“Alcapone” trial enters eighth day, son gives riveting testimony

The murder trial of Edward “Alcapone” Green enters its eighth day on Wednesday with the son of the accused taking the stand to continue giving testimony.

He had already told the court that the entire trial was not easy for him but he testified that he knew that the deceased, Damien Dorival, along with another of his father’s tenants, owed money and was always in discussion with them concerning it.

He said his father was “upset” about the entire matter.

He told the court that on June 11, 2008 he arrived home late in the evening from “band practice” in Morne Prosper and upon reaching home heard a voice he identified as his father’s calling “Pino, Pino” (the son’s  nickname).

He responded, “what happen you fall again”?

“Come Come,” his father responded.

He said he went and put away his bass guitar and whatever he had in his hand, and proceeded to the yard where his dad was and was told, “I just shoot Damian, he did not see it coming.”

He testified that he was afraid because he saw a gun in his father’s hand ( he also identified the gun to the court).

He said that his father asked him to help remove the body which lay in a pool of blood on the  ground. Then his father began dragging the body to a parked jeep.

The young man told the court he was in shock and afraid that if he did not do what his father told him to do, he would be killed.

Alcopone then asked his son to grab  the legs of the dead man while he held on to the shoulder in order to place it in the parked jeep but the body was so heavy that they decided to switch positions, the son told the court.

They eventually placed the body in the jeep, which was rented by Dorival.

He said his father went into their house, placed the gun inside and returned with two plastic bags in his hands.

Alcapone then took the keys of the vehicle, which was on the ground next to the front tire and said, “don’t worry about that, I am safe.”

He told the court that the Dorival’s head was still on his body during the entire episode.

Also testifying was another tenant, fire officer Kennedy Fergerson and forensic expert, Cheryl Cobine, from Barbados.

She told the court she had received 36 items from the police in Dominica for testing. Among them were soil and clothing items of the deceased and the accused, Green.

None of Green’s clothing, which was tested, had any blood stains, she said.

Green is accused of murdering 35-year-old Dorival, whose headless body was found on Elmshall Road in June 2008. His head was later discovered in the Palm Grove River.

He is represented in the matter by attorney-at-law, Peter Alleyne.

    well from what i have read, the son is an accomplice too he get rid of the body with his father, he should be locked up to or Someone is lying here. This case is very fishy. Family and tenants in the yard did not hear gunshot?What about his friend who went to sleep how he did not the shots???

    So ppl can’t express their opinions man. What was so wrong with my comment it wasn’t posted? Forensics don’t lie.I think alcapone was set up and the real killers are still free.son testifies and identifies the gun yet bullet found was not fired bye the gun in evidence.if alacpone gets convicted it is on reputation and not evidence. In that case the jury would have failed the people and justice will not prevail.

    Wow, this case has to be the biggest in a long, long time. But I ask myself this question. Did the police mess up again and totally ignore doing forensic checks on the vehicle which was allegedly used by Alcapone to dispose of the body after having killed him IN THE SAME WAY THAT THEY MESSED UP IN THAT REGARD IN THE CASE OF MR. GON EMMANUEL????? If the son says that Alcapone put the body into this vehicle which had been rented by the deceased, then that vehicle would have had blood deposits consistent with the body being dragged into it after the shooting. Was that vehicle ever found? What condition was it in? Did anyone see Alcapone or anyone other than the deceased driving this vehicle at any time around the time of the crime having occurred? Did anyone see someone washing down this vehicle?? Was the vehicle found but burnt out?? There are so many questions………hmmmmmm My sincerest condolences to the family of the deceased. My dear friend Ian, your mum, your sister Susan and others in the family; I really feel terrible that you all must have to go through such pain upon having to lose a family member in such circumstances. I urge you to hold strong and pray that justice truly is done. I pray that the truth will come out. God bless you all…

      you have no facts have not followed this sad story but oh yes blame the police accuse them of messing up foolish as you are. for your info the vehicle was recovered on Virgin Lane with blood stains fool. you people always quick to blame the police and I wonder if you have any idea what it took to solve this murder.     if what the young man says is true then he was right to testify. It was very wrong and selfish of the father to commit murder and then get his son involved. It seems like the father has somewhat lost his mind if he can just casually kill someone as if it was within his right to do so just because he was owed money.

