Land dispute ends in violent altercation between 67 and 74-year-old men

 

Two men from the north, 74-year-old Cuthbert Benjamin and 67-year-old Peter Edrick Benjamin have been granted bail following a land dispute which escalated into a violent altercation, with both men inflicting cutlass wounds on each other.

The pair appeared before Magistrate Michael Laudat at the Roseau Magistrate Court on August 17, 2023, charged separately in connection with the said incident.

According to the charge by the police, on August 1, 2023, Peter of Savanne Paille caused Grievous Bodily Harm (GBH) to Cuthbert at Tan-Tan. During the altercation, Cuthbert suffered severe injuries, including the loss of his thumb and index finger on his right hand due to the cutlass wounds.

When the charge of GBH was read to the accused, he was not required to enter a plea since the matter is an indictable offense, expected to be tried at the High Court before a Judge and jury.

In response to the said incident, the police have also preferred a summary charge of wounding against Cuthbert. It is alleged that on August 1, 2023, in Tan-Tan, Cuthbert wounded Peter, to which he pleaded not guilty.

At the hearing, Police Prosecutor, Sergeant Vivian Augustine did not object to bail for the men.

Peter Edrick Benjamin was released on a $25,000.00 bail with one surety and reporting conditions attached, whilst Cuthbert Benjamin was granted bail in the sum of $5,000.00 with one surety.

The cases were both adjourned to December 4, 2023, at the Portsmouth Magistrate Court.

    Here is the irony in this sordid saga. By almost killing each other with cutlasses, both of they could have died leaving behind something they were fighting over.
    Where is the logic in all of this?
    If there is a dispute over land, take the matter to court.
    Now they are both going to end up in court.
    I would have expected adult men to act more responsibly.

    Hello and good evening my people. Well the article isn’t saying what the land dispute was about. Is it about ownership or boundaries. I have a situation in Dominica where a distant family is claiming part of my mother land and it’s coming upon seven years am in court with this person who surveyed part of my mother’s land. My mother didn’t give or sell any land to this person so how can he surveyed her land when he doesn’t have any papers for her land . I came to Dominica twice for court hearing but the case was postponed. So am not surprised that those issues can lead to violence. The Courts in Dominica have to take control of said issues in a timely manner.
