the more confuse I get. to the observer in America there have been and there will continue to be spontaneous gatherings for the purpose of demonstration. that is a as it is so often called a god given right. in a free democracy those rights are protected under the constitution of the land. for people who claim to be god fearing why is it that you seem to fear man more than god. if god is the supreme one the we need to re examine our thoughts and beliefs. to zuma ,wow, truth and real possie you need to do some reflecting upon yourself and stop being misguided by party politics. some one has to stand up for the little man just as Mandela, Martin Luther king Jr, Gandi, and others has done in the past. not that Linton is being compared to any one of these men.

    After all we have very experienced and proficient trained lawyers within the ranks of the UWP. There are also very senior police officers (retired) who, whilst in service advanced the virtues of adhering to the Public Order Act. There are times when the people do take things into their hands and the State is forced to act. Is that what the recent protest actions were meant to do. To force the State into taking action, over react perhaps (which is very doubtful today given the allegiance of the police to the UWP) and thus land the UWP with a cause for civil unrest? The UWP was so unsure of what it was supposed to do after the election results in Grand Fond that they did not even lodge an election petition to challenge the results based on the countless irregularities they say took place in Grand Fond. Are they serious about law and order or they are speaking to certain elements among them. People respect the laws. Skerrit did not pass the Public Order Act. He met it there.

Those who propose that they can gather and agitate for whatever, wherever, whenever and however they wish they are only insighters of public mischief. It cannot be that because I have certain rights – freedom to associate however and wherever I wish, I have the same right to storm parliament or the PM’s office or indeed gather at the entrance to the home of Mr. Linton. (just an example). I would be totally out of order, acting illegally and the law ought to deal with me. It is Mr. Linton himself who said during the campaign that the country is governed by laws and everyone is expected to obey those laws. In the absence of which there will be chaos. The greatest demonstration of such a truism is when Mr. Linton went to the State House, stood before an “illegal President” and took the oath of office. It could not happen any other…

      You need to ask yourself when and why we have a”public order Act” in case you are unaware let me inform you that we have such an act because like now, we hero worshiped a leader and turned a blind eye to suppression of our democracy. I am happy though that at least one person recognises that. Where were those persons like the current illegal president to prevent this act from coming on our law books? He was conspicuously silent while enjoying ski trips and other perks. He forgot that one of his reasons for closing down the country was the passage of the same “public order act” so why am I making this point? Well it is to help us guard against further denials of our rights by a government and leader who we adore.

    Well Blackmore can come and all who support him because people up this side don’t have what he and others have. Lennox doing what any other parl rep would do, support his people. Lennox was not even informed prior to the action. The commuters were just fed up that morning and when people noticed what was going on they came on board. So we ready for 1979.

    I suppose one qualified for a justice minister position in government, would have some knowledge of the nation’s constitution. Begin a former police, might not be enough to be in government, never mind to be called justice minister. Some of us are aware of the British Magna Carta, written eight hundred years ago. After eight (800) years, the British campaign to reassert Britain’s Christian heritage on the 800th anniversary of the signing of the Magna Carta.

    The Magna Carta is the 13-century document enshrining the rights, privileges, and liberties of the then clergy, and the British nobles eight hundred years ago. It is also considered a founding document for human rights. Basically, British, laws, and for that matter all laws, especially in democracy’s are based on the British Magna Carta. Any lawyer who is a lawyer in Dominica should be aware of that, so too should a justice minister. The best thing for Dominica at the moment is to call a general strike, shut the island down…

    Fragility with Dominica’s Democracy will always be maintained because of the quality of scholarship permeating the country. As long as this quality of reasoning is prevalent in the culture, there can be no improvement.

    It seems like Dominicans always had it in reverse gear. It is not the party in power that has driven progress it is the opposition. But we have supported every type of wrong and kept voting for people who do nothing for us, so they will keep doing nothing.

    Now that a voice is trying to educate the masses, the masses themselves are angry because they do not want to change even if they have nothing to show for their efforts.

      I’m so happy Mr.Linton can read, understand and appreciate the Constitution and the rule of Law, Blackmoor is not going to be allowed to run block around those documents just to prove a point, he’s trying to use the Constitution to suit himself whenever he wants, but he doesn’t believe in the Law so who is he trying to fool. I agree he is angry and he is the person who is pushing the people into confrontation so they can get the police to shoot at them I hope the Police understand what they are doing but we will not buy into it because we do not want anyone to get killed and we are not going to repeat what happened when the president was leading the people in 1979 today he is president only in Dominica that could happen. So I would suggest to Blackmoor to stop behaving as a brat and do the work he is elected to do, reach out to the people and work with them instead of a heavy handed attitude.