    I am not sure I understand. The gun found is not the gun that commited the crime the forensic does not show any contact with the deceased. Is it possible the son is lying? Could he be covering something else?

    it is alleged that the son who testified against his dad has a long history of disputes and hatred towards his dad.i am left to wonder if his testimony is truthfull.in addition he said that he assisted his dad to put the body into a jeep which was rented by dorival and also indicated that the head was still attached to the body,so are we left to wonder if dorival had a weapon on the jeep which the accused might have used to cut the deceased neck

    i watch alot of unsolve mystery and csi miami which is my favourite ..you cant judge a man for his actions but i believe this man is covering for some else ….and he is afraid also the son as well …we are not sure if the person didnt threaten the man and his son …so ppl only god and they know the truth and the dead man …as i said the dead man .,… dominica not hv the right crime ppl they wont get the true kill….

    It was said previously that the night that happened. Alcapone was in a rum shop and someone had to help him to his house because he couldn’t walk. he was dragging. so how could he have possibly commit such a crime in such condition? and if he could stand how did he put the body in the vehicle?.

Please people this is a planned crime and he coulkd have used another gun knowing that the police knows he owns a gun and would not be able to link his license firearm to the body. he had however to get rid of the head as its the area he shot Damian and water would work on that head to have ot decomposed quick. this man did all his research but he made two fatal mistakes. Pls follow the trial with an open mind.

    Good afternoon sweet Dominica. Well Mr Green admitted to the murder as his son stated in court. Now I don’t condone any criminal activity but how can a defense Attorney allowed Mr Green son to testify against him. The son should have went to court and invoke his right to self incrimination and refused to testify against his father. If the Judge try to force him to testify then he should say he do not recall the incident in that way they cannot hold him in Contempt of Court or charge him with perjury because he wouldn’t say anything where they could cross examined him base on prior statements he gave to the Police. I still don’t condone any criminal act but my people you all must understand how the Criminal Justice System works and you must used it to your advantage.

      It is “smart” people like you that are responsible for the high incidence of crime in the country, including the defense lawyer, of whose record we know all too well. The victim was my neighbor, and I watched as his family grieved and tried to come to terms with the senseless loss of life of their loved one. So you saying dapway the victim … make the killer a hero by soutiway-ing him to find a loophole in the law and escape justice. I wonder if you would have thought the same if the victim had been your brother and not Damian.

I also have twenty four years of Law Enforcement in NYC and I retired at the age of 48yrs. Anyway we can post and disagree but he don’t have to used derogatory language.

        Hi I understand what the son told the Court but I am talking about the trial which is approximately two year after the incident . The son wasn’t charged with Tampering with Physical Evidence or illegal Disposal of a human body therefore the defense Attorney should have used every means to prevent him from testifying against his father.

      Dominicans have a huge problem. They do not know their right. They need to learn this right, “The Fifth Amendment” of the U.S. which should apply in any part of the democratic world.
      From reading the articles and comments on DNO a lot has to be changed in Dominica for the benefit of all.

        Hello. The victim was already dead before the son got home and he didn’t plan the shooting with his father. They should charged him with Tampering with Physical Evidence and Illegal disposal of a human body not Conspiracy to commit murder.

        I agree with you….at the end of the day he should be charged. the question is what is he guilty of? Whether he gets convicted, tht is another matter but he was an accessory after the fact.

        Whether or not he was scared would be his defence to make. No one knows the relationship he had with his dad and whether that is a true defence.

        Did he go and confess to the cops after the fact…when his father drove off with the body? How did he end up in the position as a witness?
        Was he charged adn offered a plea deal?

        Admin – what is the back ground behind the story. that reporting is incomplete as it doesnt give us enough information. Especially those of us who do not have the ease of access to the case and or details.
