Antiguan judge says Dominican police obligated to probe Choksi’s kidnapping claims

Dominican police are obliged to probe Choksi’s claims that he was taken to the country against his will.

That’s according to an April 14 court ruling handed down in Antigua and Barbuda.

The judge also ruled that Choksi can’t leave, or be removed, from Antigua and Barbuda until he exhausts all his legal remedies.

The court went against the defendants’ claims that Choksi’s claims were “frivolous, vexatious, and an abuse of the court’s process”.

Choksi, an Indian businessman is accused in the Rs 13000-crore Punjab National Bank fraud case.

He had filed a civil lawsuit arguing that there is an obligation on the part of the defendants, the Attorney General of Antigua Steadroy Benjamin and the Chief of Police Atlee Rodney, to carry out a thorough inquiry and that he has an arguable claim that he was subjected to inhuman or degrading treatment or punishment.

The wealthy businessman insisted that an investigation be made into his claims that he was kidnapped in inhuman circumstances on or around May 23, 2021, and reportedly sought relief from the court and demanded a prompt judicial or a police probe into “the circumstances surrounding his forcible removal from Antigua and Barbuda”.

While hearing Choksi’s plea, the court in St Johns prohibited his removal from Antigua and Barbuda without the court’s approval, subject to an inter-party hearing and exhaustion of all legal remedies by Choksi.

Choksi maintains that he was abducted from Antigua and Barbuda and taken to Dominica forcibly in a boat on May 23, 2021, allegedly by officials of India.

He was charged with illegal entry into Dominica but the charges were later dropped.

Based on Choksi’s petition in Antigua and Barbuda, Interpol had also withdrawn its Red Notice against him, setting back the plans of Indian enforcement agencies to extradite the absconding diamantaire.

    I was speaking to family members about that case, interestingly my 10 years old nephew said to us. “So if Choksi is a prominent business man then why does he have to travel to Dominica illegally furthermore on a boat at that time of the day?
    I say to him, boy, you are wiser than the courts, the police, the pm of Antigua and Dominica and every other persons that who speaks for both governments again Choksi.
    In summary, they are all corrupt and should go to jail for their actions

    I will say again. The leadership of the police force needs to resign if they have any integrity. Corbette cannot be in charge of an institution that is responsible for law enforcement and find himself involved in criminal mischief at this level. It is beyond belief. The police force belongs to the people of Dominica and he needs to be relieved of his duty.

    The judge is asking the Dominica police organization to investigate themselves. What good can become of this?

    The police have fallen out of favour with the public. They lack credibility, integrity, good judgment, ethics, morals and common sense.

    What we have presently pretending to be a police organisation is a gang of uniformed criminals.

    Seriously, in my honest opinion, Dominica does not have a real police service. The investigation into Choski’s kidnapping is dead before it begins.

    This situation calls for independent investigators. Why? Members of the hierarchy of the CDPF are implicated in this fiasco. It’s thugs investigating thugs.

      There are many more important things to be attended to in Dominica. Choksi is still wanted by the Indian authorities the removal of the interpol red notice changes nothing. Choksi has found a temporary safe haven in Antigua and a friendly judiciary and he is playing the system like a virtual fiddle. Choksi as of now outsmarted the Indian authorities and is now making a fool of our judicial system.

        Choksi isn’t playing anything. Antigua tried to play Choksi and lost. Its all on their heads, If they allowed justice to take its course that would not have happened . Instead they kidnapped the man, violating his human rights and made him a hero.

        Choksi is not the problem here but corruption is. Today Choksi tomorrow whom? If this charade was successful you can imagine how many other people would disappear at the whims and fancy of politicians?

        Choski’s alleged wrongdoings are not the main issue here. It is the kidnapping by three rogue regimes. Why do we have a judicial system? !eh these highly paid lawyers magistrates and judges dispense justice to every one who is taken before the court. No court, not one in this world, has found Chosen guilty of anything.

    If any Punjabis have a vested interest in the sale of Dominican citizenships it would not be unreasonable to surmise that they would collude with their fellow Indians and Dominicans to engage in a plan to whisk Choksi away from Dominica’s territory to India before anyone noticing, if only to curry favour with the latter’s government. Unfortunately for the schemers, not all players may have been equally competent, with the plan unravelling and some greedy jackals missing their reward, at least for now.

    Sorry folks if is Dominican police that are to probe Choksi’s claim, i have given up!!
    I have 0% confidence in the present CDPF.
    Had it been 30 or 40 years ago, policemen with ZERO political leanings would have fearlessly done their job, letting the chips fall wherever they have to. Not today in 2023!
    I really thought the Metropolitan Police were the ones in control…!
    Dominican Police?????? Give me a break!!!

    The Government of the Commonwealth of Dominica and the Commonwealth of Dominica Police Force were openly complicit and participatory in Dominica of the Antigua kidnapping and smuggling of Chocksi to Dominica, and that is the root of this problem.
    You have a rogue criminal government and rogue criminal police force in Dominica treating a victim of a crime with such disdain and inhumanity which is typical of Dominica today, no human rights. As Prime Minister Roosevelt Skerritt has said, “no law and no constitution can stop me!”
