A UK court has found that fugitive diamantaire Mehul Choksi presented no concrete evidence to support his claim that he was kidnapped from Antigua by Indian Agents in 2021, “while ordering him to provide security for legal costs amounting to £600,000,” an Antigua.News article reported.
Choksi is a citizen of Antigua and Barbuda under the Citizenship By Investment Programme (CBIP).
“In an order obtained by Times Now, Justice Mansfield noted that Choksi’s allegations were largely supported by circumstantial evidence and lacked independent witness testimony,” Antigua.News further stated.
According to the judge, unsurprisingly, there is no witness evidence as to the kidnapping and assault of the Claimant, other than that of the Claimant himself.
The article went on to add that, “while acknowledging that circumstantial evidence can be persuasive in conspiracy cases, the court said that at this early stage of proceedings it was difficult to assess the strength of such claims without fuller examination of the evidence.”
“Choksi’s London-based counsel, Mr Fitzgerald KC, had argued that ordering security for costs would be unjust, claiming there was strong evidence that the defendants were part of a conspiracy to abduct, torture, and forcibly render Choksi to India,” the article continued.
However, the court was not persuaded.
The ruling stems from a lawsuit filed by Choksi in May 2024 against the Government of India, four non-resident Indians, and a Hungarian woman. He alleged that he was physically assaulted and mentally harassed after being abducted in Antigua and Barbuda, before being taken by boat to Dominica.
“In support of his case, Choksi relied on an Antiguan police report prepared by Inspector Adonis Henry in June 2021 and a witness statement from private investigator Oliver Laurence, who was hired by Choksi’s family,” Antigua.News added.
The court observed that both documents relied heavily on second-hand accounts and documents reviewed by others, rather than direct witness testimony.
The article also explained that Justice Mansfield further noted that the police investigation in Antigua did not progress beyond the initial report.
Choksi’s legal team contended that the probe was halted due to alleged collusion between the defendants and the governments of Antigua and Dominica—”claims that are the subject of separate legal proceedings filed by Choksi against the Antiguan government.”
The UK court also referenced earlier rulings in Europe. Both the Antwerp Court and the Court of Cassation had previously concluded that there was no evidence to substantiate claims that Choksi was abducted by agents acting on behalf of the Indian government in May 2021.
The UK proceedings are ongoing, with the security for costs order standing as a significant financial hurdle for Choksi as the case moves forward.
The only people who believed CHOKSI was kidnapped are the blue ignorant clowns in Dominica.Just imagine those blue clowns are led by a man who is above 65 work all his young life and have nothing to show.No wife,no children,no legal land,no job and no house, another choksi.Thats it,the blind leading the blind. The blue clowns will say”they buy de court” in the CHOKSI case.
I wonder how Q95 and that Durand fellar who is now publicly wed to Joshua’s party will handle this one?
All the blue Dominica puppets who supported CHOKSI are one and the same, habitual criminals, rogues, vagabonds, arsonists, peodophiles, crooks and traitors.Criminals always support and defend criminals. Investigation revealed Choksi family knew he had left Antigua to avoid being sent to India, but they thought he had gone to Cuba.It was when he arrived in Dominica and was taken into custody he came up with that kidnapping bs.
You know when I hear this I laugh, and ask myself are the so-called legal practitioners of Law in Dominica going to pay attention to such findings, and start questioning their analytical skills and curious observation, it’s so funny even on this forum when you read some comments evidence is not something considered when making statements. I hope this finally brings closure to this matter, but let’s not forget this https://www.nationalheraldindia.com/international/total-nonsense-dominica-pm-on-claims-that-his-govt-was-involved-in-choksis-abduction.
I have lost every bit of confidence I had in the judicial systems around the world. Most courts these times are not longer the arbiters of justice.
The evidence of a kidnapping was voluminous. Did Chilli stage his own kidnapping? What did he stand to personally gain if he had done it? This judgement, if true, smacks of insanity. This judgment is profoundly wrong.
If the decision had gone the other way you would have been jumping for joy and full of praise for this same judicial system which you claim you have lost all confidence in. You are such a hypocrite.
Yes.. because you sat in the courtroom … listened to the evidence … have the expertise to interpret such evidence… and have extensive knowledge of the law pertaining to the matters in the case. Your sense of presumed knowledge is, to say the least, bewildering.
@Ibo France
OK…Mr. Kings Counsel(KC). 🫡
Don’t confuse your “conspiracy theories”🤔with “concrete/hard evidence.”⚖️
Heheheh! Oh, you know that he does.
Stop your silliness about quote, “I have lost every bit of confidence I had in the judicial systems around the world” who cares about your opinion. Why make general statements about most Courts, these times are not longer the arbiters of justice. Your problem is, Justice has to be handed down to appease your partisan political beliefs, the evidence of my accusation is with the pattern of your comments on this forum. When the Government is vindicated in a Court, it’s not Justice, but when they are found liable, that is justice for you.
So why did the Government of Dominica arrest Choksi as the victim, instead of arresting the boat people who trafficked him from Antigua to Dominica? Why did the Government of Dominica not arrest and charged the people on the boat that brought Choksi from Antigua to Dominica? Why did we allow the people who brought Choksi to Dominica to sail away scot-free?
And didn’t the Government of Dominica explain at the time that they had a request from Indian Government authorities to extradite Choksi to India? Maybe the Government and/or the Police Commissioner of the Commonwealth of Dominica should be called as a witness?
@ Truth be told, do you know what evidence was presented to the court in London. Allegations must be supported by evidence and too often we bush lawyers consider popular opinions to be evidence. Choksi made Allegations for which he provided no evidence, that does not mean that no evidence existed to support his claim, they might have just forgotten to present it to the court.
The Government arrested Choksi for illegal entry to Dominica. Your claim that he was a victim, why did they not arrest the boat people who trafficked him from Antigua to Dominica, what you’re claiming and suggesting is based on hear say, you were not there on his arrival, you do not know the facts. Did you read what the Court said, Mehul Choksi presented no concrete evidence to support his claim that he was kidnapped from Antigua, as to the boat people you’re referring to, you do know the facts what took place on arrival and why the authorities did not charge
them.
It was not only this Court who found Mehul Choksi presented no concrete evidence to support his claim that he was kidnapped from Antigua, A UK court also referenced earlier rulings in Europe, the Antwerp Court and the Court of Cassation had previously concluded. You see, your problem is you did not read the above story but fixated with what was said in the public arena, not so in a Court, produce evidence
