In a sworn testimony before a five-woman, four-man jury at the High Court this morning, a man accused of having sexual relations with a cow named Sally maintained his innocence even after the investigating officer WPC Linda Daisy told the court that the defendant had smelled of cow dung while she questioned him on the day of the incident.
The defendant was adamant that he “did not smell of no cow poo-poo”.
He told the court that at the time of the alleged incident – 9:30 a.m. on October 27,2008 – he had gone to pick oranges and grapefruits in the field that the cow was tied, but never went near the animal.
He said that persons who worked on a construction project with him nearby would normally have tea at 9 a.m. after starting work at 8 a.m. He said the work site was located approximately five minutes away from the field.
The defendant, under cross-examination, said that the cow was “meg and miserable”, unattractive and looked like it suffered from malnutrition.
When state lawyer Wayne Norde further questioned the accused whether he had found the cow’s “behind” to be big, the accused stated, “I didn’t watch it…. I didn’t go behind nothing.”
The defendant told the court that he had no prior problems with the owner of the cow, the eye witness or investigating officer involved in the matter. He said that he did not know the eye witness to be considered as a mad man in the community.
In closing his cross examination, Norde asked the accused whether he believe it was embarrassing for a man to be accused of having sex with a cow.
“For sure,” the accused replied.
The defendant further said that he would never admit if he had sex with a cow, whether he did or not, because it was shameful.
Sally died two months after the incident, the owner testified.
According to his evidence this morning, the vet had told him that the animal was now useless. Sally was a two-year-old heifer he had bought eight months prior to the incident.
The farmer told the court that he had heard of the incident at his home after tying the animal in the field after work that morning. He went back to his house – 15 minutes away.
While resting he heard somebody calling him. The eye witness came to him breathlessly saying that there was something he needed to tell him. They spoke then proceeded to the field where the cow was tied. He said he noticed that the cow was moving frantically and restlessly about until they had to calm it. He said that he noticed the cow’s genital was swollen and wet.
He subsequently approached the accused at his workplace.
“I have nothing to say. I was not on no cow and if he say he see me why he doe call me,” the accused had said when confronted by police and the owner.
Investigating officer Daisy said that the accused was given a medical form to be examined by a doctor. Details of the doctor’s report was not disclosed but Daisy said that she was present during the examination and that the defendant’s penis appeared to be medium sized – “nothing to jump or shout about”.
She told the court under cross-examination from defence lawyer Darius Jones, that she never took measurements of the accused’s height or the cow’s.
Yesterday, two prosecution witnesses testified in what state lawyer Wayne Norde deemed as an “embarrassing” case.
Veterinary Officer Reginald Thomas, an expert witness, said that during his examination of the 3 ½ – 4 ft animal on the day of the alleged incident, he noticed that the creature had reddening and haemorrhaging on its vulva (inside of vagina). Apart from this, Thomas said that there were actual signs of blood on the vulva.
The doctor told the court that based on clinical observations, the black and white cow was in heat at the time of the penetration. He did not believe that this extent of haemorrhaging was caused by a bull. He perceived that the incident took place “a couple hours” prior to his examination, based on observations.
Meanwhile, an eye witness testified that he had seen the accused having sex with the cow at about 9:30 a.m. while on his way to change the animal.
During his testimony, he demonstrated a thrusting motion he claimed the accused had done behind the cow for 15 to 20 minutes. He told the court that the owner of the cow and himself were both security guards who had gardens in the same area, so he would sometimes change his cow. He said he saw semen dripping from the accused private part at one point.
“He went out in the bush with his ‘wood’ outside. A big piece! You know what they call a big piece of wood? Penis…,” the witness told the judge.
The prosecution and defence are expected to give their closing arguments in the morning. A decision is also expected tomorrow.
The accused pleaded not guilty to bestiality yesterday where his trial began immediately before Justice Birnie Stephenson-Brooks.

We must get the facts straight before we offer these comments. The police officer was asked about the size of the penis by defence counsel and as such she was bound to give her opinion as opposed to she just offering information about the man’s penis.
